M.2.2 - PRIOR EXPERIENCE

Ratings for Prior Experience will be based on a scale of Unacceptable -> Acceptable -> Very Good -> Excellent, with Unacceptable equaling a numeric score of “0” and Excellent equaling a numeric score of “5”.

M.2.2.1 Description:

This criterion will measure the breadth, depth and relevance of an offeror’s prior experience in performing projects similar in size, scope and complexity to the one described in this RFP. Similar size is primarily determined by experience with facilities of a comparable square footage. Similar scope is defined by performance of the same type of services. And similar complexity is defined by the same types of facilities - in this case general office and courthouse space. Such projects must have involved operations and maintenance and related services. Prior experience by predecessor companies and or affiliated key personnel and subcontractors may be considered.

Previous projects may have been governmental (federal, state, or local) or private sector contracts. Experience on similar projects for the Federal Government is considered an asset.

M.2.2.2 Prior Experience Submission:

By the closing date for receipt of proposals, the offeror is requested to submit a Form M.8 with a detailed descriptive listing for three (3) projects performed within the past five (5) years that are similar in nature to the one described in this RFP. For Contractor Team Arrangements (CTA), joint ventures, or any major subcontractor arrangements, the teaming agreement between both parties should be submitted detailing ownership stakes, roles and responsibilities.

Projects may be submitted for the CTA/joint venture as an entity or for an individual member of the CTA/joint venture. Prior experience working together in a CTA/joint venture minimizes risk to the Federal Government.

More recent performance may be deemed to have greater importance than less recent performance. “Similar” is defined as projects comparable in terms of such factors as square footage, duration, complexity of equipment and systems, makeup and mission of buildings and their occupants, types of services performed or level of Contractor responsibility and authority. For ongoing contracts, the Contractor must have a minimum of six (6) months experience performing the services at those location(s) by time of the closing date of this RFP in order for those contracts to be evaluated as part of the offeror’s relevant prior experience. The detailed description submitted for each project should include, as a minimum, the following information:

a. Type of facility, number and geographical locations of associated buildings, nature of tenant mission and population, square footage, complexity of equipment, age of facilities.

b. Estimated annual dollar value of contract.

c. Description of services provided and the offeror’s level of responsibility and authority on the project.

d. List of subcontracted services and subcontractors used, along with estimated annual cost of each subcontracted service.

e. Type of contract (e.g., cost reimbursable, incentive fee, award fee, time and materials, fixed price, etc.).

f. Date of contract start and completion, including options.

g. Name, title, address, phone number, and email of customer contact. It is incumbent on the offeror to ensure the customer information is current and accurate.

h. Name, title, address, phone number, and email of the building's owner or a representative of the owner who can attest to the quality of the services provided. It is incumbent on the offeror to ensure this information is current and accurate.

Solicitation 47PG0121R0005, Section M Page 6 of 16

M.2.3 - PAST PERFORMANCE

M.2.3.1 Description:

This criterion will evaluate the quality of an offeror’s past performance in performing services for projects similar in size, scope and complexity to the one described in this RFP. It assesses the offeror’s overall quality of past performance, record of conforming to contract requirements and to standards of good workmanship; the offeror’s adherence to contract schedules, including the administrative aspects of performance; the responsiveness of management; the offeror’s history of reasonable and cooperative behavior and commitment to customer satisfaction;

including the offeror’s business-like concern for the interest of the customer, and the offeror’s overall performance on their contracts. Evidence of a history of successful past performance as a team will be considered an asset for any

Contractor Team Arrangements (CTAs), joint ventures and subcontracting arrangements.

Past performance will be evaluated by analysis of the information requested and provided under Prior Experience

(above), as well as information obtained through interviews with the offeror’s customers and/or the building's owner or a representative of the owner. Regarding past performance on any projects submitted on behalf of managers, key personnel, subcontractors or other partners, evidence of collaborative prior experience among the partners will be viewed favorably.

The Government shall apply similar analysis techniques and overall scoring techniques to all past performance references, regardless of the method of submission used. There is no additional weight applied to the past performance factor based on the method of submission. If less than three references are submitted, the Offeror will be scored zero for those references unsubmitted. In the event an Offeror without a record of relevant past performance, the Offeror will be rated neutral.

Ratings will be based on a scale of No Confidence -> Unsatisfactory -> Marginal -> Satisfactory -> Very Good ->

Exceptional, with No Confidence equaling a numeric score of “0” and Exceptional equaling a numeric score of “5”.

In addition to those references provided directly by the offeror, the Contracting Officer may identify and analyze the relevant past performance of the offeror on any other contract on which they have performed within the past five (5) years of which the Contracting Officer has knowledge or obtains knowledge. Because of the wide variety of past performance history of individual offerors, the Government is not required to ensure that an equal number of references be obtained for each offeror.

M.2.3.2 Past Performance Submission:

The offeror is required to submit form M.9 – Past Performance Reference Information to include each project submitted under Factor M.2.2 Prior Experience.

Offerors may elect to submit past performance records in one of the following two ways (indicated in form M.9): (1)

CPARS Report(s), or (2) Google Form Past Performance Survey. Form M.9 is required as part the technical proposal submission regardless of which past performance record format is elected

1. CPARS Report

The offeror is not required to submit the actual CPARS report.

2. Google Form Past Performance Survey, if applicable

If an offeror elects to utilize the Google Form Past Performance Survey the offeror must contact the

Contracting Officer at lauree.morris@gsa.gov no later than the scheduled Proposal Questions due date in the solicitation to receive their unique Google Form hyperlink. This hyperlink should be submitted to an agent of the purchasing entity for the prior experience reference. This agent must complete the Google

Form no later than the closing date of the solicitation. A sample of the Google Form Past Performance

Survey can be found in M.11 - Google Form Example.

M.3. - PRICE EVALUATION

M.3.1 Description:

For evaluation purposes only, a total evaluated price will be computed utilizing the following formulas.

The base period contract price for each offer will be determined based on the Price Sheets as follows: Base

Period I: (12 Months):

Item 0001: Basic O&M Services multiplied by 12 months.

Item 0002: Providing O&M services after normal duty hours multiplied by 250 hours.

Item 0003: Providing Maintenance Repair services beyond contract requirements during normal duty hours multiplied by 250 hours.

Item 0004: Providing Maintenance Repair services beyond contract requirements after normal duty hours multiplied by 100 hours.

Item 0005: Estimated Material value needing handling of $60,000.00 times bid %.

Item 0006: Estimated Subcontracting value needing management of $100,000.00 times bid %.

Item 0007: Providing Replacement of (HVAC Systems) Air Filters by 12 months.

Item 0008: Providing O&M Services for North District Courts agency owned equipment multiplied by 12 months

The total evaluated price for the base period will be the sum of items 0001 through 0008.

The Option I through IV contract price for each offer will be determined based on the Price Sheets as follows:

Option Periods: (12 Months):

Item 1001: Basic O&M Services multiplied by 12 months.

Item 1002: Providing O&M services after normal duty hours multiplied by 250 hours.

Item 1003: Providing Maintenance Repair services beyond contract requirements during normal duty hours multiplied by 250 hours.

Item 1004: Providing Maintenance Repair services beyond contract requirements after normal duty hours multiplied by 100 hours.

Item 1005: Estimated Material value needing handling of $60,000.00 times bid %.

Item 1006: Estimated Subcontracting value needing management of $100,000.00 times bid %.

Item 1007: Providing Replacement of (HVAC Systems) Air Filters by 12 months.

Item 1008: Providing O&M Services for North District Courts agency owned equipment multiplied by 12 months

The total evaluated price for Option I - IV will be the sum of items 1001 through 4008.

Six Month Extension:

The six-month option to extend will be evaluated by totaling the prices for Option Period IV (items 4001 - 4008) and dividing the result by two (2).

M.3.2 CALCULATED TOTAL EVALUATED PRICE:

The total evaluated price for the Base Period, four (4) Option Periods, and six-month extension period will be added together to determine the total evaluated price for each Offeror.

The Government reserves the right to accept or reject the line item prices when awarding the contract.

THE ABOVE FORMULA IS TO BE APPLIED BY THE GOVERNMENT, NOT THE CONTRACTOR.

M.3.3 Proposed Pricing Notes:

▪ The Government may determine an offer is unacceptable if the prices proposed are materially unbalanced between line items or subline items. An offer is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the offer will result in the lowest overall cost to the

Solicitation 47PG0121R0005, Section M Page 10 of 16

Government, even though it may be the low evaluated offer, or it is so unbalanced as to be tantamount to allowing an advance payment.

The Government may (1) reject any or all offers if such action is in the public interest, (2) accept other than the lowest offer, and (3) waive informalities and minor irregularities in offers received.

▪ The Government intends to evaluate proposals and award a contract without discussions with Offerors

(except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the Offeror’s best terms from a cost or price and technical standpoint. However, the

Government reserves the right to conduct discussions if later determined by the CO to be necessary.

▪ The Government may accept any item or group of items of an offer, unless the Offeror qualifies the offer by specific limitations. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the Offeror specifies otherwise in the offer.

M.4. - FAR 52.217-5, EVALUATION OF OPTIONS

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the

Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

M.5. - WRITTEN NOTICE OF AWARD

A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the Offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Negotiations conducted after receipt of an offer do not constitute a rejection or counteroffer by the Government.

Prior to award Offeror must be registered in the SAM (System for Award Management) database at http://www.sam.gov.
