Ms. Grimes:

On July 11, 2023, Mike Burke, of Farmer Environmental Services, LLC, performed a limited survey for hazardous materials in connection with the upcoming masonry repair project for the Courthouse roof at the Melvin Price Federal Building in East St. Louis, IL. The scope of the survey included testing for asbestos containing building materials, suspect lead-based paint, and Polychlorinated Biphenyls (PCB’s) associated with the roof balustrade for the Courthouse.

ABATEMENT PROJECT DESIGN.

Asbestos Sampling:

The sampling procedures were performed in general accordance with the guidelines published by the Environmental Protection Agency (EPA) in 40 CFR Part 763 Subpart E, October 30, 1987, and NESHAP regulation (40 CFR part 61, April 6,1973, revised 1990). The survey was performed by Mike Burke. Mr. Burke is an IDPH (#100-08353) licensed asbestos building inspector.

Six suspect materials were identified and sampled by the inspector. In accordance with industry standards, three bulk samples were collected for each homogeneous area. By definition, a homogeneous area means an area of surfacing material, thermal system insulation material, or miscellaneous material that is uniform in color and texture and is installed within the same period.

The bulk samples were submitted to International Asbestos Testing Laboratories (NVLAP accredited) for analysis by Polarized Light Microscopy (PLM). PLM is the recognized method for determining fibrous bulk asbestos content. Any product containing more than 1% fibrous asbestos, when analyzed by PLM, is considered a potential hazard by the Environmental Protection Agency (EPA).

The following is the key for the 3-letter “homogeneous area” identifications.

ABATEMENT

CFR Sec. 61.145(c)(1) requires that the owner or operator of a facility remove all Regulated Asbestos-Containing Material (“RACM”) from a facility being demolished or renovated before any activity begins that would break up, dislodge, or similarly disturb the material or preclude access to the material for subsequent removal. “RACM” is defined in 40 CFR Sec. 61.141 as: “(a) Friable asbestos material, (b) Category I non-friable ACM that has become friable, (c) Category I non-friable material that will be or has been subjected to sanding, grinding, cutting or abrading, or (d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by this subpart.”

Friable ACM is any material containing more than one percent asbestos (as determined by Polarized Light Microscopy) that, when dry, may be crumbled, pulverized, or reduced to powder by hand pressure.

Non-friable ACM is any material containing more than one percent asbestos (as determined by Polarized Light Microscopy) that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure.

Abatement will be necessary if renovation activities will impact or disturb the asbestos containing material listed above. The caulk itself was not found to be asbestos containing, but the tar-like material beneath it was positively identified as ACM. The most likely explanation is the black tar-like material is roof flashing mastic associated with the roof curbing up the base of the wall.

Lead-Based Paint Sampling:

Deteriorated paint was identified on the metal beams and cross bracing used to support the balustrade wall. Paint chips were collected from the cross bracing as well as the beam that runs along the interior face of the balustrade wall. The paint chip sampling was performed by Mike Burke. Mr. Burke is an IDPH licensed lead risk assessor (#005784). Two paint chip samples were submitted to International Asbestos Testing Laboratories, Inc. (AIHA-accredited, lead) for analysis by Atomic Absorption Spectroscopy (AAS). The EPA standard for lead-based paint is 0.5% lead by weight.

Sample analysis showed concentrations of lead below the criterion of 0.5% lead by weight. The paint associated with the balustrade support beams and cross bracing is not lead-based paint.

Testing did identify concentrations of lead concentrations under the criterion referenced above. Paint with concentrations of lead at less than 0.5% by weight is deemed lead containing paint versus lead-based paint. Lead can still be present in paint which is not classified as “lead-based”. This would occur when the paint has a lower amount of lead than the EPA regulates. If lead is present in the paint, lead dust can be released when the paint deteriorates, or is disturbed during remodeling, renovation, sanding, or some maintenance work that breaks the surfaces of the paint. Activities that impact lead containing paint should be performed in accordance with the OSHA lead standard for the construction industry.

Polychlorinated Biphenyls Sampling Caulk has been determined to be a possible source of Polychlorinated Biphenyls (PCB’s). The inspection resulted in the identification of five different types of caulking that had been applied to various surfaces related to the balustrade wall.

The inspector collected a sample of each type of caulk associated with the balustrade wall. The samples were submitted to Teklab, Inc., for analysis for PCB’s by EPA SW-846 3546 8082.

Materials (solids) with concentrations of PCB’s greater than 50 Parts per Million (ppm) have to be disposed of as hazardous waste. The lab analysis showed all five samples to be None Detected for Polychlorinated Biphenyls, therefore the caulk associated with the balustrade wall is not deemed hazardous for PCB’s.
