About this file

This is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by Salt Lake City Corporation Purchasing & Contracts Management Division for use by contractors or private providers submitting bids in response to Request for Bid SLCI27035 for a new Zamboni ice resurfacing machine for the Gallivan Center. The form allows bidders to identify and protect records or information they consider confidential or proprietary in their bid submissions. The document references Utah Code provisions 63G-2-305(1) and 63G-2-305(2), which permit protection of trade secrets and commercial financial information if the submitting party demonstrates that disclosure could result in unfair competitive injury and provides a formal confidentiality claim with supporting justification.

Bidders using this form must provide claimant information including company name, address, contact details, and the name of the company representative, then specify which pages and paragraphs of their submission contain confidential information along with concise statements of reasons supporting each claim. The form requires bidders to indicate whether a public redacted copy of the records is also being provided and notes that submission of a confidentiality claim does not guarantee protected classification if the government receives a records request. This form serves as a procedural mechanism for protecting sensitive business information within bid submissions while maintaining compliance with Utah's public records laws.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
