About this file
This is a Privacy and Security Agreement document issued by the San Francisco Department of Public Health (SFDPH) Office of Compliance and Privacy Affairs (OCPA) for contractors and partners who receive or access health or medical information or electronic health record systems maintained by SFDPH. The agreement contains two attestation forms—a Privacy Attestation Form and a Data Security Attestation Form—that contractors must complete and retain for seven years. The Privacy Attestation Form requires contractors to confirm compliance with Health Insurance Portability and Accountability Act (HIPAA) standards, including maintenance of formal privacy policies, designation of a privacy officer, mandatory employee privacy training upon hire and annually thereafter, signed acknowledgments of training, Business Associate Agreements with subcontractors, encrypted device usage for health information transfer, timely deprovisioning of employees within two business days, provision of HIPAA-compliant privacy notices in patients' preferred languages, posting of privacy practice summaries in six languages in patient areas, documentation of health information disclosures, and prior authorization forms for information releases beyond treatment, payment, or operations. The Data Security Attestation Form requires contractors to conduct data security assessments and audits at least every two years, document remediation plans addressing identified risks, maintain a formal Data Security Awareness Program and security policies compliant with HIPAA and the Health Information Technology for Economic and Clinical Health Act (HITECH), designate a Data Security Officer, require employee data security training upon hire and annually, obtain signed employee acknowledgments of training, establish Business Associate Agreements with subcontractors, and maintain a diagram documenting data flow between the contractor's organization and all subcontractors or vendors including access methods and processing systems. Contractors must attest under penalty of perjury to the accuracy of their responses, and any "No" or "Not Applicable" answers require review and approval by OCPA.
The agreement applies to all contractors working with SFDPH who handle protected health information, with specific additional requirements for contractors serving patients or clients directly. SFDPH provides privacy and data security training materials available upon request by contacting OCPA at 1-855-729-6040 or compliance.privacy@sfdph.org. All exceptions or non-compliant answers must be submitted to OCPA for consultation and formal approval before contractor engagement. The document functions as a compliance framework requiring contractors to demonstrate mature privacy and security governance structures and to maintain comprehensive documentation of training, audits, assessments, and security practices throughout the contract period.
