APPENDIX C - SUBMITTAL REQUIREMENTS

C.1 INTRODUCTION

Project design requires iterative review and approval by U.S. Customs and Border Protection (CBP) and other relevant stakeholders. The submission requirements listed in this appendix apply to all projects at Land Ports of Entry (LPOEs) where architects and engineers (A/Es) engage in new construction or renovation projects. Due to the complexity and difference in project requirements, the submittal requirements in this appendix may vary for each project.

The multidiscipline facility design for CBP is complex in nature and the design process involves various reviews by stakeholders with different backgrounds. This appendix defines minimum submittal requirements for the A/E to use to facilitate CBP design submittal reviews. The A/E and general contractor must engage with the Field Operations Facilities Program Management Office Project Manager (FOF PMO PM) at the earliest possible phase to discuss and confirm the submittal requirements, including the schedule of deliverables and the contents of each deliverable package.

The A/E and general contractor must also coordinate with the FOF PMO PM on the logistics of design reviews, including expected review times, delivery methods, and format. In each phase of work, project documents must be submitted to CBP in electronic and hard copy format as determined by the FOF PMO PM. Submittals that do not include all the elements or level of detail expected by CBP will delay the review process and may result in substantial changes surfacing later in the review process.

C.2 DOCUMENTATION SECURITY REQUIREMENTS

Construction project documentation or other information pertaining to federal facilities is typically considered sensitive but unclassified information that may be exempt from public release under the Freedom of Information Act (5 U.S.C. § 552).

Information where the unauthorized disclosure of which could adversely impact a person’s privacy or welfare, the conduct of Federal programs, or other programs or operations essential to the national interest must be designated as “For Official Use Only (FOUO).”

FOUO is the designator used to identify protected unclassified information that is not otherwise governed by statute or regulation as outlined in Department of Homeland Security Management Directive (DHS MD) 11042.1, Safeguarding Sensitive but Unclassified (For Official Use Only) Information.

The FOUO information is to be controlled, stored, handled, transmitted, distributed, and disposed of in accordance with DHS MD 11042.1, and it is not to be released to the public or other personnel who do not have a valid “need-to-know” without prior approval of an authorized official.

Any U.S. Department of Homeland Security (DHS) employee, detail employee, or contract employee can designate information as FOUO provided it meets the sensitivity threshold defined in any one of the eleven categories of information within DHS MD 11042.1. The Office of Professional Responsibility (OPR) may designate information as Sensitive Security Information (SSI). For information regarding SSI document handling requirements, refer to the current CBP Information Security Handbook 1400-04A.

Information designated as FOUO must be sufficiently marked so that persons who have access to it are aware of its sensitivity and protection requirements. Within any electronic or printed project documentation, including but not limited to narratives, C-3

FOUO information must not be entered or posted on any public website and must not be permitted to be sent to personal email accounts.

C.3 SUBMITTAL COMPONENTS

C.3.1 Blocking/Stacking Diagrams

Blocking and stacking diagrams must use the developed space program and demonstrate compliance with CBP-approved requirements, including all adjacencies and functional spaces. This pre-design component also shows that the proposed project is feasible from a zoning perspective and that the form of the buildings (if applicable) will fit the site’s constraints. CBP will evaluate building and site layout early for effectiveness and efficiency related to throughput, operation, safety, security, and maintenance. At this stage, these diagrams provide a crucial opportunity for CBP to address design-based threats, chokepoints, access points, and connections to adjacent properties/infrastructure.

C.3.2 Facility Long-Term Master Plan

The long-term master plan must follow the requirements set forth in Chapter 4, “Site Planning,” of this Standard. In coordination with the agency stakeholders involved in the regional planning for an LPOE, the A/E must develop and submit for approval a formal master plan for each LPOE project. For new construction projects with an existing master plan, the A/E must develop and submit for approval an updated master plan.

C.3.3 Narratives

A. Format

The A/E must produce digitally encrypted PDF narrative files for each design discipline.

B. Content

Narratives explain the design intent and document decisions made during the design process. As with drawings and specifications, narratives are an important permanent record of the building design. Drawings and specifications are

a record of what systems, materials, and components the building contains. Narratives must record why these systems, materials and components were chosen and how they meet codes, standards, and regulations. The narrative of each submittal may be based on the previous submittal, but it must be revised and expanded at each stage to reflect the current design.

C.3.4 Calculations

Manual and/or computer-based calculations must accompany narratives where required to support technical analysis. Each set of calculations should start with a summary sheet which shows all assumptions, references, applicable codes and standards, and lists the conclusions. The calculations for each submittal must be cumulative so that the final submittal contains all applicable calculations for the project. Calculations submitted at early stages of the project must be revised later to reflect the final design. Calculations must refer to code, paragraph of code used, standards, and textbooks used for specific calculations. Contractors must refer to the drawing and detail number where the results of the calculations have been used.

C.3.5 Building Performance Criteria

As part of the development of concepts, building performance criteria must be checked against the selection of systems and materials and the construction documents.

C.3.6 Drawings

A. Lettering

Lettering on drawings must be legible when drawings are reduced to half size and in electronic format. This applies to concept and design development drawings and construction documents. Nine point or 1/8-IN-high text is the minimum size for lettering on full-size drawings.

B. Drawing Scale

All drawings must include numeric scales. Graphic scales are preferred for site plans. The scale selected must be appropriate for high resolution and ensure legibility on reduced copies, such as half-sized sets. A north arrow must be included on site and plan view drawings.

C. Drawing Index

Each submittal must include a drawings index. This index must identify drawing revisions as necessary. If the drawing set includes more than one volume, each volume must include a drawing index for the entire set.

D. Seals

Each sheet of the final construction documents must bear the seal and signature of the Engineer or Architect of Record. Documents produced electronically may have digital signatures and seals.

E. Cover Sheet

On the cover sheet, designers must provide a certification statement for code compliance with specified codes and standards by each discipline with the Engineer or Architect of Record’s signature. The date of the submittal and percentage level of completion must also be included. The intent is to identify the phase/completeness of the design

and the professional contractually responsible for the design. A separate sheet may be provided for the code analysis documentation.

C.3.7 Specifications

A. Format

Specifications must be produced per the current edition of the Construction Specification Institute’s (CSI) MasterFormat divisions. Each page must be numbered. Specifications must be bound and include a table of contents.

The specifications must include instructions to bidders.

B. Editing of Specifications

The A/E is responsible for editing specification sections, including government-furnished guide sections, to reflect the project design intent, CBP requirements, and federal law. Technical specifications must be coordinated with drawings to ensure that everything shown on the drawings is in the specifications. Specification language that is not applicable to the project must be excluded.

C.4 DESIGN REVIEWS

At the end of each design stage, the A/E must submit the design documents to the FOF PMO PM for review, comments, and approvals by project stakeholders.

Technical Services and other CBP stakeholders will review design drawings for conformance with CBP design standards, criteria, building and systems performance, efficient and effective design, and identified risk factors. At each design stage, the A/E must complete a design review checklist and submit it to the FOF PMO PM along with one complete set of design submittal documents, including but not limited to drawings, specifications, design narratives, and responses to all previously submitted comments. Refer to the Submittal Requirements Matrix in Table C-2 of this appendix for a minimum list of required submittals at each design phase. These submittals must be encrypted and delivered electronically. They may also be delivered in hard copy if requested by the FOF PMO PM.

The FOF PMO PM must verify that the submittals comply with this Standard, programming documents, and other CBP requirements. Upon conclusion of the design review process, all review comments will be compiled and verified by the FOF PMO PM. The comments must clearly explain design deficiencies and required modifications to be incorporated in future submittals. With each design phase, the A/E must submit a comment log with responses to each design review comment indicating how the comment has been addressed in the design documents.

C.5 COST ESTIMATING

C.5.1 Estimating Methodology

CBP requires the A/E or design-build (D/B) team to provide cost estimates in every pre-bid submission, adding details commensurate with the level of the submission as the work progresses.

CBP has adopted the AACE International Cost Estimate Classification System—As Applied in Engineering, Procurement, and Construction for the Building and General Construction Industries. The A/E must provide cost estimates commensurate with

• Executive summary.

• Basis of estimate, rationale, assumptions, and market analysis.

• Summary reports.

• Detailed line-item cost reports.

C.6 PROJECT SUBMITTALS

Typically, Customs and Border Protection (CBP) construction projects require multiple submittals during the design phase of the project. Depending on the complexity of the design, CBP may require additional submittals or allow combining required design elements in fewer submittals. The following represents a typical high-level overview of CBP’s breakdown of the project phases. Please refer to Table C-2, Submittal Requirements Matrix, in this appendix for detailed submittal requirements for each phase.

C.6.1 Pre-Design and Programming Phase (Concept)

This phase establishes project criteria and defines possible solutions. The limitations are discussed, and the program schedule is validated. This phase may also include additional document development to support the next phase, which is schematic design. The main submittal in this phase is generally a feasibility study. The feasibility study must include all programming, planning, and existing condition information that will help the full project team determine the feasibility of the project. It may also present multiple alternatives (different locations, different methods of re-use or construction, or different facility configurations) and their benefits/costs. The recommended concept must be approved by the Field Operations Facilities

• Updated description of proposed solutions and systems.

• Utility distribution and collection systems.

• Fire protection, water supplies, fire hydrants, and fire apparatus access roads.

The schematic design package must be approved by the FOF PMO PM prior to commencing with the design development phase.

C.6.3 60% Design Phase (Development)

Once CBP has reviewed the schematic design and the review comments have been validated for inclusion in the design, the 60% design development must commence.

The objective of the 60% design development phase is to identify all project elements, products, and details that will become a basis of the design shown in the construction documents in future design submittals. The drawings for this submission must be presented in the format that will be used in future construction documents’ development.

Outline specifications must be in the current CSI MasterSpec format, including products selected for the project, general coordination, and execution requirements for each discipline.

C.6.4 60–100% Design Phase (Construction Documents)

When the 60% design review comments have been received, the designer must proceed with the construction documents development. Typically, this phase requires design submittals at 60%, 90%, 100%, and/or final stages. For smaller scale renovation projects, CBP may elect to combine the 30% and 60% submittals into a single 50% submittal. Each one of the subsequent construction document phase submittals must address the review comments received from the FOF PMO PM in response to the previous submittal. Upon completion of this phase, the construction contract documents must be finalized, and all outstanding issues must be resolved. Construction documents issued for final submittal must be signed and stamped by professional engineers for each discipline.

The specifications must be complete and well-coordinated with the drawing package and other relevant disciplines. Drawings should include further refinement for details introduced at the 30% submission stage, including coordinated cross-references with relevant disciplines. The drawing package must include all required drawings finalized and ready for construction.

The construction documents narrative must indicate how the design review comments received from the previous submission have been addressed and how the subsequent design submittal addresses construction documents development. The narrative must also indicate how the submitted construction documents meet or deviate from the program objective. The final design narrative must reflect the recorded version of design with all the outstanding issues resolved.

The construction documents narrative must include a statement confirming that the design fully complies with CBP requirements, the approved POR, the engineering system design targets, adopted value engineering changes, and applicable codes and regulations. The narrative must reflect the final design and must be signed by the A/E. The construction documents narrative must, at minimum, include the following information:

• Final description of any deviation from systems as approved in the schematic design phase submittals.

• Description of special systems and how they are coordinated with relevant disciplines.

• Description of plumbing system, including domestic cold and hot water, sanitary and storm drainage, and irrigation systems.

The construction documents must be approved by the FOF PMO PM before commencing with the construction phase.

C.6.5 Construction Phase

The A/E’s responsibilities (in coordination with CBP) will include review of product and shop drawing submittals, responses to requests for information (RFIs), site visits, monitoring of construction, sign-off and systems start-up, review of change orders, and on-site meeting attendance. The A/E may be involved in developing supplemental drawings and specifications to address changes to the design.

C.6.6 CBP Acceptance/Occupancy Phase

CBP must approve construction conditions during pre-occupancy acceptance and validation of substantial completion. The FOF PMO PM acts as the single point of approval for CBP regarding acceptance of a facility for beneficial occupancy and also for final facility acceptance. The FOF PMO PM designates CBP personnel to participate in required walk-throughs, punch list reviews, and commissioning and training exercises related to building systems.

In addition, CBP requires the performance of periodic post-occupancy evaluation and reviews. The evaluations are focused on the performance of the facility and validation of the design criteria. Most of this evaluation is completed by facility occupants, such as CBP personnel and maintenance contractors. CBP may require the A/E to participate in these activities, as the findings of this evaluation may result in modifications/corrections to the facility.

C.7 SUBMITTAL REQUIREMENTS MATRIX

The following Submittal Requirements Matrix includes detailed submittal requirements for each design discipline that may be included in the scope of the project. Only applicable design elements from this matrix are required for a given project.

Depending on the scale and complexity of design work, CBP may allow flexibility on some design elements listed in the matrix.
