About this file
This document contains the bid security, performance bond, and trench safety requirements for the Martin Luther King Jr Drainage Improvements project (IFB NO. 012-26-RM) issued by the City of Tallahassee, Florida. The project addresses localized flooding at the intersections of Barbourville and Young streets with MLK Jr Boulevard by improving roadway and gutter hydraulics, reducing lane width between intersections, and establishing positive longitudinal gutter grade. Contractor responsibilities include reconstruction of the MLK Jr northbound lane and curb and gutter, construction of stormwater curb inlets and manholes, installation of an 18-inch reinforced concrete pipe outfall, relocation of 8-inch and 6-inch water mains, roadway milling and resurfacing, driveway reconstruction, stormwater pollution prevention, tree protection, and traffic maintenance. The contractor must submit a bid bond equal to not less than five percent of the base bid and, upon contract award, provide a performance bond equal to one hundred percent of the contract sum within ten consecutive calendar days of written notice of award.
Bidders must acknowledge that trench safety compliance costs in accordance with the Florida Trench Safety Act (Chapter 90-96, Florida Statutes) are included in their bid prices and must provide a detailed breakdown of trench safety measures by unit of measure and cost. The performance bond guarantees faithful performance of all contract terms, timely payment to all claimants supplying labor, services, materials, or supplies, and a two-year warranty period from final written acceptance of all work, including remedy of any defects and payment for damage to other work resulting from defects. Any changes, extensions of time, or forbearance granted by the City do not release or affect the obligations of the contractor or surety under the bond. The surety must be a corporation duly authorized under Florida law to act as surety on bonds, and the power of attorney showing authority of the attorney-in-fact must be attached to the bond.

Description of Project: ML King Jr Drainage Improvements
IFB NO. 012-26-RM
The Contractor will provide labor, materials, equipment, supplies, services, skills, supervision and necessary tools and equipment, and other incidentals throughout the Contract period, required for the successful construction of the MLK Jr Blvd Drainage Improvements Project.
The intersections of Barbourville and Young with MLK Jr. Blvd. retain stormwater for extended periods of time resulting in localized flooding within each intersection as well as the northbound lane of MLK Jr between these two intersections. Currently there is no existing stormwater infrastructure directly serving the MLK-Young and MLK-Barbourville intersections or the segment of MLK Jr. roadway in between. The existing roadway consists of an urban typical section with curb and gutter however there are no inlets or pipes to adequately collect, capture and convey stormwater runoff. The longitudinal slope of the segment of MLK is mostly flat furthering the localized flooding and roadway spread deficiencies of the area. The project will provide roadway and intersection flooding mitigation through improved roadway and gutter hydraulics by reducing the existing lane width between the intersections and establishing a constant positive longitudinal gutter grade. This project will also include construction of new stormwater curb inlets and an associated 18” RCP outfall that will begin at the Barbourville intersection run under MLK and connect to the existing City stormwater system located at the Rudy Hubbard and MLK Blvd. intersection. Reducing the lane width between the two intersections will allow the new gutter line to circumvent the existing 63-inch Live Oak and also contain the roadway north bound lane and associated curbing gutter within the existing right of way. The project will include the reconstruction of the MLK Jr. north bound lane and curb and gutter through and between the Barbourville and Young Street intersections. It will also include the construction of stormwater curb inlets & manholes, stormwater conveyance pipes, 8” & 6” water main relocation, roadway milling and resurfacing, driveway reconstruction, SWPP, tree protection and other pay items included in the Contract Documents.
The project also includes other items incidental to construction, such as: disposal of materials removed; maintenance of traffic, and restoration of disturbed areas.
The Contractor shall have the capability to perform and complete the services in all respects in accordance with the solicitation documents. The Contractor here by warrants that all services will be performed in a timely and first-class workmanlike manner.
BY THIS BOND, We, the above-named Contractor and the above-named Surety, a corporation duly authorized under the laws of the State of Florida to act as surety on bonds, are held and firmly bound to the CITY OF TALLAHASSEE, a Florida municipal corporation, hereinafter called the City, in the following sum:
____________________________________________________________ DOLLARS
($_________________________________), for payment of which we bind ourselves, our personal representatives, successors, and assigns, jointly and severally.
THE CONDITION OF THIS BOND is that if Contractor:

4. Pays to the City all losses, damages, expenses, costs, and attorney's fees, including appellate proceedings, that the City sustains by reason of any failure by the Contractor to fully and completely perform the Contract; and, performs the guarantee of all work, materials, and equipment furnished under the Contract for the time specified in the Contract, including without limitation the remedy of any and all defects in or from the said work, and payment for any damage to other work resulting therefrom, which may exist, appear, occur or result within a period of two (2) years from the date of final, written acceptance of all work under the Contract, then this bond is void; otherwise it remains in full force and effect.
Any changes in, or under, the Contract; any granting of an extension of time for the performance of the Contract; any other forbearance by or on the part of the either the City or the Contractor; or any compliance or noncompliance with any formalities connected with the Contract or changes thereto shall in no way release or affect, in any way, the obligations of either the Contractor or the Surety under this bond.
