About this file

This is an exemption verification letter from the Northwest Florida Water Management District (NWFWMD) to the City of Tallahassee regarding the MLK Jr. Boulevard Stormwater Improvements Project (Application #PDEX-073-325542-1). The letter, dated July 21, 2025, confirms that the project is eligible for an exemption under 62-330.051(2) and will not require a District permit. The exemption also constitutes an express waiver of water quality certification under Section 401 of the Clean Water Act. The project addresses localized flooding at the intersections of Barbourville and Young with MLK Jr. Boulevard by reducing existing lane width, establishing positive longitudinal gutter grade, constructing new stormwater curb inlets, and installing an 18-inch reinforced concrete pipe (RCP) outfall that will connect to the existing City stormwater system at the Rudy Hubbard and MLK Boulevard intersection. The project will include reconstruction of the MLK Jr. northbound lane, curb, and gutter while preserving an existing 63-inch Live Oak tree.

The exemption verification applies only to the NWFWMD's regulatory requirements and does not relieve the applicant of meeting permit requirements from other agencies. Contact information for questions regarding the exemption was provided as Brandy Parker at (850) 951-4669. The document was issued by Selina Potter, P.E., Bureau of Regulatory Permits, with a Certificate of Service dated July 21, 2025, confirming proper notification to all applicable parties.

This exemption verification only applies to the requirements of the District and does not relieve you of meeting the permit requirements of other agencies. Please contact Brandy Parker at (850) 951- 4669 if you have any questions.
