About this file
This is a Claim of Business Confidentiality Form submitted in connection with a Request for Proposals (RFP) issued by the Utah Department of Transportation (UDOT) Procurement Services for Regional Welding and Fabrication Services. The form allows bidders to assert claims of business confidentiality for specified information included in their proposals, subject to Utah Code Annotated provisions 63G-2-305 and 63G-2-309. Bidders may protect non-public financial statements, specific employee names and contact information, customer information and client lists, or other information meeting statutory trade secret or commercial confidentiality standards. The form requires bidders to identify the specific pages and paragraphs of their proposals for which confidentiality protection is claimed and to provide reasons for each claim based on either trade secret status or competitive harm from disclosure.
Notably, pricing and cost proposals may not be classified as confidential and will be considered public information. Additionally, entire proposals cannot be designated as "PROTECTED," "CONFIDENTIAL," or "PROPRIETARY." Bidders who submit claims of business confidentiality will be notified if the governmental entity classifies the claimed information as public or determines that release is appropriate after weighing competing interests under applicable Utah Code provisions. The form requires the submitting company name, authorized signature, and date of submission.
