About this file

This is a Truth in Negotiation Certification form required by the Florida Department of Transportation (FDOT) for the Fort Myers Downtown Pedestrian Mall and Micromobility Feasibility Study (Project 451523-1-18-01). The certification applies to lump-sum or cost-plus-a-fixed-fee professional services contracts exceeding the CATEGORY FOUR threshold established in Florida Statutes Section 287.017. The solicitation was released on February 5, 2025, with proposals due March 6, 2025, at 2:00 pm and a pre-submittal meeting scheduled for February 12, 2025. The two-part feasibility study will investigate bicycle and pedestrian-only street and micromobility opportunities in Fort Myers' Downtown and Midtown districts, with an anticipated 18-month completion timeline following the Notice to Proceed and City Council approval scheduled for April 21, 2025. Evaluation will be based on Approach to the Project (45%) and Experience of Firm and Qualifications of Assigned Personnel (55%).

The consultant must certify that all wage rates and factual unit costs supporting the project compensation are accurate, complete, and current at the time of contracting. The consultant agrees to adjust the original agreement price to exclude any significant sums by which FDOT determines the price was increased due to inaccurate, incomplete, or noncurrent wage rates and costs, with adjustments made within one year following the end of the contract or final acceptance of work, whichever is later. The project emphasizes Disadvantaged Business Enterprise (DBE) participation with FDOT maintaining a 10.67% race-neutral DBE participation goal. Consultants must demonstrate compliance with E-Verify employment eligibility, anti-lobbying certifications, human trafficking prevention affidavits, and DBE/Small Business status verification through specified online directories. Project funding is expected through local and potentially federal sources, with participants required to enter DBE participation in the Equal Opportunity Compliance (EOC) System after contract award.
