About this file

This is a Truth in Negotiation Certification form required by the Florida Department of Transportation (FDOT) for professional services contracts exceeding the Category Four threshold under Florida Statutes Section 287.017. The certification applies to the Fort Myers Downtown Pedestrian Mall and Micromobility Feasibility Study (FDOT Project 451523-1-18-01). The two-part feasibility study investigates bicycle and pedestrian-only street and micromobility opportunities within Fort Myers' Downtown and Midtown districts to support the City's Complete Streets initiative and reduce greenhouse gas emissions. The solicitation was released February 5, 2025, with proposals due March 6, 2025, at 2:00 pm, and a pre-submittal meeting scheduled for February 12, 2025. The project has an anticipated completion timeline of 18 months after the Notice to Proceed, with City Council approval dated April 21, 2025.

The consulting firm must execute and submit this certification with its Technical Proposal, certifying that wage rates and other factual unit costs supporting the project compensation are accurate, complete, and current at the time of contracting. The consultant agrees to allow the Department to adjust the agreement price within one year following the contract end date (defined as the date of final billing or acceptance of work, whichever is later) to exclude any significant sums by which the Department determines the price was increased due to inaccurate, incomplete, or noncurrent wage rates and factual unit costs. Evaluation will be based on Approach to the Project (45%) and Experience of the Firm and Qualifications of Assigned Personnel (55%), with emphasis on urban planning, transportation engineering, and micromobility expertise. The procurement includes a race-neutral DBE participation goal of 10.67% and requires compliance with E-Verify, anti-lobbying certifications, and human trafficking prevention requirements.
