Reference Special Notes Regarding FAR 52.229-3, Offerors are hereby notified that all state and local sales or use taxes for construction materials must be included in their bid or proposal price. It is solely the responsibility of the offeror to include all other applicable taxes in their bid or proposal price as well.

1-6-2025
Please confirm the order of precedence for the contract documents. Does SOW prevail over the specifications and construction drawings?
There is no statement of work attached to this requirement. The specifications are the statement of work.
1.
1-6-2025
Is the VA willing to pay for materials stored on and/or offsite such that it meets requisite FAR and VAR clauses for stored materials. There are materials which have a 12+ week lead time which SDVOSB firms cannot procure up front without taking on the financial risk, any schedule impacts could cause irreparable harm financially. Proof of materials possession would include vendor invoices, materials under security systems, insured and bonded, photos of materials, and inspection upon request.
In accordance with contract terms and conditions, Contractors should not bid assuming the Government will approve payment for material and/or equipment procured by the Contractor and stored on the construction site, as space is available, or at a local approved location off the site. Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves.
1.
1-6-2025
Will the VA fully pay for this material/equipment if stored onsite?
See #10.
1.
1-6-2025
Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.
This will be awarded as a Firm Fixed Price (FFP) contract and all escalation should be factored in your FFP. Additionally, FAR 52.216-4 “Economic Price Adjustment – Labor and Material” is not included in the solicitation and will not be added.
1.
1-6-2025
Does this project comply with the NEW Biden Administration Executive Order 14005 concerning the Buy American Act? This executive order limits the purchase of materials from previously approved countries to include Canada and Mexico. Can you please confirm whether materials or equipment manufactured in these previously approved Buy American Act countries outside the United States can or cannot be used on this project?
The process of requesting exceptions to the Buy American Act is detailed in the provision at FAR 52.225-12, Notice of Buy American Requirement—Construction Materials Under Trade Agreements, and the clause at FAR 52.225-11 Buy American—Construction Materials under Trade Agreements, in the solicitation.

Spec 01 00 00 1.2(D), says "...retained by the Department of Veterans Affairs..." Please confirm who is responsible for testing per 1.2 D of spec 01 00 00.
The GC is responsible for testing.

1.

01 00 00, 1.2 D states "Before placement and installation of work subject to tests by testing laboratory retained by the Department of Veterans Affairs..."

01 45 29 1.1 (page 127 of 1088) says "This section specifies materials testing activities and inspection services required during project construction to be provided by a Testing Laboratory retained by the General Contractor Department of Veterans Affairs."

Question: Attachment 1 Specs: Spec 01 00 00, 1.2 (D) states that the VA will retain the testing laboratory. However, Spec 01 45 29, 1.1 states testing will be retained by the General Contract Department of Veterans Affairs. This is very confusing. Please confirm who will be responsible for testing per these two spec sections?

The GC is responsible for testing activities and inspections services.

Can you please clarify?

1. Per the site visit, we noticed most of the rooms on all 3 floors were fully occupied with employees. Most furniture appears to be cubicles that have work stations which will require access by our telecom technicians. For our proposed phasing plan, will the existing employees in specific sections be relocated prior to our work being done, or do we need to account for a certain percent of work tasks being done after normal work hours?
