About this file
This is an amendment to a solicitation for a direct to patient medical/surgical supply fulfillment contract. The amendment extends the response due date to October 21, 2020 and makes several changes to the pricing structure and items included. The Department of Veterans Affairs is seeking proposals for distribution of medical/surgical supplies and enteral nutrition products to patients located in the United States, Puerto Rico, and various U.S. territories. Offerors may submit pricing for medical/surgical items only, enteral nutrition and consumable items only, or all items. Pricing is required for the base year and four option years both with and without manifesting services. The amendment removes enteral nutrition items with Puerto Rico handling fees and makes adjustments to the performance work statement and item list.

1. Section B.2 PRICE/COST SCHEDULE is changed to read (changes in yellow highlight):
NOTE 1: Offeror’s prices shall consist of a handling fee per line item only. The handling fee shall include all the offeror’s costs such as labor, overhead, shipping cartons, any required labels, packing materials, etc. Payment to the Contractor for each line item dispensed will be at the current Federal Government Federal Supply Schedule (FSS) contract price in effect for the item at the time the order is released to the Contractor. Payment for shipping of the product(s) to the patient will be accomplished through use of an account number that will be provided by the VA for that purpose, and shipping costs of the product(s) to the patient will not be borne by the Contractor. Miscalculations by the Contractor in manifesting parcels are the responsibility of the Contractor and will not be passed to the Government for payment. The Government will be auditing all shipping manifests and invoices to ensure the Contractor follows all requirements.
NOTE 2: Upon award, the Contactor shall work with CMOP to mitigate shipping costs. The Contractor shall be able to manifest parcels internally through different vendors (USPS and third-party vendors) and/or (at the discretion of the CMOP) work with CMOP’s mail consolidators to distribute parcels to the Veteran. The Contractor shall release parcels daily to ensure parcel distribution and critical entry times are managed appropriately to meet service parameters. The Government is considering the use of a CMOP mail manifesting contract for shipment of packages under this contract. This action may be taken at time of contract award or by modification to the contract following contract award.
NOTE 3: Vendors are not required to submit pricing for all line items to be considered. Offerors may submit a proposal for all med/surg Items only (to include all option periods), all of enteral nutrition and consumable med/surg items (to include all option periods), or all line items. Offerors are required to submit pricing for CLINs with and without manifesting. To be eligible for award consideration, offerors are required to submit a proposal for the base period of one year and each of the four one-year option periods for each line item proposal. Proposals that do not offer a handling fee for the base period and each of the four option periods for the solicitation line item being offered, shall be determined non-responsive (this includes the requirement to quote with and without manifesting for all years). See Section M1(below) regarding Puerto Rico offers.
NOTE 4: Vendors should fill out Amended Attachment 8 (Pricing Spreadsheet) and submit with offer.
NOTE 5: CONTRACT LIMITATIONS
(a) Minimum Contract Value: $1,000,000 for the lifetime of the contract;
(b) Maximum Contract Value: $1,700,000,000.00 for the lifetime of the contract.
NOTE 6: Option to Extend Service The Government may require services for up to 6 months after the last day of the 4th option year. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to the contract's expiration. Pricing will continue at the price of the 4th option period.

3. Section B.2 PERFORMANCE WORK STATEMENT, Paragraph M. is changed to read (changes in yellow highlight):
M. GENERAL REQUIREMENTS
1. The Contractor shall provide Medical/Surgical (med/surg), Enteral Nutrition and related support supplies (consumables) for direct delivery to patients located within the fifty United States, Washington DC, and Puerto Rico, American Samoa, Northern Mariana Islands, U.S. Virgin Islands and Guam, in accordance with addresses supplied. The Government desires a warehouse location on the island of Puerto Rico to facilitate the provision of care to Veterans living there. Award of this CLIN will be based on the offer of a fair and reasonable handling fee as well as a technically acceptable proposal.
The Government reserves the right to award or not award on a CLIN Line basis.
2. Contractors offering Med/Surg supplies shall consider providing a physical warehouse/distribution presence on the island of Puerto Rico that will service that location and the surrounding Virgin Islands.
i) Items shipping from the Puerto Rico location will include only bulk (case lot) incontinence supplies such as diapers, briefs, liners, bed pads, etc. CMOP will provide the Contractor, at contract award conference, a line item usage report for the most recent contract quarter. The Puerto Rico warehouse/distribution list may be amended to include more or less items as the needs of the Government change.
ii) The Contractor will submit a separate handling fee for the Puerto Rico line items issued from the Puerto Rico warehouse. (See Section B.5 Price/Cost Schedule.) The handling fee will be all inclusive of the costs to ship to and warehouse the item(s) in Puerto Rico and to provide picking and packing for final distribution to the patients. USPS/UPS (or other carrier’s) costs for distribution of the product(s) to the patient will be charged to the Government account provided for this function.
iii) All requirements of this Solicitation will apply to the Puerto Rico warehouse.
iv) The Government reserves the right to not award this option if it determines that the needs of the Government can be better served utilizing shipments from the continental U.S.
3. The Contractor will also have a sufficient, well-trained staff to support the CMOPs. The Contractor will clearly demonstrate their ability to meet the CMOPs varying needs in their proposal submission. This shall include but is not limited to Standard Operating Procedures, staffing guidelines, internal policies, training requirements, labor agreements.
4. The Contractor will be reimbursed the FSS or other federal contract vehicle item price for all line items shipped, as well as a handling fee per line item. The handling fee shall include all the Contractor’s costs such as labor, overhead, shipping cartons, any required labels, packing materials, etc.
5. Payment to the Contractor for each line item dispensed will be at the current Federal Government contract price in effect for the item at the time the order is released/transmitted to the Contractor.
6. Shipping costs for distribution of product(s) to the patient will not be borne by the Contractor. (See section O. Shipping & Delivery)
7. The Contractor shall maintain adequate inventory supply to meet the needs of this work statement and have the capability to distribute an extensive line of med/surg supplies and enteral nutrition required by the CMOP facilities for continued day-to-day operations. Section D, Attachment 1 represents the most recent contract quarter, list of the products being supplied as of the issue date of this solicitation. This list of products is fluid and may change depending on patient need. The Contractor shall stock each distribution center intended to be used under this contract with one hundred percent (100%) of the products required by the CMOPs, and at the appropriate inventory levels as determined by product usage calculated by the Contractor.
8. An overall one hundred percent (100%) fill rate must be maintained by the Contractor at all times within a forty-eight (48) hour monthly average from transmission time/date stamp.
9. Contractor internal inventory replenishment/ordering schedule must be flexible to meet CMOP requirements in the event of sudden usage increases. This includes expedited delivery when necessary or changes from the routine delivery schedules of the suppliers. All costs for expedited deliveries will be the responsibility of the Contractor.
10. Recurring line item inventory outages occurring twice within two consecutive months, regardless of when in those months (other than nationally recognized manufacturer’s backorders) must be addressed by a written Performance Issue Resolution Plan (action plan) outlining the cause and/or corrective action. For clarification, out of stock timeline begins from the date inventory was received at the Contractor’s warehouse when determining two consecutive out of stock instances. This action plan is to be submitted per the written specified method within two business days of the initial notification of occurrence received from the COR.
a. Contractor is required to operate more than one distribution point for providing services required by this contract.
b. The Contractor shall stock each distribution center intended to be used under this contract with one hundred percent (100%) of the products required by the CMOPs, and at the appropriate inventory levels as determined by product usage calculated by the Contractor. This ensures timely and complete coverage of the program and provides emergency back-up for disaster recovery.
c. The distribution points must be geographically located both, east and west of the Mississippi River so that shipping costs and times are minimized to the maximum extent possible.
d. These distribution points must have the ability to transfer individual Rx’s between facilities and must provide one hundred percent (100%) of the production required by CMOP.
e. Contractor must be able to certify the ability to transfer workload prior to contract award, demonstrating that operations can be switched to an alternate distribution point with no interruption of service under the contract.
f. Workload transfers will be utilized by the Contractor to facilitate the maximum fill rate, decrease cancellations and/or delayed fills. The Contracting Officer’s Representative (COR) must be notified immediately of any workload transfers, i.e., natural or manmade disasters, catastrophic event, out of stock events exceeding thirty-six (36) hours from turnaround clock start time. Workload transfers will be considered temporary and shall return to the originating facility as soon as the reason for the transfer is resolved. The COR will be immediately informed of when the transfer situation is resolved.
11. VA has established priced contracts for the products that will be distributed through this program. Contracts for products shall include Federal Supply Schedule, including those awarded by the General Services Administration (GSA) and the National Acquisition Center (NAC), Strategic Acquisition Center (SAC), VA National Contracts, Blanket Purchase Agreements (BPA) and Blanket Ordering Agreements (BOA) with SourceAmerica. To facilitate maximum utilization of this proposed contract, the Contractor is encouraged to make all eligible FSS and federally contracted items available for distribution through the resulting contract. The VA has also entered into special pricing agreements as part of the MedSurg Next Generation Prime Vendor contract (MSPV-NG or successor MSPV 2.0). In all instances, the lowest price stated within these sources is the price that will be paid to the Contractor for the item regardless of source. These prices shall appear as a direct “pass-through” to the VA on each invoice.
a. As requirements are initially and subsequently provided by the COR, example contract source and contract item pricing will be provided to the Contractor. FSS, VA National Standardization and SourceAmerica product prices can be verified by the Contractor at time of award and real time thereafter throughout the term of the contract at NAC Contract Catalog Search Tool (CCST), current MSPV catalog, SAC pricing schedules, eCAT, and so on.
b. Product pricing at time of line item release/transmission will prevail.
12. The Contractor shall be required to add products to inventory –
a. Within forty-five (45) business days of initial Government request for items originating from an existing example Government contract source.
b. Within one hundred-twenty (120) business days of initial Government request for any new source that must be established for the existing example Government contract source.
13. The Contractor will request a Government review of items identified by the Contractor as having less than ten (10) orders per month during the previous one-hundred twenty (120) calendar days. CMOP will provide a determination to either continue or discontinue product distribution by the Contractor for those items. This determination will be provided in writing within ten (10) business days of receipt of the request from the Contractor.
14. CMOP dispenses products grouped into categories defined by VA specific nomenclature. This nomenclature consists of a CMOP ID (5-digit alpha-numeric) paired with a VA Print Name (40-character alpha-numeric description of the CMOP ID). (See Section D Attachment 4, CMOP Vendor Interface Specification, for examples of a CMOP ID and VA Print Name).
15. CMOP will provide the Contractor, in writing, the reference contract item number and reference contract number for each line item to be provided by the Contractor at initial product set-up. The above information will also be provided to the Contractor via HL7 for every line item to be filled. Independent product substitutions of similar items are not allowed without written COR approval.
16. Any product with a shelf life, or bearing an expiration date, shall have no less than six months expiration dating remaining upon delivery to the patient, unless the COR authorizes, in writing, a product with a shorter shelf life.
17. The Contractor shall ship all Rx’s completely filled (no partial shipments) and will fill with single lot numbers. When quantity equaling a manufacturer pack size is ordered, a full complete manufacturer pack size will be shipped versus a quantity of loose items.
18. The Contractor must have a system in place to internally record the lot numbers and expiration information for all line items distributed as a result of this solicitation. This information must be available for the length of time required by VHA Records Control Schedule. However, patient privacy information will not be retained by the Contractor under any circumstances.
19. The Contractor shall provide e-mail notification to the COR no later than 9:00 A.M. Central Standard Time (CST) each business day, when –
a. Out of stocks occur, regardless of reason, providing an estimated availability date.
b. Products discontinued by the manufacturer when no prior notice of discontinuance of items has been provided by the COR to the Contractor.
4. Removal of Clauses; Clause C.9 52.222-49 is hereby removed from the Request for Proposal. Additionally, the following contract clauses are removed from the Request for Proposal:
