About this file
This is a Standard Form 30 (Amendment 0005) issued by the Department of Veterans Affairs Network Contracting Office (NCO) 21 for solicitation 36C26126R0014, effective May 7, 2026. The amendment addresses three questions from the previous Amendment 003 that were not correctly addressed and adds a new federal contracting clause.
Regarding the three clarifications: (1) the Women's Health Exam Room may count toward the required three exam room count, provided it meets applicable Women's Health and exam room functional requirements in the Performance Work Statement (PWS) and Program for Design (PFD); (2) the PWS does not specifically require an on-stage/off-stage clinic design model, and offerors may propose layouts supporting efficient patient flow, privacy, staff workflow, and operational requirements consistent with PFD and applicable VA design guidance; and (3) the VA is extending the start of services to 120 days (denying the requested extension to 180 days). Additionally, this amendment adds clause 52.222-90 (Addressing DEI Discrimination by Federal Contractors, April 2026), which requires contractors to refrain from racially discriminatory diversity, equity, and inclusion activities in recruitment, employment, contracting, program participation, and resource allocation. The clause mandates contractor reporting to the Contracting Officer, compliance with information requests, and flow-down requirements to subcontractors at any tier, with noncompliance subject to contract cancellation, termination, suspension, and contractor ineligibility for future Government contracts.

The following questions were not correctly addressed in AMENDMENT 003.
7 Primary Care - Will the VA confirm if the Women's Health Exam room will count as one of the 3 required exam rooms?
Yes. The Women’s Health Exam Room may count toward the required exam room count, provided the room meets applicable Women’s Health and exam room functional requirements identified in the PWS and Program for Design (PFD).
9 Facilities Planning / Primary Care - Will the VA confirm the proposed facility must meet the on-stage off-stage design?
No. The PWS does not specifically require an on-stage/off-stage clinic design model.
Offerors may propose a layout that supports efficient patient flow, privacy, staff workflow, and operational requirements consistent with the Program for Design (PFD) and applicable VA design guidance.
11 Would the VA extend the time until start of services to 180 days and NLT to 173 to allow for the expended time needed to permit and construct a facility? This will allow for a more competitive proposal.
No, the VA is extending the start of services to 120 days.
The following clause will be added to the solicitation in accordance with an Executive Order:
52.222-90 Addressing DEI Discrimination by Federal Contractors.
As prescribed in 22.2203, insert the following clause:
Addressing DEI Discrimination by Federal Contractors (APRIL 2026)
(a) Definitions. As used in this clause—
Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations;
or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
(b) In connection with the performance of work under this contract, the Contractor agrees as follows:
(1) The Contractor will not engage in any racially discriminatory DEI activities;
(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;
(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;
(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and
(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.
(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).
(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
(End of clause)
