Project Description: Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for the construction of a new 14,857 BGSF (Building Gross Square Feet) Type II, two stories new building for Primary Care, compensation and pension, and VA/DOD integrated disability examination systems (IDES) programs, bldg. 642, at the Department of Veterans Affairs, Mather VA Medical Center, as required per the drawings and specifications.

Note #1 to bidders: A pre-bid conference and site-visit shall be held on AUG 4, 2020 at 10:00 AM PDT in front of BLDG. 650 (outside) at 10535 Hospital Way, Mather CA 95655.

Note #2 to bidders: IAW FAR 14, Sealed Bids. Award will be based on price and price related factors.

Note #3 to bidders: Prime SDVOSB shall comply with subcontracting limitations as defined in 13 CFR 125.6.

1. Bidding materials consisting of drawings, specifications and contract forms may be obtained by general (prime) contractors interested in submitting bids direct to the Department of Veterans Affairs and by suppliers and subcontractors for their use in preparing sub-bids for general (prime) contractors from the Governmentwide Point of Entry (GPE) website at https://beta.sam.gov/ under solicitation number 36C26119B0014. By registering at https://beta.sam.gov/, prime contractors, suppliers and subcontractors will have access to download plans, specifications and amendments

1. A Bid Bond is required for this solicitation. A bid guarantee is required in an amount not less than 20 percent of the bid price, but shall not exceed $3,000,000.00. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for the opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

BASIS FOR AWARD

1. INTRODUCTION

0. This is an Invitation for Bid (IFB) issued in accordance with Federal Acquisition Regulation (FAR) Part 14, Sealed Bidding, supplemented by the Department of Veterans Affairs Acquisition Regulation (VAAR). These regulations are available electronically at http://www.acquisition.gov/far/index.html and http://www.va.gov/oal/library/vaar/.

0. The Government intends to award a firm fixed price (FFP) contract to the responsive, responsible bid with the lowest fair and reasonable price for the work to be performed received in response to this solicitation.

0. Only one award will be made in response to the solicitation.

0. The solicitation is based on the use of Add Alternate Bidding. In an effort to fully utilize the funding available and maximize the amount of work awarded within the project funding, the VA may use a bidding technique called Add Alternate Bidding. Add alternates are additional items of work that may be awarded as part of the contract if the bids come within the funding available for the contract. Add alternates may include adding length or additional quantity to a project of similar type work or adding enhancements of different type work to a project.

1. BID EVALUATION PROCESS. The VA VISN 21 available funding for this project will be the basis for award of add alternates to the lowest responsive bidder who can provide the most amount of work (base plus add alternates) within the available funding. Add alternates, if awarded, will be awarded sequentially; e.g. add alternate 2 will not be awarded unless add alternate 1 is also awarded. Bidders will be evaluated as follows:

0. Step 1: Bids will be evaluated to determine if they are responsive to the solicitation.

0. Step 2: The Government will evaluate responsive bids for award purposes by ranking bids by the base bid item under contract line item 0001 with the lowest price bid first. The base bid item represents the entire project without any bid Add Alternates applied.

0. Step 3: If, after completing the review of all base bid line items under contract line item 0001, the lowest responsive base bid is less than the VA VISN 21 available funding for this project, add alternate 1 will be added to the base bid to determine if the base bid plus add alternate 1 are within the VA VISN 21 available funding for this project. If the lowest responsive base bid plus add alternate 1 is less than the VA VISN 21 available funding for this project, add alternate 2 will be will be added to the base bid and add alternate 1 to determine if the base bid, add alternate 1 plus add alternate 2 are within the VA VISN 21 available funding for this project. This process will continue until the VA VISN 21 available funding has been exceeded or until all the add alternates have been added to the base bid.

0. Step 4: The Government will evaluate the responsive lowest price bid, to include successive add alternates within the VA VISN 21 funding, to determine if the price is fair and reasonable for the work to be performed through the use of price analysis.

0. Step 5: If determined fair and reasonable for the work to be performed, the Government will evaluate the bid for responsibility under FAR Part 9.104. If determined responsible, award will be made to that bid.

0. Step 6: If the lowest bid is not determined as fair and reasonable, or if the lowest bidder is determined as not responsible under FAR 9.104, the Government will evaluate the next lowest evaluated bid, repeating the process outlined above until a responsive lowest price bid, determined fair and reasonable for the work to be performed by a responsible concern, is identified.

In the example above, if the Governments available program funding was $1,000,000.00, all bids were less than the available funding; therefore, add alternate 1 was added to the base bid. DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Scope of Work for Construct Primary Care Services Mather VA Medical Center Project Number 612-400

1.1 GENERAL INTENTION

A. Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for the construction of a new 14,857 BGSF (Building Gross Square Feet) Type II, two stories new building for Primary Care, compensation and pension, and VA/DOD integrated disability examination systems (IDES) programs, building 642 at the department of Veterans Affairs, VA Mather campus, 10535 Hospital Way, Mather, California 95655 as required drawings and specifications. Period of performance for construction shall be 425 days.

B.Visits to the site by Bidders will only be in conjunction with the scheduled pre-bid conference. Review the IFB for the date/time/location of the pre-bid conference/site visit.
C.Offices of Advance Design Consultants, Inc., as Architect-Engineers, will render certain technical services during construction. Such services shall be considered as advisory to the Government and shall not be construed as expressing or implying a contractual act of the Government without affirmations by Contracting Officer or his duly authorized representative.
D.Before placement and installation of work subject to tests by testing laboratory retained by the contractor, the contractor shall notify the COR in sufficient time to allow COR witnessing of testing laboratory personnel proper taking and testing of specimens and field inspection. Such prior notice shall be not less than three work days unless otherwise designated by the COR.
E.All employees of general contractor and subcontractors shall comply with VA security management program and obtain permission of the VA police.

Mechanical HVAC main duct work, flex ducts, diffusers, VAV boxes and associated piping and controls on 2nd floor. F. Records Management Requirements: The following standard items relate to records generated in executing the contract and should be included in a typical Electronic Information Systems (EIS) procurement contract:

1. Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228.

2. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

3. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

4. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

5. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

6. The Government Agency owns the rights to all data/records produced as part of this contract.

7. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

8. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

9. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.

10. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.

1.4 PROJECT / KEY PERSONNEL

In connection with this Solicitation and any resultant contract, any in-house personnel, subcontractors, and outside associates or consultants will be limited to individuals or firms that were specifically identified in the Contractor's accepted Bid or Pre-Construction Conference (PCC) Critical Path if Award is made. The Contractor shall obtain the Contracting Officer's written approval before making any substitution for these designated in-house personnel, subcontractors, associates, or consultants. The General Contractor’s Competent Person/Superintendent shall have completed the 30-hour OSHA certified construction safety course. PRIVACY AND CONFIDENTIALITY: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. (h) Affiliation based on joint ventures: A joint venture is an association of individuals and/or concerns with interests in any degree or proportion consorting to engage in and carry out no more than three specific or limited-purpose business ventures for joint profit over a two year period, for which purpose they combine their efforts, property, money, skill, or knowledge, but not on a continuing or permanent basis for conducting business generally.

This means that a specific joint venture entity generally may not be awarded more than three contracts over a two year period, starting from the date of the award of the first contract, without the partners to the joint venture being deemed affiliated for all purposes. Once a joint venture receives one contract, SBA will determine compliance with the three awards in two years rule for future awards as of the date of initial offer including price.

As such, an individual joint venture may be awarded more than three contracts without SBA finding general affiliation between the joint venture partners where the joint venture had received two or fewer contracts as of the date it submitted one or more additional offers which thereafter result in one or more additional contract awards. The same two (or more) entities may create additional joint ventures, and each new joint venture entity may be awarded up to three contracts in accordance with this section. At some point, however, such a longstanding inter-relationship or contractual dependence between the same joint venture partners will lead to a finding of general affiliation between and among them.

(a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation.

(b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must—

(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;

(2) Clearly identify the item by—

(i) Brand name, if any; and

(ii) Make or model number;

(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and

(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.

(c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

(d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.4 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.
