Question No. 78: SOW Section IV Code Compliance section B – Please clarify if it is the intent of the VA for this to be a design-build. Please clarify if the intent is for the contractor to hire an A&E to confirm the plans and specs conform with the VA design manuals referenced. Usually design manuals are incorporated in designs and not on a building contractor to verify designs comply with design manuals. This seems like there is a high risk, potential for redesign required, and potential for professional design insurance being needed. We would recommend converting the project to a design-build, or limiting what is bid for the project to the plans and specifications. Please note there are already 1,000 pages of specifications that should confirm compliance with VA standards, adding design requirements for the contractor we are assuming is not the intent.
Answer No. 78: See answer 70. It is performance based and not design/build. Contractor is to use drawings and specification to provide fixed price based on specific manufacturer who meet drawing and specifications. Also, specs and drawings show locations so based on system and connections the contractor can bid the project.
Question No. 79: SOW Section IV Code Compliance section B – This section states that we have to comply with requirements that can be changed and modified in the middle of construction phase, please clarify if that happens it would be considered an unforeseen condition. It is not possible to appropriately price an unknown requirement that can change.
