About this file

This is a Clarifications document that addresses seven key Q&A items related to the road improvement project at the Olin E. Teague Veterans Medical Center in Temple, Texas (Solicitation 36C25726R0053).

The clarifications address critical contract interpretation issues: (1) asphalt paving shall be installed in multiple lifts as shown on drawings, with single-lift placement only acceptable for isolated, non-phased areas of 3 inches or less thickness; (2) the CQC System Manager may serve concurrently as Superintendent if qualified, but the Superintendent cannot serve as SSHO without written Contracting Officer approval; (3) hazardous materials including asbestos and lead-based paint are identified in Drawing HA-100 and Sections 02 82 11 and 02 83 33.13, and all associated abatement costs must be included in bids with no additional compensation authorized; (4) work shall be bid per issued drawings and specifications with potential government corrective action by amendment if needed; (5) lime stabilization percentages are not fixed in contract documents, and contractors must propose the specified 6-inch lime-treated subgrade and include all testing and means/methods costs; (6) specialized CQC personnel (civil, electrical, environmental engineers and materials technician) must be directly employed by the General Contractor and physically present during applicable work, but need not be full-time for the entire project or redundant where one qualified person can cover multiple disciplines; and (7) referenced attached documents for Q&A #47 and #64 are uploaded to sam.gov. No changes to contract price or time are authorized by these clarifications.

1. Reference Q&A #1, 61 and 84 – Item #1 states that “Asphalt shall be installed in the two lifts shown on the drawings and specified in the contract documents, and no substitutions to a single lift is approved? Then it goes on to say that a “Single lift is acceptable with the exception of phased parking lots/roads” Items #61 and #84 both state that a “Single lift is acceptable with the exception of phased parking lots/roads”.

Response: Provide asphalt paving in accordance with the contract drawings and specifications. Where the drawings show separate base and surface courses, those lifts shall be provided. A single lift is only acceptable in isolated, non-phased areas where the total asphalt thickness is 3 inches or less, the paving can be placed in one continuous operation, and the area does not require interim tie-ins, staged traffic use, or phased construction. Single-lift placement is not permitted for phased parking lots/roads or anywhere the drawings specifically depict multiple courses. No change in contract price or time is authorized by this clarification.

Reasoning/basis:

•CS200 typical sections show separate HMAC base and surface courses.

•Section 32 12 16 allows one-layer placement only where finished paving is 3 inches or less, but that does not override drawing-specific multi-course requirements in phased work.

2. Reference Q&A #19 states that the “Superintendent shall not concurrently serve as the SSHO or QCM unless specifically approved in writing by the Contracting Officer….”, yet specification 01 45 00, 3.4.B. states the QCM can have other duties such as the Superintendent. Which is correct?

Response: For this project, the CQC System Manager may also serve as Superintendent provided the individual meets the contract qualifications, is identified in the accepted CQC Plan, and can fully perform both roles. However, the Superintendent shall not concurrently serve as the SSHO unless specifically approved in writing by the Contracting Officer. The Contractor remains fully responsible for maintaining required on-site quality control and safety coverage at all times.

Reasoning/basis:

• Section 01 45 00 permits the CQC System Manager to also have Superintendent duties.

• Section 01 35 26 requires a qualified SSHO with on-site presence and separate safety program responsibilities.

• This interpretation preserves both quality-control and safety oversight.

3. Reference Q&A #21 states that “No hazardous materials are identified in the contract documents…..”. There is a drawing HA100, specifications and a Design Narrative document issued that all identify hazardous materials that are to be removed as part of this contract. Please clarify the government’s answer to this question as this is an expensive endeavor.

Response: The prior response is clarified. Hazardous materials are identified in the contract documents. Offerors shall include all labor, supervision, containment, removal, handling, transportation, testing, and disposal required for hazardous materials abatement as shown on Drawing HA-100 and specified in Sections 02 82 11 – Traditional Asbestos Abatement and 02 83 33.13 – Lead-Based Paint Removal and Disposal, together with all applicable federal, state, and local requirements. No additional compensation will be due for hazardous materials work that is identified in the contract documents.

Reasoning/basis:

• Drawing index includes HA-100.

• Section 02 82 11 identifies ACM expansion joint caulk/board/backer materials and ACM curb/gutter removal.

• Section 02 83 33.13 identifies lead-based paint striping removal.

4. Reference Q&A #28 – The response given appears to be an internal conversation and not an answer to the question. Please provide an answer to the question.

Response: The work shall be bid in accordance with the drawings and specifications as issued. If needed, the Government will issue a corrected response by amendment. No change to scope, price, or time is authorized by this clarification.

5. Reference Q&A #31 and 55 – The cost difference between 5% and 7% lime stabilization on this project with the volume involved is substantial, and bidding GCs should not be forced to ‘guess’ what to bid. If we guess 5% and subsequent testing dictates 7% is needed, we lose money. If we guess 7% and others guess 5%, we may price ourselves out of the job. The government should stipulate a percentage for all to bid on and request a unit price for any changes once testing reveals the actual need. Please provide a percentage to base our bids on.

Response: Propose the lime-treated subgrade as shown and specified in the contract documents. The drawings require 6-inch lime-treated subgrade where indicated. The contract documents do not establish a single fixed lime percentage for all areas. The Contractor is responsible for providing the treatment necessary to achieve the specified result in accordance with the contract requirements, required testing, and accepted means and methods. No basis exists under the current solicitation to direct all offerors to carry a uniform percentage not stated in the contract documents. Offerors shall include all costs necessary to furnish and install the specified 6-inch lime-treated subgrade complete in place.

6. Reference Q&A #35 concerning additional CQC Personnel. Please confirm that you are requiring the GC to directly employ a Graduate Civil Engineer, a Graduate Electrical Engineer, a Graduate Environmental Engineer, and a Materials Technician as part of their staff, not an employee of the materials testing firm, or the site civil contractor, or the electrical contractor, to be part of the CQC staff, full time for the duration of the project. (we are assuming that Mechanical, Structural, Architectural, TAB and Design QC are not required because nothing in the SOW pertains to these) If so, this could add potentially over $750,000 to the project costs at the end of the day. Please reconsider your answer to this question.

Response: No, the contract does not require each listed specialty CQC position to be a separate full-time person for the full duration of the project regardless of applicability. Section 01 45 00 requires specialized CQC personnel as applicable to the work. Such personnel must be directly employed by the General Contractor, not by a supplier or subcontractor on this project, and must be physically present during work in their assigned area of responsibility. These individuals may perform other duties, and one qualified person may cover more than one area where qualifications and workload permit. Only those disciplines applicable to the actual work scope are required.

Reasoning/basis:

• Section 01 45 00 expressly says “as applicable.”

• It also states those individuals can perform other duties and one person can cover more than one area if qualified.

• This does not support an interpretation requiring all listed disciplines full-time for the entire project.

7. Reference Q&A #47 and 64 – There was no attached document. Please provide.
