Offerors cannot take responsibility for the operations and functionality of a piece of equipment we did not purchase.

ANS: Contractor submittals and testing are not required for VA-installed equipment; those responsibilities remain with the VA. For VA-furnished Contractor-installed equipment, the Contractor shall perform any testing as specified in the contract documents. The Contractor is responsible for inspecting all VA-furnished equipment upon receipt and notifying the VA of any damage or deficiencies. Once equipment is turned over to the Contractor, the Contractor assumes responsibility for its care and is liable for any damage incurred during handling, storage or installation.

Offerors are hereby notified that all state and local sales or use taxes for construction materials must be included in their bid or proposal price. It is solely the responsibility of the offeror to include all other applicable taxes in their bid or proposal price as well.

The Government has determined that for this acquisition it cannot take advantage of any sales or use tax exemptions that may be available to it under applicable state law.

Under no circumstances will any Contractor be designated as an agent of the Government for purposes of any tax exemption, nor will the Government authorize any Contractor's use of any tax exemption directly applicable to the Government under this procurement.

31. QUES: Will the government accept the use of the industry leading Procore Project Management software as the primary submittal and data tracking tool for this project?

The software is compatible with the VNs networks and is currently in use at many VA locations.

ANS: Yes. The Contractor must also provide the AE access to Procore.

32. QUES: During construction in an area where the ceilings or fire suppression system will be disrupted, will NFPA 241 apply? Will the government require additional security measures beyond NFPA code such as fire watch, temporary fire alarms, adjustment to sprinkler heads, etc.?

ANS: Yes, NFPA 241 applies to all areas undergoing construction, alteration, and demolition. The awarded Contractor must provide such measures as fire watch, temporary fire alarms, and adjustments to sprinkler heads where construction documents require.

33. QUES: Who is responsible for removing existing equipment in the SPS area?

ANS: The Contractor is responsible for disconnecting, capping, and making safe all existing equipment and utilities, as well as removing and relocating equipment as required. The Contractor must transport all removed equipment to the designated VA-provided storage areas and, once the remodel is complete, move the stored equipment back into SPS. Any equipment that is not being reused must be disposed of or turned in to the VA; the Contractor shall coordinate with the COR for this process. The VA will provide storage space within the temporary storage trailer and in designated areas of the building 1 basement corridor.
