657-18-115JC – FCA Replace Various Air Handling Units and Variable Air Volume Units
1. Can Project Superintendent also serve as both the Safety Officer & QC? COR - Yes, these two roles can be fulfilled by the project superintendent. Required official duties and certifications of each role will not be reduced just because it is fulfilled by one person.
2. Is temporary conditioning required? COR – Yes, contractor is to maintain minimal operational activities of the Medical Facility.
3. There are varying dates throughout the solicitation for the period of performance. Please specify the correct days to complete. CO – For project 657- 18-115JC the Period of Performance (POP) shall be: 550 calendar days after notice to proceed (NTP), for project 657-21-115JC the Period of Performance (POP) shall be 580 calendar days after Notice to Proceed (NTP).
4. Can you please change the technical construction experience in the technical experience of the prime contractor on A. that currently states “Work as a prime contractor under the same NAICS code as this solicitation (236220) that involved a renovation or replacement of roof at a medical facility” to “Work as a prime contractor under the same NAICS code as this solicitation (236220) that involved a renovation or replacement of HVAC and/or piping systems at a medical facility”? CO - Project 657-18-115 shall be replaced to read in its entirety FCA Replace Various Air Handling Units and Variable Air Volume Units NAICS code 236220, Project 657-21-115JC shall be replaced in its entirety to read Correct HVAC Systems in Procedure Room, NAICS code 236220.
5. In Factor 4 it states that to be technically acceptable that offerors must provide evidence that the roofing contractor has the technical qualifications and experience to meet the requirements of this project. This is an HVAC Project. Please clarify. CO
- This is an HVAC Project under NAICS Code 236220.
6. Factor 4 also states that the installer must be trained in specified types of roofs. We believe this should be changed to be relevant to a mechanical project. Please clarify.

CO - This is an HVAC project “roofing contractor” was inadvertently mentioned.
7. Can factor 4 be waived completely if the prime contractor will self-perform the mechanical work on this project? CO - CO – NO, contractor shall provide evidence of qualifications in accordance with VA HVAC Specifications.
8. Factor 4 Number 2 contradicts the other factors experience requirements of projects completed within the last 5 years. CO - Factor 4 Number 1 States Installer has technical qualifications of at least five years of successful experience, trained supervisory and installation personnel, and facilities to install HVAC system specified herein, Factor 4 Number 2 states “Proposed Contractor shall submit a list of two or more prior commercial HVAC installations. The list shall include projects that have been in operation for a period of not less than two years.
9. Factor 4 Number 3 appears to be set up similar to a submittal. The requirements of service departments do not make sense, and the approval of equipment is not relevant to a proposal requirement, as maintenance records are taken after a piece of equipment has been installed. The proposed installed equipment has not yet been installed to require maintenance records. CO – strike everything thing in Factor 4 Number 3 except for the requirement of maintenance records after installation only.
10. The pricing breakdown references NAICS 236290. Please clarify. This work is actually primarily 238220. CO – NAICS Shall be 236220.
11. Please provide above ceiling photos for the areas that were not made available during the site visit. COR - Only one site visit will be scheduled prior to the bid date. A Pre-Bid Site Visit was scheduled on 6/29/2023. Attendance was recommended. See Drawings and Specifications for additional information.
A.1 52.204-27 PROHIBITION ON A BYTEDANCE COVERED APPLICATION
(JUN 2023)
(a) Definitions. As used in this clause—
Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.
Information technology, as defined in 40 U.S.C. 11101(6)—
(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the

executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use—
(i) Of that equipment; or
(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;
(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but
(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.
(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L.
117–328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M–23–13, dated February 27, 2023, ‘‘No TikTok on Government Devices’’ Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor’s employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M–23–13.
(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.
