Final Questions and Answers

Question Answer

1. Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?

No

2. Will the VA release the site visit sign in sheet?

Yes

3. Will the Government provide comprehensive written badging requirements for the project if badging is required?

Badging is required.

a. Temporary badges can be signed out and signed in each day by an Engineering Officer from the Engineering Office AEG17.

b. Temporary badges can be signed out and signed in each day from the VA Police badging office. A government issued photo ID must be presented.

The ID will be retained until the badge is returned.

c. For personnel who will be on site continuously through the project in excess of 6 months, a flash pass can be obtained. A VA sponsor initiates action by submitting information from personnel.

Personnel will follow-up with VA for photo, fingerprinting, and background check. Personnel will be notified once badge is available for pick-up.

The process can take up to a month to complete.

4. Where will the designated parking area be for workers accessing the construction site?

There is no parking for contractor personnel on VA property. Contractor vehicles are restricted to delivery of materials to site. Contractor vehicles for other purposes must be requested and approved on a case-by-case basis.

5. Will the Owner accept the use of the industry leading Procore Project Management software as the primary submittal and data tracking tool for this project?

Yes

6. How soon after award is NTP expected to be issued?

Typically, two weeks after award.

7. Does the Government have a fire alarm servicer that they currently work with? What is the name and contact information of the person or persons that will need to be coordinated with for security and fire alarm and suppression systems work and/or disruptions?

The fire alarm system is maintained under an annual service contract. The current service provider is Optimum Low Voltage LLC/Johnson Controls, Inc.

Reference to “security” is not clear, i.e., physical access control, video surveillance monitoring, job site protection, VA Police & Security.

For “fire alarm,” coordinate with COR.

Reference to “suppression systems” implies work around the fire sprinkler protection system. Coordinate with COR.

8. Due to current potentially significant tariffs being placed on the importation of building

This will be addressed on a case-by-case basis.

Question Answer materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials?

Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.

9. As a result of the effect of COVID-19 throughout the U.S., and the resulting Federal, State, and local governments’ responses/ requirements of safe distancing and potential advocations of working remotely and/or complete organization closures, please advise how the Government intends to address delays resulting there as it pertains to the current solicitation schedule for this and all future projects.

The COVID-19 emergency is no longer in effect.

10. Will pay applications for materials secured on site or in a bonded warehouse be approved for payment?

VA space is limited and will not be made available for material storage on site.

Payment of materials stored off site will be on a case-by-case basis. This requires an inventory of materials by the COR, documentation for the off-site location, and contracting officer approval.

11. Due to the current economic inflation, Will the government reduce the amount of time that contractors must hold their numbers to 60 days? By reducing the inflation risk, the government will avoid escalations costs that general contractors and subcontractors must account for.

No

12. Will the government consider the inclusion of an Economic Price Adjustment Clause in accordance with Federal Acquisition Regulations (FAR), Subpart 16.203 "Fixed-price contracts with economic price adjustment" and the related contract clause language in FAR 52.216-2, 3, 4? We believe such a clause is appropriate for the following reasons:

• The contract involves an extended period of performance with significant costs to be incurred beyond 1 year after performance begins;

• The contract amount subject to significant fluctuations in price is substantial

No, this is a firm fixed price contract.

[may want to list specific examples of highly unstable pricing items within the scope]; and

• The economic variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor, without this type of clause."

13. Does this project comply with the NEW Biden Administration Executive Order 14005 concerning the Buy American Act? This executive order limits the purchase of materials from previously approved countries to include Canada and Mexico.

Can you please confirm whether materials or equipment manufactured in these previously approved Buy American Act countries outside the United States can or cannot be used on this project?

The current Buy America requirements apply.

14. Will the owner accept the use of Procore Project Management software as the primary submittal and data tracking tool for this project?

Yes

15. As a result of the effect of COVID-19 throughout the U.S., and the resulting Federal, State and local governments’ responses / requirements are there any new work requirements or mandates that will be required by VA on this project?

Per spec 013323-Part 1.10-D & E – the review times are 15 working days for Submittals and 10 working days for RFIs

20. When working in one (1) elevator in a bank of elevators, all other elevators in operation, the 24/7 emergency calls and service are covered and provided by the VA and not the contractor, even though all elevators listed in this scope of work are in the contractor's

The contractor assumes the responsibility for the operation and service of all of the elevators in a bank that have been turned over for construction even when only one elevator is taken out of service for the project work.

scope of work. In other words, the contractor is not required to assume the 24/7 emergency calls and service of the VA elevators.

21. Will the Government provide the 3-D REVIT Design model in native file format, for the creation of coordination drawings, and use by contractor?

CAD files exist for project as per VA guidelines, the AE can supply Revit files at VA request.

136. Spec section 01 45 00 3.4.B which identifies the qualifications required for the CQC Manager. According to this spec section “The CQC system Manager is required to be a graduate engineer, graduate architect, or a graduate construction manager, with a minimum of 5 years construction experience on construction similar to the scope of this Contract”. This statement would require an on-site person with a 4-year degree in either architecture, engineering, or construction management to be employed full-time, onsite, and for the duration of the project.

This is typical of a US Army Corps of Engineer spec reserved for projects with much higher complexity and magnitude than this SDVOSB solicitation for the Department of Veterans Affairs. Enforcement of this spec would require creating an additional high paying position among the onsite staff, thereby increasing monthly overhead project cost to the Government on every project.

Meeting this requirement in an industry that already has a significant shortage of labor resources will be both difficult to fill and costly for the project. Based on the size and complexity of this project, we respectfully request that this spec requirement be revised to add the statement “or a construction professional with a minimum of 7 years related work experience” at the end

Replace 01 45 00 3.4, B. with the following.

B. CQC System Manager: Identify as CQC System Manager an individual within the onsite work organization that is responsible for overall management of CQC and has the authority to act in all CQC matters for the Contractor. The CQC system Manager is required to have 3 years construction experience on construction similar to the scope of this Contract. This CQC System manager is on the site at all times during construction and is employed by the General Contractor.
