About this file

This is Amendment 0003 (SF 30) to Solicitation 36C24626R0072 for the replacement of Building 2 Air Handler Units (AHUs) at a Department of Veterans Affairs facility in Hampton, Virginia. The amendment provides Government responses to 68 Requests for Information (RFIs) and Questions submitted by potential offerors, along with amended Instructions to Offerors (Section 2.1) and Evaluation Criteria (Section 2.2). Key clarifications include: the project is not exempt from Virginia sales tax; Submittal Exchange is the required platform (Procore is not acceptable); contractors must provide temporary cooling/heating and all testing/commissioning services; badging requires 90 days processing with employees responsible for coordinating appointments; the bid validity period remains 120 calendar days and will not be reduced; contractors retain ownership of temporary AHU equipment and must remove it upon completion; the Quality Control Manager must be a separate individual from the Superintendent, though the Superintendent may serve dual roles as Safety and Security Health Official if qualified; and all materials must comply with the Buy American Act with no waivers obtained. The project requires ICRA Level IV infection control measures, involves hallway work during evening and weekend shifts to minimize disruption to facility operations, includes delegated design responsibilities for sprinkler system engineered shop drawings, and anticipates a 480-calendar-day contract duration from Notice to Proceed.

The amendment establishes that proposals are due by Wednesday, August 19, 2026 at 5:30 PM Eastern Time, submitted via email to the Contracting Officer with a 25 MB file attachment limit per email. Award will be made using Lowest Priced Technically Acceptable (LPTA) methodology with price as the most important factor. Offerors must submit two separate volumes: Volume I (Price) including company information, completed SF 1442, Attachment A Price Breakdown Form, Buy American Act Compliance Certification (Attachment F), bid bond, and acknowledgment of amendments; and Volume II (Technical) limited to 20 pages, addressing General Qualifications and Project Management Plan subfactors, with a list of all proposed subcontractors and trades. Past performance will be evaluated based on CPARS records from the past five calendar years without requiring offeror submission. The RFI due date was Monday, July 27, 2026 by 5:30 PM EST. Three attachments accompany this amendment: a Glycol System Drawing Addendum, a Mobilization Area map, and an Asbestos/Hazardous Materials survey report for June 2025.

SOLICITATION 36C24626R0072

658-24-102 Replace B2 Air Handler Units RFIs/QUESTIONS RESPONSES

1. Is this project exempt from sales tax? If so, will the VA provide a tax exemption certificate for material purchases?

RESPONSE: There is no state tax exemption for this project in the State of Virginia.

2. Will the VA permit the use of Procore or an equivalent construction management software platform for submittals and project communications?

RESPONSE: Submittal Exchange is required by the specifications. Procore is not an or equal substitute.

3. Will payment applications be accepted for materials stored on-site or in a bonded off-site warehouse?

RESPONSE: See the FAR for acceptable terms for progress payments for stored materials. Use of an off site warehouse is acceptable with regular inspections of the material, including prior to the first progress payment.

4. Will the Government consider including an Economic Price Adjustment (EPA) clause to address significant fluctuations in material pricing?

RESPONSE: The VHA does not utilize EPA clauses or contract types other than Firm Fixed Price unless under extreme circumstances.

5. If tariffs are imposed on materials (e.g., steel, wood) after bid submission but before award, will the Government allow a price escalation even if the materials remain Buy American–compliant?

RESPONSE: Proposals are to be complete at time of submission.

6. Will the Government provide detailed requirements for contractor badging? Please clarify the PIV process, including documentation, background checks, and estimated processing time.

RESPONSE: Contractors are to complete a form with detailed information for each badged employee. All forms must be submitted timely and allow at least 90 days for processing and issuance of the badge. All communication regarding the badge background investigation, photo appointments, and appointment to pick up the badge take place in email between the badging office and the individual employee. Employees are responsible to provide a working email address, to respond timely to setting appointments when notice is received, and to appear timely to each appointment. Badges are to be returned to the VA COR at the conclusion of the project.

7. How soon after contract award does the Government anticipate issuing the official Notice to Proceed?

RESPONSE: The Government will typically issue Notice to Proceed after receipt of executed performance and payment bonds.

8. Will the Government consider reducing the required bid validity period (e.g., to 60 days) to account for inflation and contractor pricing risk?

RESPONSE: 120 calendar days was intentionally selected and will not be reduced.

9. Can the Government confirm the stated contract duration is accurate, considering phased access and execution requirements?

RESPONSE: Confirming the stated contract duration of 480 calendar days from NTP.

10. Can we use CPARS instead of PPQs?

RESPONSE: The solicitation does not reference any Past Performance Questionnaires (PPQs). The Government is not using PPQs for this solicitation.

11. May one individual serve in dual or multiple roles (SSHO, QCM, Superintendent) if fully qualified?

RESPONSE:

The full time Superintendent may serve dual roles as SSHO provided the individual meets the requirements for both positions. The Quality Control Manager must be a separate individual. See the specs for QC Manager qualifications including being a degreed Architect, Engineer, or Construction Management graduate. The Sub-Factor reads as follows: “CRITERIA and SUBMISSION REQUIREMENTS: The prime contractor shall be (1.) a licensed General Contractor operating from within the United States, or otherwise demonstrate meeting licensure requirements according to U.S. State regulation where the firm is headquartered (“principle place of business”), relevant to the work being performed, and (2.) performs work under the applicable NAICS code, as verified in the System for Award Management. Offeror shall provide State of Licensure and license number in a brief narrative or otherwise explain State regulation regarding the discipline of work and lack of licensing requirements for their location State.”

e. What surety contact information are you requesting? From the Broker/Bond agent, or the underwriters?

RESPONSE: A fully executed bid bond with power of attorney attached. Submitted electronically with the rest of the proposal.

f. Will Offerors be held to the list of proposed subcontractors and trades in their project management plan? Pricing and availability of subs affect sub selection.

RESPONSE: The Government is not selecting subcontractors or evaluating/rejecting offers on the basis of the subcontractors listed, however the Government needs the list for informational purposes to understand whether adequate price competition was received in the event of substantially high priced offers. The Government’s evaluation assumes that a qualified General Contractor, that otherwise meets the terms of the solicitation, will hire capable/qualified subcontractors.

68. Note G in the Reflected Ceiling notes references finishes sheets and they don’t appear to be included with the bid documents. Will you please include this missing document with the RFI answers?

RESPONSE: Finish sheets not applicable to this project. Refer to specifications for acoustical ceiling tile requirements.

2.2 EVALUATION CRITERIA (Amendment 0003)

1. LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA): The Government will award a contract resulting from this solicitation to the responsible Offeror whose proposal, if conforming to the solicitation, is the Lowest Priced Technically Acceptable proposal (sequential evaluation). The following factors will be used to evaluate offers. The factors are listed in order of relative importance, with the Price Factor being the most important. All evaluation factors other than cost or price, when combined, are significantly LESS important than cost or price.

1.1. VOLUME I – PRICE FACTOR

1.2. VOLUME II – TECHNICAL FACTOR

1.3. PAST PERFORMANCE FACTOR

2. BASIS FOR CONTRACT AWARD: This is a competitive Lowest Priced Technically Acceptable (LPTA) source selection in which all evaluation factors other than price, when combined, are significantly LESS important than price. The factors other than price include both the Technical Factor and the Past Performance Factor. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the requirements for acceptability.

3. Regarding the below process, the terms strength, weakness and deficiency are defined as follows:

3.1. The term weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.

3.2. The term deficiency means any part of an offer that does not conform to a material requirement of a RFP. A material requirement is one that affects price, quantity, quality, or delivery, or that the RFP requires to be met at the time of proposal submission. See FAR 15.001.

4. By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a solicitation requirement may result in an offer being determined unacceptable (see below). The evaluation process shall proceed as follows:

5. MATERIAL REQUIREMENTS OF OFFERS

5.1. Offers will first be evaluated as to whether they meet the material requirements of the solicitation. The Contracting Officer may identify/confirm missing documentation with an offeror(s) and decide whether the offeror should/can be allowed to submit any missing/deficient documentation without adverse effect to other offerors or the timeliness of award. Offers meeting the material requirements of the solicitation will then be evaluated on the factors of Price, Technical Capability and Price. Failure to complete and submit VAAR clause 852.219-75 with the offer will result in immediate rejection of the proposal without further consideration.

6. VOLUME I – PRICE PROPOSAL

6.1. The price proposal shall include the completed Attachment D Base Offer Price Breakdown Form and other items as noted in the Instructions to Offerors section. The Price Breakdown may be discussed during negotiations to confirm that no major work elements have been omitted. The price breakdown may also be used to conduct negotiations if discussions are held with any offerors. The Government anticipates awarding a contract without discussions, but reserves the right to hold discussions. Other than certified cost or pricing data may be requested.

6.2. The Government will evaluate offers for award purposes by reviewing the total price(s) offered, the offeror’s Attachment D Base Offer Price Breakdown form for the base proposal item. The Government will use the committed funds amount as the control amount for price evaluation. The control amount will not be made publicly available during evaluation and selection, due to the use of FAR Part 15 procedures, as it represents both the committed funds amount and the Government Estimate. The Government Estimate is source selection sensitive information and will not be disclosed.

6.3. Offers will be evaluated in accordance with FAR clause 52.225-9 Buy American-Construction Materials and FAR provision 52.225-10 Notice of Buy American Requirement-Construction Materials. Complete FAR provision 52.225-9 Buy American-Construction Materials if applicable regarding use of foreign material. Offers shall include a completed Attachment F – Buy American Act Compliance Certification.

6.4. Each Offeror’s price proposal will be evaluated for fairness and reasonableness, using any of the methods identified at FAR 15.404-1(b). Other than certified cost or pricing data may be requested if price fairness and reasonableness cannot be otherwise determined.

6.5. An Offeror’s proposal may be rejected if it is determined during evaluation that a significant element of work was omitted from the offeror’s price, where correction of the mistake would result in an increase of the offeror’s proposed price(s).

6.6. The Government intends to award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. The Government, however, reserves the right to conduct negotiations if deemed necessary.

7. VOLUME II – TECHNICAL CAPABILITY

7.1. The technical subfactors of offers will be evaluated based on the following “Combined Technical/Risk Ratings”. All areas (subfactors) of the Technical Proposal must receive at least an acceptable rating for a proposal to be considered any further. Offers receiving an unacceptable technical proposal rating will be rejected.

Table – Combined Technical/Risk Ratings

Adjectival Rating
Description
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Unacceptable
Proposal does not meet requirements and contains one or more deficiencies. Proposal is not awardable.

7.2. Sub-Factor 1 – General Qualifications.

7.2.1. CRITERIA and SUBMISSION REQUIREMENTS: The prime contractor shall be (1.) a licensed General Contractor operating from within the United States, or otherwise demonstrate meeting licensure requirements according to U.S. State regulation where the firm is headquartered (“principle place of business”), relevant to the work being performed, and (2.) performs work under the applicable NAICS code, as verified in the System for Award Management. Offeror shall provide State of Licensure and license number in a brief narrative or otherwise explain State regulation regarding the discipline of work and lack of licensing requirements for their location State.

7.2.2. The offeror shall briefly describe their business, resources and type of work performed in the past. The response will be evaluated to confirm whether the offeror is a legitimate, established business under the NAICS code assigned to this solicitation. An offeror’s inability to demonstrate in writing that it is an established business under the NAICS code may result in the technical proposal being rated as unacceptable.

7.2.3. Offerors shall include their Accord Certificate of Insurance noting the insurance types and levels required by the solicitation. Offerors shall ensure they complete and submit VAAR clause 852.219-75 with their offer to be considered for award. Failure to complete VAAR 852.219-75 will result in immediate rejection of the proposal without further consideration.

7.3. Sub-Factor 2 – Project Management Plan

7.3.1. CRITERIA and SUBMISSION REQUIREMENTS: Please provide a brief project management plan, outlining the processes, and methods by which work would be completed. The project management plan will be evaluated for sufficient initiating, planning, executing, monitoring/controlling, and closing processes to satisfy the project specifications, including the offeror’s processes for controlling the quality and timely execution of subcontractor work. Discussions may be held to address any questions regarding the project management plan. Include in the plan a list of all subcontractors and their trades on the project.

8. PAST PERFORMANCE FACTOR

8.1. Past performance information identified in the Contract Performance Assessment Reporting System (CPARS) will be utilized to determine the quality of the offeror’s past performance as it relates to the probability of success of the required effort. Past performance will be evaluated as to how well offerors performed on federal contracts that were given CPARS assessments. Emphasis will be on recent, relevant past performance within the last five (5) calendar years, beginning September 1, 2021, however the offeror’s CPARS records for the five-year period will be considered, generally, in identifying any substantial performance risk.

8.2. In addition to CPARS data, the Government may investigate past performance using other sources, in particular other Government databases, SAM.gov information on past awards, and interviews by email or telephone questions for Government COR, CO, or PM positions for Contractor projects performed for the Government or for private sector projects. If the Government collects this data, it will be on recent, relevant projects that meet the criteria above for CPARS data. If the Government collects this data, it will be used as part of the inputs to determine the past performance rating. If not, then CPARS data will be the only data used to develop past performance ratings. If adverse past performance is identified that has not been documented in CPARS, the Government will need to hold clarifications under RFO FAR 15.202(a)(2)(ii) to allow the offeror an opportunity to respond to the adverse past performance information.

8.3. Performance Rating Method

Table – Past Performance Ratings

Adjectival Rating
Description
Acceptable
Based on the offeror’s recent/relevant performance record, and performance records generally, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or otherwise the offeror does not have a past performance record. An offeror without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance.
Unacceptable
Based on the offeror’s recent/relevant performance record, and performance records generally, the Government has no expectation that the offeror will be able to successfully perform the required effort.

8.4. CRITERIA and SUBMISSION REQUIREMENTS: The Government will evaluate the records available in the Contractor Performance Assessment Reporting System (CPARS). Project owners may be contacted to verify information provided, where necessary, and to obtain documentation regarding successful or unsuccessful performance, and to obtain information regarding the following performance areas. The offeror’s past performance records, generally, will also be reviewed in the Contractor Performance Assessment Reporting System (CPARS) for the purpose of identifying any existing derogatory records impacting on the evaluation team’s confidence in the offeror to perform the work.
