B.2 STATEMENT OF WORK

Statement of Work for

FY25 Triennial Electrical Inspection at VA Pittsburgh Healthcare System (VAPHS)

10/24/2025

1. Introduction

1.1. This Statement of Work (SOW) describes requirements to perform inspection, testing, and required maintenance of the electrical power distribution system and all components.

1.2. Locations:

2. Statement of Work

2.1. Inspection, Testing, Repairing, Maintenance, and/or calibration of the Electrical Power Distribution System and all of its components.

2.2. Within two (2) days of award, contact the Technical Point of Contact (TPOC) to coordinate service. After initial contact, there will be 30 days for contractor and TPOC to coordinate the onsite visit to start the service.

3. Scope

3.1. It is expected that this inspection contract will identify new and existing breakers that were found in the Arc Flash Study’s Condition Assessment that pertain to panels and breakers that need replacement.

3.2. The contractor to conduct triennial inspections/reports of electrical equipment listed below and the other services described including updating the Equipment Assessment List and updating all Panel Schedules.

3.3. At no time can any Life Safety and critical equipment systems be compromised. This includes but is not limited to nurse call systems, fire alarm systems and removal of ceiling tiles. Interim Life Safety Measures may need to be implemented, and contractor-provided fire watch may be required.

3.4. Work items, definitions, and references shall comply with the latest edition of the InterNational Electrical Testing – Maintenance Testing Specifications

3.4.1. Use lint-free rags to clean conductors, contact points between the circuit breakers and main buss bars, buss bars and interior of the electrical equipment.

Use a vacuum cleaner to remove large debris; compressed air is not to be used for this purpose. Visually inspect for signs of overheating, misaligned contacts, damaged insulation, or lose lugs.

3.4.2. Lubricate all moving parts with manufacturer’s approved lubricants.

3.4.3. Test and exercise circuit breakers located in switchgears, switchboard, and distribution panels to ensure operation under overload, and short circuit conditions.

3.4.4. Contractor shall vacuum the inside of the gear and panels.

3.5. Contractor supervisors shall be available always when contract work is in progress to receive notices, reports, or requests from the Contracting Officer (CO) or the Technical Point of Contact (TPOC). Any change to Supervisor personnel must be made with an official notification to the CO and TPOC.

3.6. The Contractor shall make site visits as required to determine/verify all existing and as built conditions affecting this project.

3.7. Information including drawings and other documentation provided by VAPHS to the Contractor is to be used for reference only, and all such information, including as-built drawings, shall be field verified by the contractor to ensure accuracy in the final report.

VAPHS does not guarantee accuracy of information and provided as-built drawings.

3.8. The Contractor shall field verify every aspect of the electrical distribution system that relates to the SOW, including all dimensions and utility locations.

3.9. The Contractor shall survey complete electrical distribution systems at both campuses and submit updated single line drawings in PDF and (.dwg) file forms to TPOC before contract close out.

3.10. Contractor shall note any discrepancies between the provided drawings and existing conditions for correction on final line drawings and final report.

3.11. The Contractor shall take photos and notes of any pre-existing damage or missing labels.

3.12. The Contractor shall also determine which circuits are capable of being tested through secondary injection test method and/or primary injection method. If both are feasible, the secondary injection method shall be utilized.

3.13. The Contractor shall survey all items to be tested and create an electronic spreadsheet inventory all items with the following information:

3.13.1. Item Number.

3.13.2. Component Type (e.g., Liquid Filled Transformer, Protective Relay, etc.)

3.13.3. Location of item with room number (on inventory sheet and on drawing)

3.13.4. Area that device serves (if applicable)

3.13.5. Panel Serving the device.

3.13.6. Breaker # and Amperage.

3.13.7. Type of power:

4.26. System Function Tests:

4.26.1. Functional tests for the electrical system shall be conducted for performance, safety, and reliability after testing of the breakers is complete.

4.27. Thermographic Survey:

4.27.1. Infra-Red Scanning: This work item must be done while the Electrical Power Distribution System is energized. Appropriate safety precautions must be taken before, during and after scanning the system.

4.28. Test ground fault protection devices for proper function if they are installed in the Facility Electrical Power System.

4.29. Inspect and tighten ground connections. Test ground resistance for the entire facility grounding system (submit report). Any method of ground resistance must be considered acceptable if it can verify continuity and quantify the impedance to ground, to include but not limited to fall-of-potential, induced frequency and clamp on testing. If initial tests indicate a problem or concern (e.g., ground resistance greater than 25 ohms), a more detailed test must be performed using fall-of-potential or 3-point test.

Where installed, the lightning protection system must be inspected and tested for continuity to ground, ground resistance and certification in accordance with Underwriters Laboratory (UL) standard 96A.

4.30. Transformers, including all related components, include results in report.

The following is a minimum list of Transformer items to be inspected, tested, and maintained:

4.30.1. Transformers must be cleaned exteriorly, inspected for signs of overheating with infrared thermal detecting equipment, and inspected for any damage to the housing, connection points, or insulation.

4.30.2. Liquid cooled transformers must have the cooling liquid tested and replaced, when tests indicate that the liquid no longer meets manufacturer’s specification.

The liquid must be re-filled to meet the manufacturer’s specifications.

4.30.3. Dry type transformers must be thoroughly cleaned exteriorly and inspected for overheating with infra-red thermal detecting equipment.

4.31. Contractor shall create a separate site (Heinz and UD) electrical equipment list in Excel format containing the following information:

4.31.1. Name of device.

4.31.2. Site (Heinz or UD).

4.31.3. Location (Building #, Floor, etc.).

4.31.4. Area Equipment serves, Controls, or feeds.

4.31.5. Manufacturer.

4.31.6. Model #.

4.31.7. Serial #. (If applicable).

4.31.8. Capacity.

4.31.9. Year Manufactured.

4.31.10. Condition (Excellent, Good, Fair, Poor).

4.32. Contractor shall create a basic existing panel schedule for both sites (Hz and UD) in Excel format that portrays the best existing breaker branch feed information from this survey (Signal and wire tracing to lights, receptacles, equipment not required).

Panel schedule shall contain the following information:

4.32.1. Panel Name.

4.32.2. Service type (Phase type, delta, Wye, 3 wire, or 4 wire, etc.).

4.32.3. Line Voltage.

4.32.4. Main breaker amps.

4.32.5. Fed from.

4.32.6. Example Layout

4.33. Testing conditions

4.33.1. VA Staff will de-energize/re-energize all Electrical Power Distribution Systems Equipment.

4.33.2. Contractor to remove/reinstall and test all Electrical Power Distribution System

4.33.3. Equipment defined in SOW and Single line drawings in accordance with Codes.

4.33.4. Work shall be performed on weekends, evenings, and nights.

4.33.5. After completing maintenance, testing, inspection and calibration of each device in the electrical distribution equipment the Contractor shall place an adhesive label on each device containing the Contractor company name, test results and date of the services performed.

When updating labels, remove existing outdated labels.

5. Repairs

5.1. Recommend corrective actions, if any. Prioritize deficiencies with cost estimates for repairs. Cost estimates shall include unit costs, subtotals, and grand totals. Cost estimates shall also break down labor and material costs per item.

5.2. Provide temporary generator (480V) for work being performed at HZ, Bldg. 32 to ensure uninterrupted service of the data center.

5.3. Contractor shall immediately report deficiencies that are deemed critical or catastrophic immediately to TPOC for contractor and TPOC to develop immediate plan to address.

5.4. Use of an infra-red scanning camera will be used to detect the hot spots in the Electrical Power Distribution System. This will detect any loose or corroded connections in the system. Problem connections shall be replaced with new connectors, and/or tightened with torque wrench to meet the equipment manufacturers’ specifications.

6. Summary of Deliverables

6.1. Dated calibration labels shall be visible on all instruments, test equipment, tools and PPE as appropriate.

6.2. The contractor shall note any discrepancies between the provided drawings and existing conditions for correction on final line drawings and final report.

6.3. The contractor shall take photos and notes of any pre-existing damage or missing labels.

6.4. Provide complete written report of the work. Information shown in the report shall include the following:

6.4.1. Company’s name, address, telephone & FAX numbers of the QECP.

6.4.2. Name, and signature qualified technicians who perform the inspection, testing, and maintenance.

6.4.3. Work Contract Number.

6.4.4. Date and time of work.

6.4.5. Copies of QECP’s certifications, licenses, and training certificates.

6.4.6. Descriptions and model number of tools and equipment used.

6.4.7. Location, Type, and Name of electrical equipment to be maintained and tested.

6.4.8. Descriptions of work items.

6.4.9. Test data.

6.4.9.1. Data to be appended to final report.

6.5. Reference materials such as equipment manufacturer’s specifications, coordination study, etc.

6.6. Deficiencies.

6.7. Recommended corrective actions.

6.8. Submit four (4) hard copies of the complete written report and one (1) CD-ROM of the electronic version of the report in Microsoft Word format to the TPOC within seven (7) calendar days of contract completion. All reference materials shall be included in the electronic version of the report, either through scanning or other means of electronic text import methods.

6.9. QECP shall report deficiencies that are deemed imminent or catastrophic immediately to the TPOC and Chief of Engineering Service for immediate actions.

7. Scheduling

7.1. Contractor shall submit a tentative schedule of deliverables (including planned location shutdowns) in writing prior to any work.

7.2. List of critical areas of VAPHS indicated where shutdowns due to testing will require significant advanced planning with contractor and VAPHS to ensure hospital operations are not negatively impacted. These areas serve the medical center 24/7 so advanced planning is essential to ensure safety of the veterans and continuity of services.

7.3. Outages affecting critical care areas will be required to be in sort durations four (4) hours or less to ensure patient care is not impacted. Contractor will be required to set up outages affecting air handlers in these areas to be staged for as four (4) hour outage, energize system for two (2) hours to reach equilibrium, then another four (4) hour outage can follow the equilibrium period. The following are VAPHS critical care areas:

7.4. Contractor shall develop and submit an alternate testing schedule should any of these areas served by the electrical distribution equipment being tested are not available at the time of testing. This will be due to unforeseen clinical emergencies.

8. Working Hours

8.1. Normal working hours are Monday through Friday from 7:00 AM to 4:30 PM ET. All work for this contract will be performed outside of normal working hours for (4) consecutive days ending on a Sunday. Weekend work hours for this contract will be from 7:00 AM ET until planned work for that day is complete and all electrical equipment under test for the facility is back in proper working order as approved by TPOC.

8.2. The specific dates shall be coordinated with the TPOC in writing at least three (3) days in advance. Testing dates may change due to inclement weather or hospital emergencies; however, the TPOC shall first be notified and approved of any changes necessary. If possible, TPOC will notify contractors of unforeseen emergencies within two (2) hours of event occurrence. Contractor shall anticipate all work to be done after normal working hours.

9. Qualifications for Qualified Electrical Contract Professionals (QECP)

9.1. QECP shall be certified by the InterNational Electrical Testing Association (NETA) as NETA Certified Technician and completed the Occupational Safety & Health Administration (OSHA) approved 10-hour construction safety training.

9.2. Operating/Maintenance manuals, and specifications of the electrical equipment to be maintained and tested. These documents may be obtained from the Medical Center, or the equipment manufacturers.

10. Safety Requirements

The Contractor shall adhere to all NETA, OSHA, EPA, NFPA Life Safety Codes.

10.1. The Contractor shall comply with VAPHS smoking policy, which designates no smoking on campus.

10.2. The Contractor shall replace all safety guards, equipment, devices, etc., removed during service or repair immediately after completion of work or when leaving a job unattended.

10.3. The Contractor shall submit to the Contracting Officer, prior to the start of the contract, the Material Safety Data Sheets (MSDS) for all potentially hazardous materials (lubricants, cleaners, working fluids, etc.) to be used in the facility during performance of the contract, and will not use in the facility, any materials which have not been cleared in advance with the

VAPHS.

10.4. MSDS for new chemicals shall be furnished concurrently with the arrival of the chemical on site.

10.5. The Contractor shall maintain a copy of all MSDS at the chemical storage site in a location accessible to VAPHS personnel to assure compliance with all laws and requirements regarding the “Right to Know” law.

10.6. The Contractor shall obtain a Hot Work Permit from the VAPHS Safety Office whenever soldering, welding, using a cutting torch, or other open flame, spark, or heat producing equipment is required.

10.7. The Contractor is responsible for the supervision of all its employees while on government property.

10.8. In TPOC the event of an accident or injury, the Contractor shall submit a written report to the within five work (5) days of the incident detailing the malfunction, accident or injury. The report shall state the cause of the injury or accident, and a list of completed or scheduled corrective actions to avoid further incidents.

C.2 52.240-91 SECURITY PROHIBITIONS AND EXCLUSIONS (NOV 2025)

(DEVIATION)

(a) Definitions. As used in this clause—

American Security Drone Act-covered foreign entity means an entity included on a list that the Federal Acquisition Security Council (FASC) develops and maintains and publishes in the System for Award Management (SAM) at https://www.sam.gov (section 1822 of Pub. L. 118-31, 41 U.S.C. 3901 note prec.).

Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.

Covered article, as defined in 41 U.S.C. 4713(k), means:

(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;

(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.S.C. 153);

(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or

(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.

Covered foreign country means The People’s Republic of China.

Covered telecommunications equipment or services means—

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means—

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled—

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

FASC-prohibited unmanned aircraft system means an unmanned aircraft system manufactured or assembled by an American Security Drone Act—covered foreign entity.

FASCSA order means any of the following orders issued under the Federal Acquisition Supply Chain Security Act (FASCSA) requiring removing covered articles from executive agency information systems or excluding one or more named sources or named covered articles from executive agency procurement actions, as described in 41 CFR 201-1.303(d) and (e):

(1) The Secretary of Homeland Security may issue FASCSA orders that apply to civilian agencies, to the extent not covered by paragraph (2) or (3) of this definition. This type of FASCSA order may be referred to as a Department of Homeland Security (DHS) FASCSA order.

(2) The Secretary of Defense may issue FASCSA orders that apply to the Department of Defense (DoD) and national security systems other than sensitive compartmented information systems. This type of FASCSA order may be referred to as a DoD FASCSA order.

(3) The Director of National Intelligence (DNI) may issue FASCSA orders that apply to the intelligence community and sensitive compartmented information systems, to the extent not covered by paragraph (2) of this definition. This type of FASCSA order may be referred to as a DNI FASCSA order.

Information technology, as defined in 40 U.S.C. 11101(6)—

(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use—

(i) Of that equipment; or

(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;

(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but

(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.

Intelligence community, as defined by 50 U.S.C. 3003(4), means the following—

(1) The Office of the Director of National Intelligence;

(2) The Central Intelligence Agency;

(3) The National Security Agency;

(4) The Defense Intelligence Agency;

(5) The National Geospatial-Intelligence Agency;

(6) The National Reconnaissance Office;

(7) Other offices within the Department of Defense for the collection of specialized national intelligence through reconnaissance programs;

(8) The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Department of Energy;

(9) The Bureau of Intelligence and Research of the Department of State;

(10) The Office of Intelligence and Analysis of the Department of the Treasury;

(11) The Office of Intelligence and Analysis of the Department of Homeland Security; or

(12) Such other elements of any department or agency as may be designated by the President, or designated jointly by the Director of National Intelligence and the head of the department or agency concerned, as an element of the intelligence community.

Interconnection arrangement means arrangements governing the physical connection of two or more networks to allow the use of another’s network to hand off traffic where it is ultimately delivered (e.g., connecting a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Kaspersky Lab-covered article means any hardware, software, or service that—

(1) Is developed or provided by a Kaspersky Lab-covered entity;

(2) Includes any hardware, software, or service developed or provided in whole or in part by a Kaspersky Lab-covered entity; or

(3) Contains components using any hardware or software developed in whole or in part by a Kaspersky Lab-covered entity.

Kaspersky Lab-covered entity means—

(1) Kaspersky Lab;

(2) Any successor entity to Kaspersky Lab, including any change in name, e.g., “Kaspersky”;

(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab;

or

(4) Any entity of which Kaspersky Lab has a majority ownership.

National security system, as defined in 44 U.S.C. 3552, means any information system (including any telecommunications system) used or operated by an agency or by a contractor of an agency, or other organization on behalf of an agency—

(1) The function, operation, or use of which involves intelligence activities; involves cryptologic activities related to national security; involves command and control of military forces; involves equipment that is an integral part of a weapon or weapons system; or is critical to the direct fulfillment of military or intelligence missions, but does not include a system that is to be used for routine administrative and business applications (including payroll, finance, logistics, and personnel management applications); or

(2) Is protected at all times by procedures established for information that have been specifically authorized under criteria established by an Executive order or an Act of Congress to be kept classified in the interest of national defense or foreign policy.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Sensitive compartmented information means classified information concerning or derived from intelligence sources, methods, or analytical processes, which is required to be handled within formal access control systems established by the Director of National Intelligence.

Sensitive compartmented information system means a national security system authorized to process or store sensitive compartmented information.

Source means a non-Federal supplier, or potential supplier, of products or services, at any tier.

Subsidiary means an entity in which more than 50 percent of the entity is owned directly by a parent corporation or through another subsidiary of a parent corporation.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

Unmanned aircraft means an aircraft that is operated without the possibility of direct human intervention from within or on the aircraft (49 U.S.C. 44801(11)).

Unmanned aircraft system means an unmanned aircraft and associated elements (including communication links and the components that control the unmanned aircraft) that are required for the operator to operate safely and efficiently in the national airspace system (49 U.S.C.

44801(12)).

(b) Prohibitions on providing or using specific products or services in performance of contract.

Unless a waiver or exception applies, the Contractor is prohibited from providing any products or services to the Government or using in the performance of the contract any of the following:

(1) A covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor’s employees (section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328));

(2) A Kaspersky Lab-covered article (Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91));

(3) Covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system (paragraphs (a)(1)(A) of section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232)). This does not prohibit contractors from providing—

(i) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Prohibition on unmanned aircraft systems manufactured or assembled by American Security Drone Act—covered foreign entities.

(1) Prohibition. The Contractor is prohibited from—

(i) Delivering any FASC-prohibited unmanned aircraft system, which includes unmanned aircraft (i.e., drones) and associated elements (sections 1823 and 1826 of American Security Drone Act of 2023, within the National Defense Authorization Act for Fiscal Year 2024, Pub. L.

118-31, Div. A, Title XVIII, Subtitle B, 41 U.S.C. 3901 note prec.);

(ii) On or after December 22, 2025, operating a FASC-prohibited unmanned aircraft system in the performance of the contract (section 1824 of Pub. L. 118-31); and

(iii) On or after December 22, 2025, using Federal funds to procure or operate a FASC-prohibited unmanned aircraft system (section 1825 of Pub. L. 118-31).

(2) Procedures. The Contractor shall search SAM for the FASC-maintained list of American Security Drone Act—covered foreign entities before proposing, or using in performance of the contract, any unmanned aircraft system. Also, the Contractor shall ensure any effort or expenditure associated with a FASC-prohibited unmanned aircraft system is consistent with a corresponding exemption, exception, or waiver determination expressly stated in the contract.

(3) Exemptions, exceptions, and waivers. The prohibitions in paragraph (c) of this clause do not apply where the agency has determined an exemption, exception, or waiver applies, and the contract indicates that such a determination has been made. See sections 1823 through 1825 and 1832 of Public Law 118-31 for statutory requirements pertaining to exemptions, exceptions, and waivers.

(d) Prohibition on using or providing specific products or services or conducting certain transactions regardless of connection to contract.

(1) Certain telecommunications and video surveillance equipment, systems, or services.

(i) Unless an applicable waiver has been issued by the Government, the Contractor cannot use any equipment, systems, or services that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system (paragraph (a)(1)(B) of section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232)).

(ii) This prohibition applies to using covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. This does not prohibit the contractor from using—

(A) A service that connects to the facilities of a third party, such as backhaul, roaming, or interconnection arrangements; or

(B) Telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Office of Foreign Assets Control Restrictions.

(i) Except as authorized by the Office of Foreign Assets Control (OFAC) in the Department of the Treasury, the Contractor shall not acquire, for use in the performance of this contract, any supplies or services if any proclamation, Executive order, or statute administered by OFAC, or if OFAC’s implementing regulations at 31 CFR chapter V, would prohibit such a transaction by a person subject to the jurisdiction of the United States.

(ii) Except as authorized by OFAC, most transactions involving Cuba, Iran, and Sudan are prohibited, as are most imports from Burma or North Korea, into the United States or its outlying areas.

(3) Sudan prohibition. The Contractor is prohibited from conducting any restricted business operations in Sudan in accordance with Accountability and Divestment Act of 2007 (Pub. L. 110- 174).

(4) Iran prohibitions.

(i) Unless an exception applies according to paragraph (d)(4)(iii) or the Government grants a waiver, the contractor shall not engage in certain activities or transactions relating to Iran (section 6(b)(1)(A) of Iran Sanctions Act (50 U.S.C. 1701 note).

(ii) Unless an exception applies according to paragraph (d)(4)(iii) or the Government grants a waiver, contractor shall not export certain sensitive technology to Iran, as determined by the President, and has an active exclusion in SAM (22 U.S.C. 8515).

(iii) The prohibition in paragraphs (d)(4)(i) and (d)(4)(ii) do not apply if the acquisition is subject to trade agreements and the offeror certifies that all the offered products are designated country end products or designated country construction material (see part 25).
