1. The solicitation including specifications and drawing was posted to FedBizOps on December 19, 2019. All contractors should have reviewed the entire solicitation before this meeting.
2. Discuss Scope of Work: 545 days to complete this project after Notice to Proceed is issued. The Construction Magnitude is between $5,000,000.00-$10,000,000.00. There is the base proposal and five (5) proposal deducts for this project.
3. This is a construction project that will utilize FAR Part 15 and will be awarded as stated in the solicitation on Page 23, B4. EVALUATION GUIDANCE. Evaluation Factors 1 and 2 (Technical Capability and Past Performance) are non-price evaluations factors, are of equal importance and when combined, are significantly more important than Factor 3 (Price).
4. This is a 100% set-aside for SDVOSB. The contractor will be required to be registered in SAM, VIP and VETBIZ.
5. The first request for proposal is due TUESDAY, JANUARY 28, 2020, 4:00 p.m. The new proposal due date is now FRIDAY, FEBRUARY 14, 2020 at 12:00 PM (EST) to award as soon as possible after the solicitation closes. All proposals can be hand carried or mailed addressed to the Department of Veteran Affairs, Network Contracting Office 4, Attn: Cheryl A. Roberts, 20 Montchanin Road (Montchanin Corporate Center), Greenville, DE 19807.
6. Please send all questions pertaining to this project to Cheryl A. Roberts, Contracting Specialist (CS), Charles Peck, Contracting Officer (CO) and Edward Gannon, Contracting Officer’s Representative (COR) by e-mail no later Thursday, January 16, 2020. Answers will be posted to FedBizOps via solicitation amendment by Tuesday, January 21, 2020.

9. Questions, Comments or Notes
QUESTION 1: Please confirm that the Offerer shall include the "Safety or Environmental Violations, and Experience Modification Rate" information identified in Section 1.12 on page 18 of 69 of the Solicitation in Binder #1 as indicated in Section 2.1 on page 22 of 69.
VA RESPONSE: Confirmed, as referenced in Paragraphs 1.12 and Paragraph 2. The VA does not want a contractor constructing this project with many OSHA and EPA violations along with a bad EMR rating.
QUESTION 2: The description of Sub-Factor B - Capability on page 23 of 69 of the Solicitation and the description of Sub Factor C - Quality Control on page 24 of 69 of the Solicitation makes reference to "Technical Proposal Data questions" however the referenced questions are not contained within the documentation issued as part of the Solicitation. Please advise.
VA RESPONSE: These description for these two sub-factors will be changed as shown below.
SUB-FACTOR B - CAPABILITY:
The Government will evaluate the offeror’s responses to Evaluation Factor 1 (Technical Capability) and any contractor’s attachments concerning scheduling, construction approach, overall organization, organizational chart, as well as number of personnel and the duties of proposed technical staff to determine if offeror has the ability to manage multi-discipline projects within the areas of consideration chosen without significant difficulty. The specific criteria proposed (skill levels and background) for personnel, if adequate, is an indicator of an acceptable organization.
The proposed subcontractors, applicable for multi-discipline consideration, are verifiable, and information provided indicates a good professional relationship with Demolition and Removal, Substructure, Structural Frame, Roofing, Exterior Walls, Interior Finishes, HVAC, Plumbing, Electrical, etc. The calculations of self-performed work must be completed and submitted, in accordance with FAR 52.219-14, limitations on subcontracting.
Also note any improvements exceeding the RFP requirements or betterments provided, including an explanation of proposed systems, must be clearly identified in this sub-factor.
SUB-FACTOR C - QUALITY CONTROL:
The Government will evaluate the offeror’s responses to Evaluation Factor 1 (Technical Capability) and any contractor’s attachments concerning proposed quality control activities and proposed safety program, including, but not limited to, training and documentation for compliance with the solicitation requirements.
QUESTION 3: The description of Sub-Factor A - Experience on page 23 of 69 of the Solicitation makes reference to "Attachment #6, Past Performance Relevancy Questionnaire" and the description Section 4.2 " Evaluation Factor 2: Contractor's Past Performance" on page 24 of 69 of the Solicitation makes reference to "Attachment 7, Past Performance Questionnaire (PPQ)". Please clarify the reference as the Past Performance Questionnaire included within the Solicitation documents makes no reference to an Attachment. Please advise.
VA RESPONSE: This was an administrative error in referencing the Past Questionnaire as Attachment 6 in Paragraph 4.1. This is changed to Attachment 7 (attached). As shown on the last page of the solicitation, all seven (7) attachments are identified on what they are.
QUESTION 4: Section 01 00 00 -1 Paragraph 1.2 D states the VA will provide inspections including Special Inspections. Is this correct and the Contractor will not do testing?
VA RESPONSE: Special Inspections shall be conducted in accordance with Section 01 45 35, VA to provide this service per 01 00 00 -1 Paragraph 1.2D. Contractor shall provide all standard testing as delineated in Section 01 45 29 and subsequent material sections.
QUESTION 5: Section 01 00 00 – 7 Paragraph 1.6 J states to erect Construction fence as shown. Please state where this is shown or are we to assume it to be along the entire LOD?
VA RESPONSE: YES, Line of Demarcation for the construction fence.
QUESTION 6: Section 01 00 00 -25 Paragraph 1.24 A. Please confirm a Professional photographer is required to take photos weekly and also shall include 360 degree photos of the project.
VA RESPONSE: YES.
QUESTION 7: I am also looking form access to the prints for the Div. 27 Low Voltage structured cabling.
VA RESPONSE: Specification Section 26 05 19 Low Voltage Electrical power conductors and cable is attached. (Attachment 1) Electrical drawings are E001, E101, E102, E201, E202, E301, E401, E402 and E501. Site Electrical are ES101 and ES102 and were included in the project drawings.
QUESTION 8: Are all the attachments located in FBO? Can we access the documents?

QUESTION 9: Is it possible to share the Electronic Revit model with the contractor se we can build upon. We are ready to sign a disclaimer to waive any liability that may be generated from sharing the Revit model.
VA RESPONSE: The Revit version 2018 was used for the New Admin drawing set.
QUESTION 10: There are two (2) proposal due dates for the proposal. Which one is correct?
VA RESPONSE: The February 14, 2020 date is the correct date. This amendment changes the proposal due date to Friday, February 14, 2020 at 12:00 PM. The SAM Customer Service representative posted the second solicitation with a proposal due date of 2-14-2020 along with activating the vendors interested tab.
QUESTION 11: The solicitation states that the proposal is due 01/28/2020 at 4:00 p.m. but the beta.sam.gov website states that offers are due 02/14/2020. Please confirm the date the proposals are due, and I’ve included a snapshot of both the solicitation and website below for reference. Thank you in advance.

QUESTION 12: Please verify the sealed offers due date is 4 pm on Tue 1/28/2020. On the beta.SAM.gov website the “Updated and Original Date Offers Due” lists Feb 14, 2020.
VA RESPONSE: A solicitation amendment will be posted this week changing the response date to February 14, 2020. The second posting was not from us in the Contracting Office.

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate, if it is higher than the conformed wage rate). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

4.) All decisions by the Administrative Review Board are final.
