This project is to furnish all necessary professional Construction services to upgrade steam/condensate heating distribution system and devices throughout the multiple floors of Building 1 located at the East Orange VA Medical Center The contractor shall furnish all materials, supplies, equipment, personnel and supervision to accomplish Project No.

561-20-101 Upgrade steam/condensate heating distribution system.

This is a 100% Service-Disabled Veteran Owned Small Business set aside procurement. All prospective bidders must be registered in SAM (WWW.SAM.GOV) with a Unique Entity Identifier (UEI) and are verified/visible/certified as an SDVOSB on WWW.DSBS.SBA.GOV at the time of bid submission and prior to award of this procurement. Bidders must submit their annual Vets-4212 Report. Magnitude of Construction: Between $5,000,000 and $10,000,000. The North American Industry Classification System Code (NAICS) is 238220 - Business Size is $45 million.

Contractor will be responsible to coordinate and schedule work and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the CO. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the East Orange Campus.

A pre-bid site visit is scheduled for 4/30/25 at 9:00 AM EST. Prospective bidders shall meet at VA East Orange Building 5A Engineering Conference Room 113, 385 Tremont Ave East Orange, New Jersey 07018.

NOTE: NO OTHER SITE VISITS WILL BE ALLOWED. INTERESTED BIDDERS ARE STRONGLY ENCOURAGED TO ATTEND.

Upgrade Heating System Phase 1

1. Contract Title.

Furnish professional construction services for project 561-20-101 Upgrade Heating System Phase 1 at the VA NJ Health Care System, East Orange, NJ.

2. Background.

Project will upgrade steam/condensate heating distribution system and devices throughout the multiple floors of Building 1.

The current heating system is collapsing and is beyond economical repair status.

Newly created, more economical system will reduce the amount of maintenance time, and allow for a better control and heat distribution among the rooms, floors and departments.

In addition, the new system will create a better quality of life for patients, visitors and employees at VA New Jersey Health Care System East Orange Campus, Building 1 Main Hospital.

3. Scope.

Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials to perform work for VA Project 561-20-101 Upgrade Heating System Phase 1 as required by AE drawings and specifications

4. Specific Tasks.

The contractor shall provide a complete construction service, including but not limited to, all labor, material, equipment, supervision, inspections, submittals and as built drawings to perform all work as shown in the AE drawings and specifications.

5. Performance Monitoring.

Work shall be coordinated with the facility through the Contracting Office Representative (COR). The designated COR will monitor the contract performance and make sure the Contractor adheres to VA standards and designated project milestones.

Contractor will be evaluated at least annually for performance and conformance to the requirements. Few main areas will be evaluated throughout the Construction period. Areas to include:

Quality, examples:

o Ability to maintain quality control o Implementation of 3-phase inspection process o CQC (Contractor Quality Control) documen o Whether plans are coordinated with specifications o Coordination between disciplines o Compliance with design criteria o Reviews of materials and shop drawings o Identification and correction of deficient work o Whether there was incorporation of unspecified materials

Schedule, examples:

o Contractor’s management, on-site, and home office personnel exhibiting the capacity to adequately plan, schedule, resource, organize and otherwise manage the work.

o Subcontract management in relation to prompt payment, compliance with labor and safety standards and whether subcontractors were an integral part of the contractor’s team.

6. Security Requirements.

Contractor’s employees shall not enter the project site without appropriate security badge. They may also be subject to inspection of their personal effects when entering or leaving the project site.

No photography of VA premises is allowed without written permission of the CO/COR except as specifically required by the scope of the work.

VA reserves the right to close or shut down the project site and order Contractor’s employees off the premises in the event of a national emergency. The Contractor may return to the site only with the written approval of the Contracting Officer.

9. Risk Control

Contractor shall take all measures for safety & infection control and provide all material necessary for protecting existing equipment and property in affected areas of construction against dust and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered.

Contractor shall permit access to Department of Veterans Affairs personnel and patients through other construction areas which serve as routes of access to such affected areas and equipment. Coordinate alteration work in areas occupied by Department of Veterans Affairs so that Medical Center operations will continue during the construction period.

10. Place of Performance.

VANJHCS East Orange, Building 1

Minimize interference of construction activities with flow of Medical Center traffic, keep roads, walks and entrances to grounds, to parking and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles.

11. Period of Performance.

Contractor to start immediately after receiving the Notice to Proceed (NTP), estimate completion time is 760 calendar days. Completion time includes all phases of the contract, weekends and holidays.

SALIENT CHARACTERISTICS:

Controls for all equipment within this project including but not limited to condensate pumps, hot water pumps, heat exchangers, fan coil units, air handlers, finned tube radiators, variable air volume boxes, and constant volume boxes must be integrated into the existing building management system. Ainsworth is the controls vendor for the East Orange VA campus and will assist in ensuring integration is completed to the level required at the station and as specified by the contract drawings. Controls equipment related to the above-mentioned equipment will be custom tailored to the station based on existing controls equipment provided by Ainsworth. Ainsworth provided controls equipment meets the required specifications and will allow for seamless integration of new equipment into the existing building management system already present at the station. New equipment information and alarms will be able to be viewed by expanding and utilizing the current BACnet infrastructure at the station. Detailed equipment information will be able to be accessed at the main console in the chiller plant. Utilizing a separate controls vendor would require significant modification for proper integration into the existing system and would come at an excessive cost to the government.

All characteristics are for reference purposes only and the VA will consider similar substitutions provided the intent of this project is still met and no federal, state or VA standards are violated.

SOLICITATION AMENDMENTS: Amendments to the solicitation will be posted at https://sam.gov/ Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.

2.4 52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT—

CONSTRUCTION MATERIALS UNDER TRADE AGREEMENTS (MAY 2014)

ALTERNATE I (MAY 2014) AND ALTERNATE II (NOV 2023)

(a) Definitions. "Bahraini, Mexican, or Omani construction material," "commercially available off-the-shelf (COTS) item," "construction material," "designated country construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials Under Trade Agreements" (Federal Acquisition Regulation (FAR) clause 52.225-11).

(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute shall submit the request with its offer, including the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material, except foreign construction material from a designated country other than Bahrain, Mexico, or Oman that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material other than Bahraini, Mexican, or Omani construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material other than Bahraini, Mexican, or Omani construction material. (a) Any protest filed by an interested party shall—
