Base offer minus Deduct Alternates 1, 2 and 3, within funding limitations will be awarded. If it exceeds funding limitations then;

PROPRIETARY ITEMS: Notwithstanding any other provision of the contract, no other material, equipment, testing, installation or product of the following proprietary items will be acceptable for use as a substitution:

1) Fire Alarm System - General Electric/EST-3 System as assembled and bench tested by the manufacturer of record Signet Electronics Systems, Inc. Justification: Items are Engineering’s building standards; only one fire alarm system can operate the Brockton campus. The campus has an existing General Electric/EST-3 Fire Alarm System as assembled and bench tested by the manufacturer of record, Signet Electronic Systems, Inc. in place. In order to maintain VA code certification the fire alarm system to be installed in the new building must be the same product and manufacturer of the existing system. The existing Siemens Building Technology Direct Digital Control HVAC Building Management System was procured under a contract awarded through full and open competition. No substitutions.

2) Direct Digital HVAC Building Management Control System - Siemens Building Technology. Justification: Items are Engineering’s building standards; only one building management system can operate the Brockton campus. Any products to be used on the existing HVAC Building Management System must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project must be provided by the same manufacturer as that of the campus wide system; other manufacturer’s components may not operate properly or operate at all on the existing system. The VA has existing service contracts with Siemens. It is cost effective for the new DDC system and components to be installed and maintained under the existing service contracts with Siemens. Introducing other manufacturer’s products may void the existing DDC system’s manufacturer’s warranty. Therefore, only this manufacturer’s products are acceptable. The existing Siemens Building Technology Direct Digital Control HVAC Building Management System was procured under a contract awarded through full and open competition. No substitutions.

3) Door Lock and Latchset – Schlage. Justification: Items are Engineering’s building standards; Engineering’s locking system for Brockton is based on Schlage locks. Schlage is the existing VA Brockton Engineering building standard for door locks that is installed and operating campus wide at the Brockton VAMC. Schlage products are compatible with the Best keying system used on the Brockton VAMC campus; other manufacturer’s door locks may not be compatible with the Best keying system and may not operate properly or operate at all with the Best keying system. The Brockton campus has an existing locksmith with inventory of Schlage door locks and spare parts; it would be uneconomical for VA locksmith to create additional inventories of other manufacturer’s door locks. Therefore, only this manufacturer’s products are acceptable; no substitutions.

4) Door Lock Cores - Best Access Systems. Justification: BEST 7-Pin Door Lock Cylinders with Removable Cores from Stanley Security Solutions - BEST 7-Pin Door Lock Cylinders with Removable Cores from Stanley Security Solutions is the existing VA Brockton Engineering building standard for door lock cylinders that is installed and operating for the keyed security system campus wide at the Brockton VAMC. Other manufacturer’s cannot make the Best lock cylinder and would not be compatible with the existing keyed security system. The Brockton campus has an existing locksmith with inventory of BEST 7-pin cores from Stanley Security Solutions; in order for the new door lock cylinders with removable cores on this project be coordinated with the existing locksmith and inventory, the door lock cylinders with removable cores must be BEST 7-Pin door lock cylinders with removable cores from Stanley Security Solutions. No substitutions.

5) Patient Lift Systems – Patient lift systems by Liko North America, a Hill-Rom company; distributed and installed by Beacon Health Care products, LLC - Liko Patient Lift Systems is the existing VA Boston Healthcare System (Brockton, Jamaica Plain, West Roxbury) patient lift standard that is installed and operating at the three campuses. The recommended source has determined both the ability to install the system properly and to troubleshoot problems when they arise. Engineering believes that a critical system like this one needs to be installed by a single source so that when there are problems this single source can be contacted for immediate resolution.

6) Brick - Exterior Face Brick: Taylor Clay Products Exterior Face Brick, Blend #306, 309 and 316. Justification: This system is VA Brockton Engineering’s Building Standard for exterior face brick. In order to maintain matching the existing face brick in color, composition and size the exterior face brick must come from the same manufacturer as the original building construction. Taylor Clay Products Exterior Face Brick, Blend #306, 309 and 316 is the original manufacturer of the exterior face bricks used on the original buildings at the Brockton campus. Other manufactures are unable to match the existing exterior face brick. Therefore, only this manufacturer’s products are acceptable. No substitutions.

7) Interior Signage - Innerface Sign Systems, Inc. Justification: Items are VA VISN 1 Interior Designer’s building standards. No substitutions.

PHASING:

Phase 1: Wards 4-1-B, first floor and 4-2-B, second floor. These wards will be vacated by the VA prior to construction field work commencement.

Phase 2: Wards 4-1-C, first floor and 4-2-C, second floor. These wards will be vacated by the VA prior to construction field work commencement.

NOTES:

1. The order of phasing may change at the discretion of the VA.

2. One phase needs to be complete before the next phase can commence.

3. 60 calendar days prior to start of Phase 1, the contractor shall provide written notification to the VA the actual date construction field work for Phase 1 will commence (see specifications section 01 00 00 General Requirements regarding construction commencement). VA will conduct internal coordinations/relocations/notifications/etc. before the contractor can commence Phase 2 work.

4. Basement Floor will remain occupied and operational during each phase.

5. 60 calendar days prior to completion (which includes all corrective action for punchlist items) of Phase 1, the contractor shall provide written notification to the VA the date Phase 1 will be complete. VA has 60 calendar days from the end of Phase 1 actual completion date to conduct internal coordinations/relocations/notifications/etc. before the contractor can commence Phase 2 work.

6. Basement Floor will remain occupied and operational during each phase.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS

1.1 INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO OFFERORS

The Government will award a contract resulting from this solicitation using the evaluation method “Lowest Price Technically Acceptable.” This method is appropriate when best value is expected to result from selection of the technically acceptable offer with the lowest evaluated reasonable price. Offers will be evaluated for acceptability but not ranked using the non-price factors. Evaluation factors and significant sub factors that establish the requirements of acceptability are set forth below. Award will be made on the basis of the lowest evaluated reasonable price of proposals meeting the acceptability standards for non-price factors (FAR 15.101-2). The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a price, management approach and past performance. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The Government reserves the right to waive informalities and minor irregularities in offers received. If a minor clerical error has occurred, then the offeror may be given an opportunity to correct the minor error within the constraints of the "clarifications" process. The following factors shall be used to evaluate offerors on a lowest reasonable price, technically acceptable in accordance with FAR 15.101-2:

This solicitation is for a firm, fixed price construction contract. Award shall be made to the technically acceptable offer that provides the lowest reasonable price as referenced in the Statement of Items; however due to funding constraints the Government may award any deduct alternate or combination of deduct alternates in accordance with the notes on the Statement of Items. The Government intends to award a contract to one offeror deemed responsible in accordance with Federal Acquisition Regulation (FAR 9.1).

Offerors are required to submit technical proposals addressing the Evaluation Factor, Management Approach - Technical Qualifications, Sub-Factors 1-5. Award will be made on the basis of the lowest evaluated reasonable price of proposals meeting the acceptability standards for non-price factors. There shall be no trade-offs. Offers evaluated as not Technically Acceptable will not be eligible for award, regardless of price.

OFFERORS SHALL COMPLETE THE ATTACHED CALCULATION OF SELF-PERFORMED WORK AND SUBMIT THE COMPLETED FORM WITH THEIR PROPOSAL.

The proposal must set forth full, accurate and complete information as required by the solicitation. The Government will rely on such information for the award of the contract. By submission of the offer, the Offeror agrees that all items proposed (if applicable e.g. key personnel, subcontractors, safety plan, etc.) will be utilized for the duration of the contract and any substitutions will require prior Contracting Officer's approval.

The offeror shall be held responsible for the validity of all information supplied in the proposal, including the information provided by potential subcontractors. Should subsequent investigation disclose that the facts and conditions were not as stated, the proposal may be rejected.

AVAILABILITY OF SOLICITATION DOCUMENTS: All solicitation related documents will be published to http://www.fedbizopps.gov.

SERVICE DISABLED VETERAN-OWNED SMALL BUSINESS VERIFICATION: This requirement is 100% set-aside for verified Service Disabled Veteran Owned Small Business (SDVOSB). The award of this requirement shall not be delayed due to loss of SDVOSB verification. Proposals submitted by non-verified SDVOSB’s will be excluded from evaluation and award consideration.

AMENDMENTS: Amendments to this solicitation will be posted at http://www.fedbizopps.gov. Paper copies of the amendments will NOT be individually mailed. No other notification of amendments will be provided. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your bid being considered nonresponsive.

PREPARATION OF PROPOSAL: Government will not pay for any costs incurred in preparation and submission of offers.

1.2 EVALUATION FACTORS AND BASIS FOR AWARD

A. Technical Evaluation Factor

Management Approach - Technical Qualifications:

The Government will rate an offeror's Technical proposal, at the factor level, using an acceptable or unacceptable rating that combines technical merit and proposal risk that most accurately defines the offeror's performance risk considering all sub-factors identified in this section. Sub-Factors 1-5 will be evaluated as “Acceptable or Non-Acceptable”. The Government intends to make a single award to the lowest priced technically acceptable offer. To receive an overall acceptable rating and be eligible for award, the offeror must be technically acceptable in each of the sub-factors identified below.

Sub-factor 1. Ability to adhere to construction schedule:

Ability to adhere to construction schedule for completion within 912 days from Notice to Proceed as specified in the solicitation. Using the information submitted in response to the solicitation, the Government will evaluate the offerors’ scheduling methodology to determine if they have scheduling processes that ensure completion and control of the project from beginning to end. To be evaluated as acceptable the offeror must provide a sample schedule that demonstrates an understanding of the limitations of the schedule as well as an understanding that an appropriate schedule will result in successful completion of the project for this evaluation factor. If the offeror plans to use a fast-track approach to permit early mobilization and construction, this approach shall be described. Proposals describe capability to meet CPM form requirements and demonstrate, with a sample schedule, the ability to appropriately utilize this method of scheduling. Based on the information provided in response to the RFP, evaluate the schedule and make an acceptability determination as to the offeror’s ability to meet the contract completion time.

Sub-factor 2. Technical Approach:

Using the information submitted in response to the solicitation, the Government will evaluate the offeror’s ability to successfully perform the requirements of the project. To be evaluated as acceptable the offeror must provide a narrative that addresses the functions, responsibilities, authorities, and duties of proposed technical staff to determine if the offeror has the ability to manage and perform the project without significant difficulty for this evaluation and sub-factors. Specific details should also be addressed in the proposal to demonstrate sequence of work to be performed in a realistic fashion; i.e. coordination with subcontractors, etc. The narrative should also identify key personnel proposed for the project and their documented experience on successful completion of contracts. Cost control successes should be documented for other completed contracts. Proposal addresses ability to work cooperatively with other contractors working in adjacent spaces and also addresses the ability to work in occupied spaces, including flexibility with scheduling in order for the VA to continue to provide services required for our patients. Provide address of corporate office and branch office which would manage the project if awarded.

Sub-factor 3. Expertise in constructing addition within a hospital Using the information submitted in response to the solicitation, the Government will evaluate the offeror’s ability to perform work required under this project with relation to expertise in building medical additions of comparable size. To be evaluated as acceptable the offeror must provide a narrative that addresses prior projects that are directly related in scope, complexity, magnitude, and cost to this requirement completed within the past five (5) years. The proposal narrative shall adequately describe the projects that are relevant to this requirement that were preformed directly by the General Contractor. The narrative shall also address any equipment to be utilized (owned or rented); and any other documentation relative to this project to demonstrate expertise in building medical additions.

Sub-factor 4. Effective Construction Safety Plan and demonstrated satisfactory record of safety performance on past projects:

Using the information submitted in response to the solicitation, the Government will evaluate the offeror’s ability to comply with an effective construction safety plan submitted in response to the requirements of the solicitation. The offeror shall develop a proposed plan in response to this evaluation sub-factor. Additionally the proposal shall include documentation regarding the successful training of personnel in accordance with OSHA requirements (i.e., 30-hour or 10-hour completed OSHA training.) The narrative demonstrates familiarity with and/or plans to adhere to OSHA requirements and other safety requirements incorporated in the solicitation. Additionally, the proposal shall contain relevant information regarding any safety accidents or violations and corrective action taken or demonstrates no documented violations. Offeror shall demonstrate that the company has no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past three years and has an Experience Modification Rate (EMR) of equal to or less than 1.0. Simply having an EMR greater than 1.0 does not eliminate a contractor from selection. The Offeror will be allowed to submit an offer with additional information explaining the EMR; and the CO will need to make a responsibility determination based upon all the usual factors. Further, if the offeror is deemed non-responsible, but otherwise eligible for award; the matter will be referred to the SBA for a Certificate of Competency. Offeror shall complete the attached Pre-Award Contractor Evaluation Form for Safety and submit it with your narrative response to this sub-factor. To be evaluated as acceptable the offeror must submit a proposed plan in response to this evaluation factor addressing the requirements of the safety and training requirements. The offeror shall also complete the attached Pre-Award Contractor Evaluation Form for Safety and submit it with your narrative response for this evaluation factor.

Sub-factor 5. Compliance with Infection Control Procedures Using the information submitted in response to the solicitation, the Government will evaluate the offeror’s demonstrated ability to comply with the requirements of the Infection Control Procedures at the VAMC Togus. The proposal addresses supervision, responsible parties, employee responsibilities, work practices; training, materials, equipment, and risk assessment methods. To be evaluated as acceptable the offeror must submit a narrative that addresses supervision, responsible parties, employee responsibilities, work practices; training, materials, equipment, and risk assessment methods for this factor.

Technical Acceptable/Unacceptable Ratings at Factor Level

Rating
Description
Acceptable

B. Past Performance Evaluation Factor

Past Performance:

Previous experience will be evaluated as “Acceptable or Non-Acceptable”. To be acceptable, offerors must provide information demonstrating they have successfully performed as prime contractor within the last five (5) years* no less than ONE (1), and no more than three (3), construction projects of equal or greater size and complexity within the same or similar scope of work as work is identified in the project as described by the drawings and specifications of this solicitation in the price range of $5,000,000 to $10,000,000.00. This information shall be submitted on the “Past Performance Information Form” that is attached. (Note: A separate form shall be submitted for each contract). The past performance information forms provided with the proposal will be used for this evaluation factor. Additionally, past performance information shall be obtained by the Contract Specialist from any other sources available to the Government to include, but not limited to, PPIRS or other databases; interviews with Program Managers, Contracting Officers, and/or Contracting Officer Representatives.

For each of the submitted Relevant Past Experience contracts, provide the following information:

· Provide at 1 - 3 photos for each project submitted

· Total square footage for new new/renovated space to the nearest whole number

· Projects showing renovation of hospital environment interiors

· Projects showing replacement of roof top HVAC units and controls

· The name of the construction contract, and the contract ID number;

· The name of the contracting agency or organization the contract was awarded by

· The date of the construction contract award, POP, and the contract award amount in dollars;

· The date of the construction contract completion, and the final contract amount, in dollars

· Provide a description of the construction contract scope of work; and

· Identification of at least one point-of-contact at the organization that awarded the submitted contract, including:

· The name of the point-of-contact; their current mailing address; phone number; and email address (if applicable).

*The (5) five years shall be calculated from the solicitation issue date.

**Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Aspects of Past Performance Evaluation: The past performance evaluation results are an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertains to the requirements outlined in the solicitation.

There are two aspects to the past performance evaluation. The first is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The criteria to establish what is recent and relevant are listed above. Consideration should be given to those aspects of an offeror’s contract history that would give the greatest ability to measure whether the offeror will satisfy the current procurement. Common aspects of relevancy include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.

Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is expressed as a time period during which past performance references are considered relevant.

Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

Past Performance Relevancy Ratings

Rating
Definition
Relevant
Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Not Relevant
Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

Sources of Past Performance Information for Evaluation are as follows:

• Past performance information shall be provided by the offeror, as solicited.

• Past performance information shall be obtained from questionnaires tailored to the circumstances of the acquisition

• Past performance information shall be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; interviews with Program Managers, Contracting Officers, and Contracting Officer Representatives. The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to overall performance.

Once relevancy and overall performance have been reviewed, an overall acceptable or unacceptable rating will be assigned to each offeror based on the below definitions.

Overall Past Performance Evaluation Ratings

Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above.)
Unacceptable
Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

C. Price Evaluation

Price:

The purpose of the Price evaluation is to provide an assessment of the reasonableness of the proposed price in relation to the solicitation requirements. Reasonableness of an offeror's proposal is evaluated through price analysis techniques as described in FAR Subpart 15.305(a) (1) and (4). For Price to be reasonable, it must represent a Price that provides best value to the Government when consideration is given to prices in the market, (market conditions may be evidenced by other competitive proposals), technical and functional capabilities of the offeror.

Base offer and Deduct Alternate 1-3

After Completion of Technical and Past Performance have been determined, the intention of the Government is to award the base lump sum item contingent upon funding limitations. Should all proposals for the base lump sum (Line Item 0001), exceed the funding limitations for this project, the Government will evaluate deduct alternate items alternates according to the following priority list:

Base offer minus Deduct Alternate 1 (Line Item 0002), within funding limitations will be awarded. If it exceeds funding limitations then;

Base offer minus Deduct Alternates 1 and 2 (Line Items 0002 and 0003), within funding limitations will be awarded. If it exceeds funding limitations then;

Base offer minus Deduct Alternates 1, 2, and 3 (Line Items 0002, 0003 and 0004), within funding limitations will be awarded. If it exceeds funding limitations then the solicitation will be cancelled;

NOTE: Offerors must provide a price for all line items (Line Items 0001 thru 0004)

1.3 SUBMISSION OF PROPOSAL

Important Note: Respond to all requirements of the solicitation. Failure to provide the information required will render the offer unacceptable.
