INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS
(a) Hard copies of bidding documents will not be provided. The solicitation, all bidding documents, subsequent solicitation amendments, award notification, and all other solicitation related information will be posted to the website www.SAM.gov under the Contracting Opportunities section.
(b) A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for receipt of proposals, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(c) The bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25. The penal sum for each bond at the time of award shall be 100% of the original contract price IAW FAR 52.228-15. The awardee shall furnish performance & payment bonds to the Contracting officer. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.
(d) An original, hard copy, executed Bid Guarantee (on form SF-24) must be mailed to the address below and received by the Contracting Officer within 5 business days of the proposal due date and time shown in Box 13a of solicitation form SF 1442 (or as subsequently amended).
(e) Volume III, Tab 2 - Price Proposal must contain a legible, scanned copy of the Executed Bid Guarantee (SF-24). Seals should be shaded with pencil lead to make them legible, prior to being scanned and emailed.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS
PART I - GENERAL
1. Gender: Whenever the masculine gender is used in this solicitation and contract documents, it shall be considered to include feminine.
2. The Government makes no guarantee as to the accuracy of the electronic copies of drawings.
3. Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at www.SAM.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their proposal.
4. Offerors are encouraged to track this solicitation via the Contract Opportunities Section of the www.SAM.gov website.
5. Amendments: Amendments to this solicitation will be posted at www.SAM.gov. Paper copies of the amendments will NOT be individually mailed. Check www.SAM.gov regularly for updates. No other notification of amendments will be provided. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your proposal being considered non-responsive.
6. A public bid opening will not occur under this RFP solicitation.
7. VETS 100: Title 38, USC Section 4212(d) and Public Law 105-339, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS 4212 reporting information can be done electronically at: https://www.dol.gov/agencies/vets/programs/vets4212. For procurement awards in excess of $25,000, this report must be completed and accepted prior to any Federal contract award. Therefore, all potential contractors are encouraged to file every year.
8. Required registration with contractor performance assessment reporting system (CPARS)
(a) As prescribed in Federal Acquisition Regulation (FAR) Part 42.15, the Department of Veterans Affairs (VA) evaluates contractor past performance on all contracts that exceed $750,000, and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses online databases located at the Contractor Performance Assessment Reporting System (CPARS) website; to include the Construction Contractor Appraisal Support System (CCASS), the Architect-Engineer Contract Administration Support System (ACASS), and the Federal Awardee Performance & Integrity Information Retrieval System (FAPPIS). This site is maintained by the Naval Sea Logistics Center. The CPARS database information is shared with the Past Performance Information Retrieval System (PPIRS) database, which is available to all Federal agencies.
(b) Each contractor whose contract award is estimated to exceed $750,000 is required to register with the CPARS database at the following web address: https://cpars.cpars.gov/cpars/app/accessrequestverify_input.action?role=SCR (Corporate Senior Management Access Request). Help in registering can be obtained by contacting CPARS Support E-mail (webptsmh@navy.mil) or by calling (207) 438-1690. Registration should occur no later than thirty days after contract award and must be kept current should there be any change to the contractor’s registered representative.
(c) For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and reassign the report to the VA contracting officer.
(d) Failure to have a current registration with the CPARS database, or to reassign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.
Pre-Proposal Conference & Jobsite Walkthrough (Site Visit):

The pre-proposal conference will be held on site and virtually on May 5, 2022, from 10:00am – 10:15am CST (Local - Central Time).

A jobsite walkthrough (site visit) is scheduled to take place immediately upon completion of the pre-proposal conference on May 5, 2022 from approximately 10:15am to 12:00pm CST (Local - Central Time).
No questions will be answered at the site visit. All questions must be submitted in writing to the Contracting Officer, as indicated below.

PART II – PROPOSAL INFORMATION
1. PROJECT DESCRIPTION
The purpose of this project is to enable an existing national cemetery to continue to provide burial services for eligible veterans in the St. Louis, MO area. The National Cemetery Administration (NCA) contracted this 8.5-acre cemetery expansion project to increase burial capacity of Jefferson Barracks National Cemetery (JBNC) to serve veterans in the St. Louis area. This cemetery expansion project identified as Phase 5C is expected to be the last expansion at JBNC. The Phase 5C documents are packaged separate due to the schedule of building demolition for the Jefferson Barracks Division of the Veterans Affairs St. Louis Health Care System (abbreviated herein as VAMC) project. Phase 5C will proceed upon VAMC building demolition and property turnover to JBNC. Design elements of Phase 5C is listed below:
Base Requirements:
ITEM I, CLIN 0001 BASE BID: The contractor shall provide all labor, equipment, and materials necessary to complete all work in accordance with the Specifications and Drawings. Work includes general construction, alterations, roads, walks, grading, drainage, site furnishings, landscaping and irrigation necessary removal of existing structures and construction and certain other items. The Base Bid work of this contract includes phased requirements. Phase 5C includes PPC Sections 1XX (2,316 double depth crypts), 1YY (1,981 double depth crypts), 1S (2,216 double depth crypts), 1R (2,022 double depth crypts) and IGC Section 1ZZ (765 In Ground Cremains sites). PPC Sections 1XX and 1ZZ will be turned over to the government within 275 calendar days from Notice to Proceed. These phases are referred to as Early Turn Over (ETO). Completion of the ETO work will follow procedures like those for final completion and acceptance, with the facilities within the ETO being completed and turned over to the Cemetery for use to begin operation of the Cemetery while the remaining work is completed. ETO shall be completed and accepted by NCA for operation within 275 calendar days from Notice to Proceed. While the work of the ETO is being performed, work for the remainder of the project can also be performed.
ITEM II, CLIN 0002 BASE BID: Manufacture, deliver, off-load, and store no fewer than 8,535 pre-placed double-depth crypts.
ITEM III, CLIN 0003 Add Alternate 1: Improve paving grades at two locations on the Jefferson Barracks Division Campus where existing grading anomalies present challenges to pedestrian transit. The locations are at the intersection of the cemetery road and the facility between buildings 1 and 25 as well as near the stair at building 55. At the crosswalk from B1 to B25, rework grading and paving to provide an accessible crosswalk. At the building 55 connector, rework and regrade the existing sidewalk at the approach to the building 55 connector and repair stones at stair as indicated. See Add Alternate 1 drawing sheets G001, AE100, C-100, C-101, and C-102.
The project period of performance shall be 548 calendar days from Notice to Proceed.
An additional 90 calendar days will be added to the period of performance if Add Alternate 1 is elected for award in the contract.
The estimated cost of construction is between $20M and $50M.
The contract is estimated to be awarded on or around July 24, 2022.
2. ACQUISITION STRATEGY/CONTRACT STRUCTURE
In accordance with 38 USC 8127, the contracting officer has determined that this construction acquisition be 100% set-aside for CVE-verified Service-Disabled Veteran-Owned Small Business (SDVOSB) concerns.
The basis for award will be FAR 15 Best Value utilizing Tradeoff Process source selection.
The Government intends to make award without discussions, in accordance with 15.215-1. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if the Contracting Officer determines discussions to be necessary.
This acquisition will result in a firm-fixed price contract. The Government will award a single contract resulting from the solicitation, to the responsible Offeror whose offer conforms to the solicitation requirements and provides the best value to the Government considering both non-price factors and price.

Technical factors are Equal in importance and subfactors within factors are equal in importance. Technical factors and Past Performance factor are equal in importance. When combined, non-price factors are approximately equal to Price.
Award may be made to other than the lowest-priced offeror or other than the highest technically rated offeror.
5. DEFINITIONS
For the purposes of this solicitation, Recent, Relevant and Similar are defined as follows:
• Recency: “Recent” is defined as construction project/contract work performed in the last five (5) years (between 2017 to 2022). Projects may be completed or at least 50% complete at time of proposal submission.
• Relevancy: “Relevant” is defined as construction project/contract work of a similar size and comparable level of complexity to this project. Relevant size & complexity aspects may include (in descending order of relevance):
o Very Relevant: Cemetery projects exceeding $20M in construction costs, requiring new precast crypt field development, columbarium construction, roadway or other paving, irrigation systems, dam/spillway/stormwater outfall improvements, vertical construction/renovations, and significant landscaping improvements.
o Relevant: Cemetery projects greater than $10M OR other heavy civil construction projects exceeding $20M, requiring new precast crypt field development, columbarium construction, roadway or other paving, irrigation systems, stormwater management systems, vertical construction/renovations, and/or significant landscaping improvements.
o Somewhat Relevant: Cemetery projects greater than $5M OR other construction projects exceeding $10M in construction costs, requiring new construction/renovations of buildings, pre-cast/cast in place concrete, turf (sod) placement and maintenance, tree and shrub placement and maintenance, irrigation central control systems, stormwater systems, roadways or other paving, wetlands/environmental remediation, or restoration. May include golf courses, regional parks, multiple sport-fields complexes, or multi-phased recreation-oriented land development projects larger than 10 acres.
o Not Relevant: Involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
• Similar: “Similar” is defined as a cemetery construction projects comparable to value project at or over $20M.
6. OFFEROR SUBMISSION INSTRUCTIONS
This solicitation is set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). To help determine the eligibility of Prime contractors to participate in this solicitation, the Government will use the Small Business Administration (SBA) small business size standard associated with the NAICS code applicable to this solicitation – see below.

Submitted proposals that do not adhere to the following instructions may be deemed unacceptable and ineligible for an award;
a. Proposals will be submitted in THREE (3) separate volumes (files).
i. Volume I shall be the Technical Proposal and shall include the offeror’s responses to Evaluation Factors 1, 2, and 3 as well as the subfactors

3. If the file size is greater than 40MB, separate document into multiple files and label files logically and sequentially, for example Volume I-part 1, Volume I-part 2, etc.

NOTE: While 40MB is the maximum message size, things like encryption can add overhead to a message and increase its size, so there are times when a message may need to be under 40MB to be sent successfully to account for this overhead. VOLUME I - TECHNICAL PROPOSAL
Technical Proposal shall consist of THREE (3) factors: (1) Relevant Experience, (2) Technical Approach, and (3) Construction/Project Management and their subfactors, as identified below.
a. FACTOR 1 - RELEVANT EXPERIENCE
Sub-Factor 1.1, Project Experience
The Offeror shall submit three (3) recent projects, considered to be relevant as defined in the solicitation. The Offeror may submit projects for which they were a Prime contractor and projects of their major subcontractors or other partners for which they would partner with on this project.
For each of the three (3) projects, the offeror shall summarize the following information not to exceed four (4) pages for each project. (Total page limit – 12):
· Describe the project in detail and highlight relevance of the project to this solicitation project scope of work.
· Detail the project team and explain each firm’s role on the project. Specifically identify major partners & subcontractors involved on this project that would be used for the project outlined in this solicitation.
· Describe the original project pricing and schedule, then detail the projects performance and include explanations for any price and/or time growth experienced. Include an explanation of any potential correlation between price and schedule.
· Describe the project’s safety record (i.e. number of lost time accidents/days)
· Describe how sustainable design principles were incorporated into the project; indicate to what extent environmental program goals (e.g., Energy Star, Leadership in Energy and Environmental Design) were achieved and how those achievements were recorded into the final documentation. If a LEED certification was required, provide which elements contributed to the certification.
· Indicate whether or not the project required LEED Silver (or higher) certification, and if so, what elements composed that certificate.
· Provide a customer point of contact for each project including name, title, email and phone number. The Government reserves the right to contact the customer to verify information provided by the Offeror.
Sub-Factor 1.2, Key Personnel
Offerors shall provide one resume for each key person identified below including their relevant experience for being assigned to this project.
Resumes should describe work experience in sufficient detail to demonstrate its relevance to the evaluator. Resumes should also show the number of years the person occupied each position. Proposals that exceed Minimum Qualifications may be rated higher. (Total page limit 21, max 3 pages per resume)
1. Project Executive
Minimum Qualifications:
· Eight (8) years of experience managing construction work considered relevant as defined in this solicitation. (Higher rating may be given for more than fifteen (15) years of experience leading on-site construction projects considered relevant as defined in this solicitation.)
· Bachelor Degree. (Higher rating may be given for Bachelor Degree in Engineering, Construction, Architecture, or Landscape Architecture. Higher rating also may be given for professional licensure in the fields of engineering, architecture, landscape architecture, or construction management)
2. Project Manager
Minimum Qualifications:
· Eight (8) years of experience leading on-site construction projects considered relevant as defined in this solicitation. (Higher rating may be given for more than fifteen (15) years of experience leading on-site construction projects considered relevant as defined in this solicitation.)
· Bachelor Degree in Engineering, Construction, Architecture, or Landscape Architecture. (Higher rating may be given for professional licensure in the field of engineering, architecture, landscape architecture, or construction management)

3. Construction Superintendent
Minimum Qualifications:
· Ten (10) years of field superintendent experience, leading construction work considered relevant as defined in this solicitation. (Higher rating may be given for more than fifteen (15) years of field superintendent experience leading on-site management of construction work considered relevant as defined in this solicitation.)
· Show evidence candidate meets Health & Safety qualifications in the solicitation specifications (Spec 01 35 26 Sec. 1.7-1.8), at the time of proposal.
4. Quality Control Officer/Contractor Quality Control (CQC) System Manager:
CQC System Manager is an individual within the onsite work organization that is responsible for overall management of CQC and has the authority to act in all CQC matters for the Contractor.
Minimum Qualifications:
· Bachelor’s degree in Engineering, Construction, Architecture, or Landscape Architecture and five (5) years general construction experience in the role of project manager, project engineer, QC manager, or project superintendent.
· Two (2) years quality control experience on projects considered to be relevant as defined in the solicitation.
· Show evidence candidate meets Health & Safety qualifications in the solicitation specifications (Spec 01 35 26 Sec. 1.7-1.8), at the time of proposal.
5. Safety Officer
Minimum Qualifications:
· Must be designated Prime Contractor Safety Officer
· Provide evidence (course completion certificate) that candidate has completed the OSHA 30-hour Construction Safety class within the last two (2) years
· Five (5) years of construction industry safety experience OR three (3) years of construction industry safety experience if he/she possesses a Certified Safety Professional (CSP) or certified Construction Safety and Health Technician (CSHT) certification or have a safety and health degree from an accredited university or college.
· Provide evidence that candidate must meet the Quality Control and Health & Safety qualifications specified in the solicitation specifications.
· Resume should display candidate’s capability (through training, experience, and qualifications) of ensuring that the requirements of 29 CFR 1926.16 and other appropriate Federal, State and local requirements are met for the project.
6. Independent CPM Consultant
To fulfill all the requirements of this specification section, the Contractor shall engage an independent CPM consultant who is skilled in the time and cost application of scheduling using (PDM) network techniques for projects considered relevant as defined by this solicitation. Provide a brief narrative that describes three (3) to five (5) prior construction projects for which the proposed consultant has performed complete project scheduling services.
Minimum Qualifications:
· Resume should contain sufficient information to show that the proposed consultant has the qualifications to meet the requirements specified in section 01 32 16.13 NETWORK ANALYSIS SCHEDULES MAJOR PROJECTS of the solicitation specifications.
· Resume must indicate scheduling software experience with Primavera P6
7. LEED/Commissioning Coordinator
Provide resume of LEED/Commissioning coordinator to work with the project’s Commissioning Agent and be the contractor’s dedicated Commissioning Team lead.
Minimum Qualifications:
· LEED AP accredited professional OR
· Five (5) years demonstrated experience as commissioning coordinator
b. FACTOR 2 - TECHNICAL APPROACH
The Offeror shall provide a technical approach narrative that clearly indicates how the Offeror would proceed if awarded this contract. The Offeror shall demonstrate their capabilities to use various tools, processes, techniques, personnel, and subcontractors to successfully manage and deliver this project and describe the following:
· Understanding of the project, work requirements and anticipated challenges (construction)
· Plan to manage this project proactively
· Critical construction materials and techniques to ensure timely delivery and installation
· Capability demonstrating the ability to schedule large projects, showing satisfactory completion of construction, using the phases per the plans and specs with minimal interference to daily cemetery operations and visitors (Higher rating may be given for offerors proposing a realistic shortened schedule.)
· Manage project quality control and safety
· Incorporate procedures and plans for managing subcontractor performance
· Incorporate innovative techniques and practices

1. Sub-Factor 3.1, Project Organizational Chart and Narrative:
The Offeror shall provide an Organization Chart and supporting narrative which includes the Offeror’s key personnel as well as major subcontractors and their key personnel. Offeror shall demonstrate its ability to manage a project considered to be relevant as defined in this solicitation, and that it has the necessary organization, experience, accounting, operational controls, and technical skills to build a National Cemetery. Clearly describe the prime responsible firm and key personnel as well as the roles and responsibilities of major subcontractors including crypt supply and placement, irrigation system installation, earthwork subcontractor, and columbarium niche unit supplier and masonry subcontractor. 1. Sub-factor 3.2, Capacity to Perform Work:
The Offeror shall demonstrate they and their major subcontractors have the resources and capacity to perform the work as required by the solicitation documents. The Offeror shall display their current projects with dollars values and estimated completion dates, as well as the current projects with dollar values of their major subcontractors. The Offeror shall also identify current utilization of key personnel proposed in Sub-Factor 1.2. The Government has the discretion to determine what would be considered over capacity. iii. Subfactor 3.3, Schedule:

VOLUME II - PAST PERFORMANCE
Past Performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements. It considers each Offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements.
Each Offeror shall provide three (3) summaries for projects on which the Offeror’s firm was the prime contractor, joint venture partner, or a major subcontractor, in accordance with FAR 15.305(a)(2).
These projects do not have to be the same as submitted under the Technical subfactor 1.1 Project Experience.
For each project selected, Offerors shall provide the following information, not to exceed three (3) pages for each project:
1. Project name and Contract Number (If the project is with a Joint Venture (JV) Partner, provide the DUNS/UEI (Unique Entity Identifier) numbers for each entity).
2. Project location (city & state)
3. Detailed description of the overall project and work scope,
4. Contract award and completion date (if not complete, provide target completion date).
5. Describe the project’s relevance to this National Cemetery project.
6. Provide the name of organization that issued the contract
7. Provide an Owner point of contact (POC) that includes:
i. Name & Title,
ii. Current email address,
iii. Current phone number
8. Provide information regarding completed CPARS evaluations (see below)
OR
COMPLETED Past Performance Questionnaires (see below)
CPARS:
For each of the projects identified for Past Performance evaluation, if CPARS evaluations are available, the Offeror shall clearly identify, by contract number, which projects have interim and final CPARS past performance evaluations. There is no requirement to submit the CPARS reports.
Using CPARS.gov, the Contracting Officer (CO) will access Past Performance reports for the Offeror's core team members (Prime General Contractor, Joint Venture teaming partner and/or mentor-protégé partner. The Offeror shall provide DUNS/UEI (Unique Entity Identifier) numbers for itself and each of the Offeror's core team members (Prime General Contractor, Joint Venture, teaming partner and/or mentor-protégé partner) to facilitate the retrieval of recent and relevant CPAR reports for Past Performance evaluation.
Past Performance Questionnaires:
ONLY for projects without CPARS ratings, the Offeror shall initiate Past Performance Questionnaires (PPQs), by completing blocks 1 through 7 on the form (See Solicitation Attachment.) The offeror will obtain from these contacts, responses to the “Past Performance Questionnaire” to be included in VOLUME II - Past Performance Information.
In case PPQs are not received prior to the proposal submission due date, the Offeror shall clearly identify all representatives to whom PPQs were sent. Offerors are responsible for ensuring that the contact information provided for the representative indicated for each project is accurate and that the representative is aware that the Contracting Officer may be contacting them regarding the PPQ and the Offeror’s past performance. If completed PPQs are not received timely by the Contracting Officer from the representative, the Government reserves the right to disregard them, contact the representative directly, or obtain the requested information from any other sources.
In the event, PPQs are received for projects with CPARS ratings, PPQs will not be considered.
Note: Multi-division or regionalized firms should identify projects performed by the division/business segment that would, if selected, perform the construction on this contract. Projects performed by other divisions/business segments may be identified but may be considered less relevant than projects performed by the local division/business segment proposing on this project.
