About this file

This document is Attachment 9, a Certification Under Executive Order No. 16, which prohibits state agencies and authorities from contracting with businesses conducting business in Russia. The document is part of a statewide contract for Group 30310 – Vehicle and Equipment Parts and Related Product. It requires vendors to disclose and certify their business operations in Russia, with the goal of preventing state entities from entering into new contracts or renewing existing contracts with entities conducting business operations in Russia while federal sanctions are in effect.

The certification form provides vendors with four options for disclosure: (1) no business operations in Russia, (2a) conducting business in Russia but taking steps to wind down operations, (2b) conducting limited business for vital health and safety services or legal compliance, or (3) conducting business operations in Russia. Vendors must sign and date the document, certifying under penalties of perjury that the information provided is true to the best of their knowledge. The document encourages vendors who may be excluded due to current Russian business operations to still respond to solicitations, preserving potential future contracting opportunities if sanctions are lifted.

Certification Under Executive Order No. 16

Prohibiting State Agencies and Authorities from Contracting with Businesses Conducting Business in Russia

Executive Order No. 16 provides that “all Affected State Entities are directed to refrain from entering into any new contract or renewing any existing contract with an entity conducting business operations in Russia.” The complete text of Executive Order No. 16 can be found here.

As defined in Executive Order No. 16, an “entity conducting business operations in Russia” means an institution or company, wherever located, conducting any commercial activity in Russia or transacting business with the Russian Government or with commercial entities headquartered in Russia or with their principal place of business in Russia in the form of contracting, sales, purchasing, investment, or any business partnership.

Is Vendor an entity conducting business operations in Russia, as defined above? Please answer by checking one of the following boxes:
