About this file

This is a Public Contract Boycott Restriction Statement (Attachment B) issued by the Jordan School District in Utah, establishing compliance requirements for vendors bidding on the Remodel Portable Classrooms for Multiple Locations project. The statement mandates that all vendors certify they are not currently engaged in an "economic boycott" or "boycott of the State of Israel" as defined under Utah Code 63G-27 (S.B. 97), and agree to maintain this compliance throughout the contract term if awarded. Vendors must acknowledge their understanding that boycotts of specified entities—including the State of Israel, companies in traditional energy, mining, agriculture, firearms manufacturing and distribution, and companies based on environmental standards or abortion access policies—are prohibited unless such actions constitute ordinary business purposes. The certification requires vendors to provide their company name, signature of an authorized representative, printed name, date, and the solicitation name and number.

This attachment represents a mandatory compliance requirement for participation in the Jordan School District's competitive bidding process. Vendors who discover they are in violation of the boycott restrictions during the contract period must immediately notify the public entity in writing. The statement does not address pricing, set-asides, funding amounts, or other financial terms, as it functions solely as a compliance certification document that must be submitted as part of bid packages. All vendors seeking to contract with the Jordan School District for goods, services, supplies, information technology, or construction services—including this specific portable classroom remodeling project—must complete and submit this certification to be considered responsive bidders.

Public Contract Boycott Restriction Statement Attachment B

(Revised 09/10/2024)

ATTACHMENT B

Public Contract Boycott Restriction Statement

In accordance with Utah Code 63G-27 (S.B. 97) Public Contract Boycott Restrictions, vendors contracting with the Jordan School District to provide any good or service, including supplies, information technology, or construction services, must certify they are not currently engaged in an “economic boycott” nor a “boycott of the State of Israel” as those terms are defined in that Code section. Vendors must also agree not to engage in either boycott for the duration of the contract (if awarded). For example, a vendor may not, without an ordinary business purpose, boycott: the State of Israel; companies engaged in activities related to traditional energy, mining, or agriculture; companies engaged in the manufacture, distribution, sale, or use of firearms; companies that do not meet environmental standards beyond applicable state and federal laws; or companies that do not facilitate access to abortion or sex characteristic surgeries. If a vendor does engage in such a boycott, it must immediately notify the public entity party to the contract in writing.

We agree to comply with the above statement during the entire contract period.
