About this file
This is an Addendum #2 to the bid documents issued by the Essex County Office of the Manager, Purchasing Agent Linda M. Wolf, for a multi-site culvert replacement project in the Town of Moriah, Essex County, New York. The project involves the replacement of culverts at two locations: Tracy Road Culvert(s) over Roe Pond Outlet and Witherbee Road Culvert over Roe Pond Outlet (PIN 1762.97; D041779). Sealed bids were due by 2:00 P.M. on July 30, 2026, with public opening and reading of bids occurring on the same date at the Essex County Purchasing Office, located at 7551 Court Street, Elizabethtown, New York 12932. Addendum #2 was issued on July 27, 2026, three days prior to the bid opening deadline.
Addendum #2 clarifies three key bidding requirements through a question-and-answer format. First, Minority Business Enterprise (MBE), Women Business Enterprise (WBE), and Service-Disabled Veteran-Owned Business (SDVOB) participation commitments or good faith effort documentation must be submitted with bid proposals or no later than close of business on August 3, 2026. Second, subcontractor and supplier tabulations must similarly be submitted with bid proposals or by close of business on August 3, 2026, superseding the original requirement to submit within five days after bid opening. Third, a Disclosure of Lobbying Activities form is not required, as the project is funded entirely by state funds and does not utilize federal funding. These clarifications were issued to all bid document holders of record and must be acknowledged on the Bid Form and inserted into the Project Manual.

QUESTION AND ANSWER (Q & A):
1. Q: Section 10 on Page II-37 of the Bid Proposal states that the Contractor shall "Provide commitments to meet the established MBE/WBE/SDVOB participation goal(s) as part of bid submittal or submit a good faith effort package displaying sufficient good faith efforts to do so." Typically, MBE/WBE/SDVOB utilization plans and/or good faith effort documentation are often requested from the apparent low bidder within 10 days following bid opening rather than included with the bid submission. Please confirm whether bidders are required to submit MBE/WBE/SDVOB commitment documentation and/or a good faith effort package with their bid.
A: Commitments or good faith effort packages shall be submitted with bids or no later than close of business on August 3rd, 2026.
2. Q: Section 9(i) of the Bid Form states that contractors must include “A tabulation of Subcontractors, Suppliers, and other persons and organizations required to be identified in this Bid (See Section 11 of the Invitation to Bidders)” with their bid proposals. However, Section 11.1 states that the apparent Successful Bidder shall submit this information within five (5) days after bid opening. Please clarify whether subcontractor/supplier tabulations are required with the bid or may be submitted after bid opening pursuant to Section 11.1.
A: Subcontractor/suppliers shall be submitted with bids or no later than close of business on August 3rd, 2026.
3. Q: Section 14 of the Instructions to Bidders and 9(f) of the Bid Form require that we submit a “Disclosure of Lobbying Activities”. After reviewing the documents, I was unable to find this form.
Could you please confirm whether there is a separate Disclosure of Lobbying Activities form that must be completed and submitted? Not required since no federal funds.
A: Not required, as the project is state-funded and does not utilize federal funds.
