EVALUATION FACTORS FOR AWARD
Non-Cost/Price Evaluation Factors
Factor 1 – Technical Solution Factor 2 – Energy and Sustainable Design Factor 3 – Past Performance
Price
Factor 1 – Technical Solution
(i) Solicitation Submittal Requirements:
Provide a narrative describing your understanding and approach to executing the project that meets or exceeds the requirements of the RFP. The narrative shall address the following:
Project site work, storm water management, low impact development (LID), sanitary sewer, water, and landscape
Connections to existing Utilities inside Building 3854: electrical, telecom, fire alarm, fire sprinkler
Open Secret Storage (OSS) features Anti-terrorism/force protection features Building layout and Joint Terminal Attack Control (JTAC) Simulator Building envelope Building systems including foundations, structure, HVAC, telecommunications and electrical.
Narrative shall not exceed six (6) double-sided pages (or 12 single-sided pages). Up to three
(3) conceptual 11” x 17” drawings may be provided to supplement the narrative.
Offeror shall use the conceptual floor, elevation, site, and other plans provided with the RFP as the basis for their design. The Offeror may suggest enhancements/betterments to the base requirements of the RFP if desired. The cost of any proposed betterments must be incorporated into the Offeror’s total proposed price and may not be presented as option items.
(ii) Basis of Evaluation:
The Government will evaluate the narrative and conceptual drawings (if included) considering the extent to which the Offeror demonstrates a clear understanding of the architectural and engineering requirements of the project. The Government will evaluate the Offeror's technical solution to determine adherence to the technical requirements of the RFP.
Factor 2 – Energy and Sustainable Design
Provide the following information, which describes how the project will meet or exceed the following sustainable design contract requirements.
(1) Performance Optimization Narrative:
Using the guidance outlined in Part 3 of this RFP, provide a detailed narrative to describe whether the proposed solution will meet or exceed the goal of a 30% energy reduction using ASHRAE 90.1-2013, Appendix G, Building Performance Rating Method, excluding receptacle and process loads. Provide the proposed percent energy reduction. Provide the assumptions the Offeror will use to obtain a high-performance building, which will comply with these energy reduction goals. Describe the Offeror’s proposed building with regards to building fenestration, solar heat gain coefficients (SHGC), wall and roof insulation values (U-values), HVAC systems, water heating systems, lighting systems, and control systems. Organize/divide the assumptions into three areas; building envelope, mechanical systems, and electrical systems. If the Offeror cannot achieve the 30% reduction within the budget identified, the Offeror shall state what percent energy reduction is proposed within their proposal. Do not exceed two
(2) double-sided pages (or four (4) single-sided pages). Note: Building performance rating and percent energy reduction are calculated in terms of energy rather than energy cost.
(1a) Performance Rating Report:
Provide a Performance Rating Report to demonstrate the percentage improvement in the Proposed Building Performance Rating. Provide a completed Performance Rating Method Compliance Report per the ASHRAE 90.1-2013 User’s Manual. Utilize the default simulation factors and energy rates included in the RFP, Part 6.
The Government will evaluate the Offeror’s response to the Energy and Sustainable Design Factor considering the proposed energy savings.
Performance Optimization Narrative: The Government will evaluate the Offeror’s proposed percent energy reduction relative to energy efficiency goals in Part 3 of this RFP, including evaluation of assumptions.
Performance Rating Report: The Government may evaluate the Performance Rating Report to determine the validity of the design assumptions, thoroughness of the energy simulation, and the percent improvement above the Baseline Building Performance Rating.
Factor 3 – Past Performance
Offerors do not need to provide any information under this factor as the Government will base the evaluation on known past performance on task orders awarded under this Multiple Award Contract (MAC). However, Offerors may provide any information on problems encountered and the corrective actions taken on task orders under this MAC. Offerors may also address any adverse past performance issues under this MAC. Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.
Note: If there is no past performance information available under this MAC, the Government will rely on information from the evaluation for the basic contract award. Offerors do not need to submit additional information.
The degree to which past performance evaluations reviewed by the Government reflect a trend of satisfactory performance.
Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Acceptable.”
Price

(b) Basis of Evaluation: The government will evaluate price based on the lump sum price. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
a. Comparison of proposed prices received in response to the RFP.
b. Comparison of proposed prices with the Independent Government Cost Estimate
(IGCE).
EVALUATION
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award to other than the lowest priced offeror or other than the highest technically rated offeror.
2. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.”
3. The Tradeoff process is selected as appropriate for this acquisition because The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

1.2 GENERAL BID NOTES
a. Award will be made on the total sum of Contract Line Items (CLIN) 0001.
b. The Government reserves the unilateral right to award CLIN 0002 to the Contractor at the proposed price within 120 calendar days after the contract award. Firm fixed price is required for CLIN 0001 and CLIN 0002. No provision is made for economic price adjustment. If Option is exercised within 120 calendar days after the contract award, the contract completion date remains unchanged.
c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR
17.206(b) Evaluation, not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s) to the total price for CLIN 0001.
In accordance with FAR 52.217-5 Evaluation of Options, evaluation of Options will not obligate the Government to exercise the Option(s).
d. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the Base Price, Unit Prices, and Options. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
e. Bonding is required for all CLIN 0001 items. If CLIN 0002 is awarded, adjustment to bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.
1.2.1 PLANNED MODIFICATION BID NOTES
These notes apply to Planned Modification CLINs.
a. The estimated amounts for FF&E, A/V, and ESS have been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E, A/V, and ESS including freight and installation charges. The Government FF&E, A/V, and ESS estimates are only estimated amounts.
b. If awarded, line items will be funded separately after completion of FF&E, A/V, and ESS design package review by the Government, and receipt of appropriate funding by the Government.
Requirements and details are provided in RFP Sections, E20 FURNISHINGS, E10 EQUIPMENT, and D503005 SECURITY SYSTEMS.
c. Bonding is not required for the design, procurement and installation of FF&E, A/V, and ESS equipment.
d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E, A/V, and ESS not to exceed 5 percent. The Contractor will only be evaluated on the HAR rate applied to the Government Estimate. The actual total cost of the awarded planned modification will be the total of the accepted Final design packages for FF&E, A/V, and ESS plus their respective HAR rates included in the CLIN schedule. This fee shall account for administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E, A/V, and ESS. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E, A/V, and ESS. The proposed HAR is a fixed rate.
e. The Government is not obligated to award Planned Modification line items. Should the
Government choose to award a Planned Modification, the line item will be awarded as a negotiated modification to the contract. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E, A/V, and ESS.
f. If awarded, the FF&E, A/V, and ESS modifications will be awarded at least six months prior to the contract completion date. The Contractor's schedule must assume the award of the FF&E, A/V, and ESS as modifications. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award a Modification less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that accepted Final FF&E, A/V, and ESS packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E, A/V, and ESS are not available due to cause outside the Contractor's control or the Government's award of the modification is in the period less than the last six months of the contract.
g. For CLIN 0003: Unit price for providing all work in connection with excavation, handling, storage, sampling, analysis and disposal of petroleum contaminated soil (TPH <500 ppm) at a permitted licensed facility. Sampling shall consist of one composite soil sample (obtained by combining and homogenizing a minimum of three smaller samples from representative sampling points) for each 200 loose cubic yards of material. Soil samples shall be analyzed for Total Petroleum Hydrocarbons (TPH) diesel range and gasoline range organics (DRO & GRO), and Benzene, Toluene, Methylbenzene, and Xylenes (BTEX), plus other analytes required by the treatment/disposal facility. Unit price shall include all work in connection with petroleum contaminated soil removal and disposal and replacement with clean imported structural backfill.
Unit price shall include removal, treatment, and disposal of petroleum contaminated soils encountered within planned excavations at a permitted licensed treatment/disposal facility and backfilling the excavation with compacted clean imported structural backfill. Unit price shall include handling and transportation. The volume of petroleum contaminated soil removed will be based on approved truck scale measurement and the quantity will be approved by the Contracting
Officer. Any work under this CLIN will not proceed without prior written approval and field verification from the Contracting Officer.
1.3.1 Planned Modification-specific Bid Notes
a. FF&E: Design of the FF&E is performed under Base Bid and included in CLIN 0001. Design of the FF&E for Option Item No.1 is included in CLIN 0002. Upon Government approval of the preliminary design and best value analysis, a Best Value Determination (BVD) will be made and will be the rationale for selecting the FF&E vendor(s) for the project. Accordingly, the price(s) provided by the selected vendor(s), using predominately negotiated price schedules from BPA, GSA or other Federal contracts, will be the basis for the actual cost of the Final FF&E Package.
Submit the Final FF&E package, including pricing and vendor selection, not later than nine months prior to building completion.

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
