About this file

This document is a Justification for an Exception to Fair Opportunity (SF 1014) for a firm fixed-price contract to provide software maintenance services for the IRS's SailPoint Identity IQ (IIQ) platform.

The IRS IT Cybersecurity Architecture & Implementation Division requires renewal of an existing maintenance contract for the SailPoint IIQ platform, which supports the agency's Continuous Diagnostics & Mitigation (CDM) program. The justification cites FAR exceptions for brand name requirements and unique/highly specialized services, as SailPoint IIQ is the IRS's chosen COTS solution for identity and access management. The contract will include a 12-month base period and two 12-month option periods. The estimated value is included, and the contracting officer will determine price reasonableness. The agency commits to pursuing competition for future IT purchases where feasible. The associated federal contract opportunity is a solicitation for these SailPoint IIQ maintenance services, to be awarded on a lowest-price technically acceptable basis. The requirement is a total small business set-aside under NAICS code 511210.

Prescribed by Treasury: DTAP 1016.505

1. Identification of the requiring activity and the contracting activity:

The IRS IT Cybersecurity Architecture & Implementation (A&I) Division’s Cybersecurity Solutions Development (CSD) Branch, Service and Product Delivery (SPD) Team requires renewal of an existing software maintenance contract for Brand Name, SailPoint IdentityIQ (IIQ) Platform Modules in support of the Agency’s Continuous Diagnostics & Mitigation (CDM) Program (IRA Strategic Operating Plan Objective 4.4, Initiative 4.4.1 Continuous Diagnostics & Mitigation).

2.a Nature and/or description of the action being approved:

SailPoint IIQ is the Agency’s chosen COTS solution for identity and access management (IAM) capabilities, including the Basic Entitlement Access Request System (BEARS). 4.a Identification of the exception to fair opportunity being used:

FAR 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

FAR 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

FAR 16.505(b)(2)(i)(D) – It is necessary to place an order to satisfy a minimum guarantee.

FAR 16.505(b)(2)(i)(E) – For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

Prescribed by Treasury: DTAP 1016.505

FAR 16.505(a)(4) – The requirement is for an item peculiar to one manufacturer. (i.e., Brand Name specifications) 4.b Supporting rationale:

SailPoint IIQ is the Agency’s chosen COTS solution for identity and access management (IAM) capabilities, including the Basic Entitlement Access Request System (BEARS). The product supports every user of GFE across the enterprise for provisioning and deprovisioning on all systems. The Department of Homeland Security (DHS) and the Department of the Treasury have also adopted Brand Name, SailPoint Technologies, Inc. platforms / products as the COTS solutions of choice for implementation of CDM Program capabilities across federal agencies.

SailPoint Technologies, Inc. is a Cybersecurity Infrastructure Security Agency (CISA) Approved Products List (APL) registered supplier, offering products compliant with cybersecurity supply chain security risk management (C-SCRM) standards. Brand Name, SailPoint products are the Agency’s chosen COTS solution for IAM solutions under the CDM Program and are required for compliance with federal directives and mandates.

5. A determination that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer will determine that the anticipated price(s) will be fair and reasonable in accordance with FAR 16.505 as NASA SEWP V has already determined the prices of supplies and fixed-price services as a Treasury Mandatory Source, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. However, although NASA SEWP V has already negotiated fair and reasonable pricing, ordering activities may seek additional discounts before placing an order.

The Contracting Department performed additional market research. It was determined that a small business set aside is no longer permissible under this NAICS code 541519 under NASA SEWP.

Contract vehicle - the findings of the analyses conducted identified the following contracts could support the Brand Name, SailPoint requirement:

•SAM.GOV

6.a Any other facts supporting this justification:
