About this file
This document is a GRAMA Claim of Business Confidentiality form issued pursuant to Utah Code Section 63G-2-305(1) and (2), for use by companies submitting proposals to the Utah State Board of Education (USBE) in response to the Continuous Improvement Experts Prequalification List solicitation. The form allows vendors to assert claims protecting specific categories of information submitted with their Request for Statements of Qualifications responses, including non-public financial statements, specific employee names and contact information, customer or client lists, and other proprietary information. Vendors may claim business confidentiality protection if the information qualifies as trade secrets under Utah Code Section 13-24-2, or if the information constitutes commercial or non-individual financial information where disclosure could reasonably result in unfair competitive injury or impair the government entity's ability to obtain necessary information in the future, provided the submitting party has a greater interest in prohibiting access than the public has in obtaining it.
The form requires the submitting company to identify which categories of information require protection, provide a concise statement of reasons supporting the claim of business confidentiality, and obtain authorized signatures on behalf of the company. This template enables vendors to comply with Utah's Government Records Access and Management (GRAMA) Act while protecting legitimately confidential business information from public disclosure during the prequalification process for Continuous Improvement Experts serving USBE-designated Elevate and Springboard schools. The claim process ensures transparency in government procurement while preserving vendor confidentiality rights related to proprietary information submitted in competitive bid situations.
