About this file
This is a Florida Trench Safety Act Certification and Disclosure Statement form issued by Hillsborough County, Florida, establishing mandatory compliance requirements for bidders on construction contracts involving trench excavation. The form requires bidders to acknowledge and commit to compliance with the Federal excavation safety standards set forth in 29 CFR Part 1926.650, Subpart P, which serve as Florida's interim state standard until the Department of Labor and Employment Security adopts, updates, or reviews alternative standards. Contractors are responsible for selecting geotechnical data from county sources and other relevant information to design appropriate trench safety systems. Bidders must itemize excavation and trench safety measures in a structured table format, specifying the type of safety measure, quantity, unit of measure (linear feet or square yards), unit cost, and extended cost, with the total disclosed cost matching the amount stated in the contract requirement titled "Florida Trench Safety Act."
The disclosure of trench safety costs does not represent county evaluation of cost adequacy nor does it relieve the contractor of its sole responsibility to comply with applicable safety standards. Contractors are required to expend additional sums at no additional cost to the county, except as otherwise provided in contract documents, to achieve full compliance with trench safety requirements. The county's acceptance of a bid containing this certification does not constitute endorsement of the adequacy of proposed safety measures or costs. This form applies to the Valrico Reclaimed Water Facility Diesel Generator Project, estimated at $4,728,600.00, which includes trench work as part of the installation scope. The project includes a Small Business Enterprise (SBE) subcontractor participation goal of 5%.
