About this file
The document is a Claim of Business Confidentiality Form from Utah, specifically related to the Utah Department of Transportation (UDOT) Region 1 Fence Repair, Replacement and Installation Invitation for Bid (IFB) solicitation number UDOT260088JB. The procurement is seeking a five-year agency contract for fence repair, replacement, and installation services within UDOT Region 1, with the UDOT Procurement Services Division serving as the issuing procurement unit and UDOT Region 1 as the conducting procurement unit.
The form provides a mechanism for bidders to claim confidentiality for certain non-pricing information, with specific restrictions on what can be marked confidential. While pricing/cost proposals cannot be classified as confidential and will be considered public information, bidders can protect trade secrets, specific employee information, customer information, and other sensitive commercial data that meets strict legal definitions of confidentiality under Utah Code Annotated. The solicitation emphasizes that an entire proposal cannot be marked as "PROTECTED", "CONFIDENTIAL", or "PROPRIETARY", and requires detailed justification for any confidentiality claims.
