About this file
This is a Proprietary Information guidelines document from the City of Arlington's Office of Procurement pertaining to an Annual Requirements Contract for Janitorial and Related Services Citywide in Texas. The document establishes the framework for how vendors must identify and protect proprietary information in their submissions to the City. All material submitted becomes public property subject to the Texas Public Information Act upon receipt. Vendors seeking protection of proprietary information must clearly mark each affected page by including the word "PROPRIETARY" in all caps and highlighted in yellow on the bottom center of the page at the time of submittal. The City will endeavor to protect such information from disclosure to the extent allowed by law, though the final determination of what must be disclosed rests with the Texas Attorney General.
The document explicitly states that pricing information may not be marked as proprietary and will be made publicly available in a bid/proposal tab following review of all submittals. By submitting a response, vendors automatically agree that pricing is not proprietary and may be released. Vendors must list each page number believed to contain proprietary information in the provided chart and clearly identify specific sections if only portions of a page warrant protection. Failure to properly identify proprietary information will result in all unmarked sections being deemed non-proprietary and available upon public request.
