About this file
This is a Conflict of Interest Reporting Requirements document issued by the City of Midland, Texas, applicable to vendors responding to the Auctioneer Services RFP (26001106). The document outlines compliance obligations under Texas Local Government Code Title 5, Chapter 176, which governs disclosure of relationships between vendors and local government officers. Vendors who have a business relationship with the City of Midland and meet the definition under Section 176.001(1-a) are required to file Form CIQ (Conflict of Interest Questionnaire) with the City Secretary no later than the 7th business day after becoming aware of facts requiring disclosure. The form must be submitted with the bid or mailed to the City of Midland, Attn: City Secretary, PO Box 1152, Midland, Texas 79702. When no known conflict of interest exists as defined by statute, Form CIQ submission is not necessary; however, the form must be filed if a conflict is subsequently discovered.
Failure to comply with conflict of interest reporting requirements constitutes a Class C Misdemeanor under Texas law. Contracts or purchase orders awarded to vendors that violate this statute are subject to termination without recourse to the City of Midland, and the vendor will be removed from the City's bidders list for a minimum of one year. By submitting a response to this request, vendors represent compliance with Chapter 176 of the Texas Local Government Code. Current information regarding local government officers is available at http://www.midlandtexas.gov/. This requirement was updated to reflect changes made by H.B. 23 of the 84th Legislative Session.
