About this file

This is a Questions and Answers document for federal contract opportunity 19GE5026Q0149 0002 for the US Embassy Beirut, Lebanon.

The solicitation covers multiple line items (CLINs) including night vision devices, thermal imaging devices, drug testing kits, evidence collection kits, and mobile tracking devices. CLIN 0020 requires four image intensifier night vision devices and four thermal imaging devices (total of eight units), all handheld observation devices, not weapon-mounted. These have been split into CLIN 0020A (Night Vision Devices, 4 EA) and CLIN 0020B (Thermal Imaging Devices, 4 EA). CLIN 0017 requires drug testing kits with a minimum of 10 tests per drug type per set. CLIN 0018 requires offerors to propose a standard commercial evidence collection and packaging kit containing every component category specified, with quantities to be proposed by contractors and evaluated under Equipment Compliance criteria. CLIN 0016 involves mobile tracking devices with application licenses and platform subscriptions to be provided by the contractor for five years from Government acceptance, including role-based access, audit logging, and historical track retention.

Delivery, shipping, insurance, and export licensing costs must be included in each CLIN unit price with no separate delivery charges permitted. Delivery is FOB destination Beirut only; consolidation point delivery is not acceptable. INL provides a clearance letter for customs; the ISF clears goods at the port and the supplier delivers to destination. VAT exemptions apply to INL donations to the Host Government, though only Lebanese-registered companies can receive VAT exemption stamps and must pay Lebanese income tax. For CLIN 0020, a DDTC-registered manufacturer or distributor may serve as exporter of record and DSP-5 applicant with another company as prime. The contractor bears sole responsibility for determining export classifications, obtaining all required export licenses and authorizations prior to shipment, and bearing associated costs. Offerors must propose delivery timelines in calendar days from award; failure to obtain export authorization is not grounds for delivery extension.

Questions and Answers

19GE5026Q0149 0002

US Embassy Beirut, Lebanon

Q6. - CLIN 0020. The quantity is 4 EA, but the specification covers both image intensifier night vision and thermal devices. Please confirm the split between the two, and whether these are weapon-mounted sights, as the reference to reticles and zeroing suggests, or handheld or helmet-mounted observation devices.

A6. The requirement is for four (4) image intensifier night vision devices and four (4) thermal imaging devices, for a total of eight (8) units. All eight units are handheld observation devices; none are weapon-mounted. Quantities have been updated in Attachment 1- Rev.2. and CLIN 0020 is revised to include CLIN

0020A, Night Vision Devices, 4 EA, and CLIN 0020B, Thermal Imaging

Devices, 4 EA.

Q7. CLINs 0017 and 0018. Please confirm the minimum contents of one SET, specifically the number of tests per drug type for CLIN 0017 and the quantity of each listed item for CLIN 0018.

A7. For CLINs 0017, one set shall contain 10 tests per drug type.

The Government has not established a fixed bill of materials for CLIN 0018.

Offerors shall propose a standard commercial evidence collection and packaging kit that contains, at minimum, every component category listed in the CLIN 0018 specification, and shall state in Volume II the quantity of each component contained in one (1) SET. Proposed contents will be assessed under the

Equipment Compliance sub-factor in Phase 2.

Q8. CLIN 0016. Should prices include cellular data service and portal subscription, and if so for what period? Will the ISF provide local SIM cards

A8. Local SIM cards and cellular data subscriptions will be provided by the ISF and shall not be included in the quoted price. The application license and/or platform subscription necessary to operate the devices and to provide the secure portal or application required by the CLIN 0016 specification shall be provided by the Contractor and shall be included in the CLIN 0016 unit price for a period of five years from the date of Government acceptance. The license or subscription furnished shall support role-based access, audit logging, and retention of historical tracks, as required by the specification, and the Contractor shall provide the data security information required by Section (vi), paragraph 6.b.

Q9. Delivery pricing. Section II states that prices shall include delivery, shipping and export licensing costs, while Attachment 1 has a separate line, CLIN 23 "Delivery FOB Destination". Should delivery be included in each

CLIN unit price or priced only on that line?

A9. Delivery, shipping, insurance, and export licensing costs shall be included in the unit price of each CLIN. Offerors shall not quote any separate delivery, freight, or export-licensing charge. The separate "Delivery FOB Destination" line has been deleted in Attachment 1- Rev.2.

Q10. Customs and taxes. The consignee is INL at the American Embassy c/o the ISF, while delivery is to the ISF warehouse in Rass Beirut. Who is responsible for Lebanese customs clearance? Will shipments be exempt from

Lebanese duties and VAT, and if so what documentation will INL provide?

Should offerors include Lebanese duties or taxes in their prices

A10. INL provides a clearance letter to the ISF. ISF will clear goods at the port of entry, and the supplier will deliver to the destination.

VAT Language:

• INL donations to the Host Government are VAT exempt; VAT is not applicable.

• (ONLY companies registered in Lebanon can receive VAT exemption stamps from the Government of Lebanon (facilitated by INL). Please note that registered companies are automatically liable to pay income tax in Lebanon.

Q11. Please confirm that, for CLIN 0020, INL will accept a DDTC-registered manufacturer or distributor as the exporter of record and DSP-5 applicant, with another company as prime, as stated in Q&A No. 4.

A11. Confirmed.

Q12. Will INL/Embassy Beirut provide the Government of Lebanon authorization and the signed end-user/non-transfer documentation (e.g., DSP-

83) required for a DSP-5 application to Lebanon under ITAR §126.1(t), and has such authorization already been coordinated for this requirement?

A12. After the goods arrive and a clearance letter for custom clearance will be provided, INL issues a transfer letter to the ISF stating that all equipment at the ISF shall only be used by the ISF and remain accessible to the USG for yearly end use monitoring. Consistent with Section (vi), paragraph 6.c, the quoter is solely responsible for determining the export classification of every item it offers and for identifying, applying for, and obtaining all required export licenses, authorizations, and approvals prior to shipment, and for bearing all associated costs within its quoted unit prices. This includes preparation and submission of any DSP‑5 or other

DDTC application

Q13. Given typical DDTC processing times of 60–120 days or more for

Category XII items to Lebanon, will the Government treat the licensing period as an excusable delay under Section (vi) paragraph 6.e, or alternatively consider a separate delivery schedule for CLIN 0020/0022 (e.g., 180 days after award)?

A13. Offerors shall state a proposed delivery timeline in calendar days from award for each CLIN in Volume I. Failure to obtain authorization is not itself grounds for a delivery extension; See FAR 52.212-4 (f) Excusable Delays.

Q14. The place of delivery is subject to 22 CFR 126.1. State whether this transfer moves under an existing Government authorization or program authority, or whether every export authorization for the controlled line items is the contractor's to obtain prior to shipment.

A14. It will be Contractor’s responsibility.

Q15. Delivery point. Confirm whether the Government will accept delivery

FOB a CONUS consolidation point, with onward movement by the

Government, in lieu of FOB destination Beirut.

A15. No, Deliver only to Beirut.
