These disclosures must be updated promptly to the Contracting Officer during the period of performance upon any new use of AI or significant material change to the existing AI capability, its functionality, its use case, or its data inputs/outputs during the life of the contract.

The Government reserves the right to review the proposed AI use, request additional safeguards or controls, and/or disallow its use if it is deemed inconsistent with agency policy, legal requirements, or federal AI governance standards.

(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;

(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and

(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.

(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

SECTION 4 - EVALUATION FACTORS

FAR 52.212-2 – Evaluation – Commercial Products and Commercial Services (Deviation JAN 2026)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Government intends to establish a single contract award. Quotes that do not conform to the instructions and requirements of the solicitation shall be deemed unacceptable and no further consideration shall be given unless the Contracting Officer determines that requesting revised quotes is deemed advantageous to the Government.

The Government intends to award a contract/purchase order resulting from this solicitation to the lowest priced, technically acceptable offeror/quoter who is a qualified responsible contractor. The evaluation process shall include the following:

a. Compliance Review. The Government will perform a review of quotations received to determine compliance with the instructions and terms of the solicitation. The Government shall reject as unacceptable quotations which do not conform to the solicitation instructions and requirements. This review does not restrict the Government from requesting revised quotations provided under FAR Part 12.

b. Technical Acceptability. Technical acceptability will include a review of past performance and experience as defined in Section 3, along with any required technical information provided by the offeror with its /quote submission.

c. Price Evaluation. The lowest price will be determined by multiplying the offered prices times the estimated quantities in “Prices – Continuation of SF-1449, Block 23”, and arriving at a grand total, including all options. This includes pricing information for potentially exercising the 6-month option to extend services (FAR Clause 52.217-8). The

Government reserves the right to reject price quotes that are unrealistically low or unreasonably high.

d. Responsibility Determination. The Government will determine prospective contractor responsibility by analyzing whether the apparent successful offeror complies with the requirements of FAR Subpart 9.104-1 general standards, including:
