Solicitation #19AQMM18R0428 Reading Room NDA CERTIFICATE OF NONDISCLOSURE FOR HANDLING GOVERNMENT-PROVIDED DATA IN ACCORDANCE WITH THE VISA SUPPORT SERVICES SOLICITATION All individuals involved in the planning, development, and/or review of a response to the Visa Support Services (VSS) solicitation must sign the following nondisclosure statement. This includes any individual who is a member of the prime Offeror as well as any other organization representative or subcontractor who will have access to solicitation materials. Filled out and signed statements (page one only) should be scanned and e-mailed to Joshua Brewer, BrewerJ@state.gov, copy to Kathy Mejia at MejiaKJ@state.gov. Upon receipt of the signed forms, Mr. Brewer will arrange for pick-up by the Offeror of the CD containing the documentation noted in Section C.3.1. of the VSS solicitation.

I acknowledge that I represent an organization that is participating in the solicitation for the Department of State’s (DoS) Visa Support Services (VSS) program. I understand that in responding to the VSS solicitation, I and my organization will have access to materials that are considered sensitive (12 FAM 541 (b) 3, 4 - national security, sources and methods) by the United States Government. I certify that I will not knowingly disclose sensitive information about Consular Affairs systems, processes, procedures, data and/or strategies directly or indirectly to any applicable person other than a person authorized by the Contracting Officer to receive such information. Sensitive information includes the following reading room materials:
· Historical processing statistics for NVC and KCC
· Visa petition information, an explanation of visa symbols, processing requirements for each visa petition category
· Processing manuals
· Basic IV processing flow charts
· CAT-I Ineligibility Refusal Files
Other reading room contents, particularly when combined with the sensitive items listed above, are for official use only in conjunction with the VSS solicitation process. I understand that unauthorized disclosure of such information by me or any other representative of my organization may, at a minimum, result in exclusion of my organization from participation in the VSS solicitation, and may further subject me personally to substantial administrative, civil, and criminal penalties.

12 FAM 541 SCOPE

a. Sensitive but Unclassified (SBU) information is information that is not classified for national security reasons, but that warrants/requires administrative control and protection from public or other unauthorized disclosure for other reasons. SBU should meet one or more of the criteria for exemption from public disclosure under the Freedom of Information Act (FOIA) (which also exempts information protected under other statutes), 5 U.S.C. 552, or should be protected by the Privacy Act, 5 U.S.C. 552a.
b. Types of unclassified information to which SBU is typically applied include all FOIA exempt categories (ref. 5 U.S.C. 552(b)), for example:
(3) Department records pertaining to the issuance or refusal of visas, other permits to enter the United States, and requests for asylum;
(4) Law enforcement information or information regarding ongoing investigations;
