About this file

This memorandum documents the characterization of shoulder soils for the OR140: Klamath County Boat Marina - Lakeshore Drive project. The project will widen OR140 to include 12-foot travel lanes, 6-foot shoulders, and centerline and shoulder rumble strips. It will also realign portions of OR140, install guardrail as needed, construct stone embankments along Upper Klamath Lake to prevent erosion, acquire new right-of-way, and remove the existing asphalt wearing surface on Bridge #18142. Excavation of shoulder soils during this work may generate excess material. According to a 2017 statewide study and 2019 beneficial use determination from the Oregon Department of Environmental Quality, shoulder soils in the project area's Basin and Range physiographic province are substantially clean fill and can be managed as such, though reuse within the right-of-way is preferred given potential minor contaminants from highway use.

Shoulder Soil Waste Characterization Memo OR140: Klamath County Boat Marina – Lakeshore Drive Project (Key #19788)

The purpose of this correspondence is to document the shoulder soil waste characterization for OR140: Klamath County Boat Marina – Lakeshore Drive project. Shoulder soils are defined as soils that extend from the roadway edge of pavement to the right-of-way line and that are not covered by existing impervious surfacing such as paved or concrete sidewalks and parking lots.

Shoulder soils may contain highway-related non-point-source contaminants at concentrations that exceed Oregon Department of Environmental Quality (DEQ) clean fill criteria1. Highway-related contaminants include petroleum hydrocarbons, metals (notably lead), and herbicide residues. Shoulder soils that do not meet clean fill criteria must be managed within operational right-of-way or disposed of off-site as a regulated solid waste.

The proposed construction activities for this project include the following2:

• Widening of OR140 to include 12-foot wide travel lanes, 6-foot shoulders and shoulder and centerline rumble strips.

• Realignment of OR140 and installation of new guardrail where needed.

• Construction of stone embankments with fish enhancements where OR140 adjoins the shore of Upper Klamath Lake to prevent wave erosion.

• Acquisition of new right-of-way (R/W) to establish more consistent R/W widths throughout the project corridor.

• Remove the existing asphalt concrete wearing surface (ACWS) on Bridge #18142, located at MP 58.83.

1 This memo does not address point-source contaminants. Point source contaminants are addressed in the February 8, 2018 Level 1 Corridor Assessment.

2 The scope of work is subject to change because this project is currently under development.

Shoulder Soil Waste Characterization Memo OR140 – Klamath County Boat Marina – Lakeshore Drive March 24, 2020

The proposed construction activities have the potential for generating excess excavated shoulder soils, so characterization of this potential waste is required.

Statewide shoulder soil sampling by ODOT and Cascadia Associates, LLC (Cascadia) provided a basis for defining the lateral and vertical extent of shoulder soil contamination by geographic areas known as physiographic provinces. The 2017 Statewide Highway Shoulder Soil Evaluation Results Report, prepared by Cascadia and dated June 30, 2017, documents this analysis. As a result of this study, ODOT applied for a Beneficial Use Determination from DEQ.

In response to this application, DEQ issued the Highway Shoulder Soil throughout Oregon BUD (BUD-20181204) on July 2, 2019.

This BUD requires a clean fill determination to be performed on shoulder soils in the Basin and Range physiographic province, where the OR140: Klamath County Boat Marina – Lakeshore Drive project is located. However, Cascadia determined through analysis of shoulder soil data that the shoulder soils in the Basin and Range are substantially like clean fill.

Summary and Recommendations Based on the July 2, 2019 DEQ Beneficial Use Determination (BUD-20181204) and the June 30, 2017 Statewide Highway Shoulder Soil Evaluation Results Report prepared by Cascadia, shoulder soils in the Basin and Range Physiographic Province are substantially like clean fill and may be managed as clean fill. In consideration that the shoulder soils may contain some highway-related contaminants, reuse of excess excavated shoulder soils within the right-of-way is encouraged but not required.
