Solicitation No. 1630J6-18-R-00001 Amendment No. 6

1. Pages 35-36 (Section G.3). The cost incentive fee section excludes FAR-required information. FAR 16.405-1, Cost-plus-incentive-fee contracts, states: “This contract type specifies a target cost, a target fee, minimum and maximum fees, and a fee adjustment formula.”

I. The RFP/contract must clearly identify the terms for fee adjustment. Please confirm the following for compliance with the FAR:

a. The total of cost reimbursable CLIN 0003 and similarly in option years is the “Target Cost.” Yes.

b. Average Cost Incentive Fee represents “Target Fee.” Yes.

c. Consistent with other Job Corps contracts, the Fee Adjustment Formula is 50% Government and 50% contractor for budgetary overruns and underruns. Yes.

2. Section G.8. Liquidated damages for invalid days are listed at 20% of the student year cost per day. In typical contracts, this rate is 15% of the student year per day cost.

Additionally, the PRH lists the rate at 15%. Please specify the basis for the increase in the liquidated damages rate. Would the government consider adjusting the rate back to 15%?

The rate will remain at 20% for this solicitation.

3. Revised Pricing Schedule and Response No. 1 on Amendment 4. Revised Pricing

Schedule has grayed out areas for the quantity, unit, and amount under Center Operation/ Type: FFP Sub CLINS which is not consistent with the Pricing Summary Tab of the most recent version of the Attachment J.1.

Furthermore, the response offered does not address the point of the question which mentions that CLINS 1023, 2023, and 3023 do not exist.

These CLINs have been removed.

4. Section G.3.2 and Response No. 18 on Amendment 4. Response indicates that contractors shall propose 1.2% for the cost incentive fee as stated. This is not stated, hence the request for clarification. Also why would contractors propose 1.2% when it does not represent the minimum, average, or maximum amount of the cost incentive fee?

It appears the response may have been incorrectly referring to the performance incentive fee which was not the subject of the question. Please clarify.

Offerors shall propose the average fee of 1.2%.

The response “invoicing has not changed’ is ambiguous as billing for cost incentive fee has indeed been different across various Job Corps contracts. Please indicate the amount of cost incentive fee that is billable.

The billable amount of cost incentive fee is 1.2%.

5. Attachment J.1. Based on response #6 and #17 of Amendment 4 the technical performance incentive fee is not applicable to OA and CTS.

According to FAR 16.202-1 cost incentive fees are not applicable to Firm-Fixed-Price contracts. This implies that the cost incentive fee would also not be applicable to the OA and CTS components of the contract since they are firm-fixed-price.

Solicitation No. 1630J6-18-R-00001 Amendment No. 6

Since the incentive fees are not applicable to OA and CTS, consider removing the OA and CTS incentive fee tables on the DFP & Incentive Fees tab of Attachment J.1.

These tables should be left empty if they do not apply to this solicitation.
