Response: No, it is not available in excel format.

8) Attachment 11, Non SCA Exempt Incumbent Employees Length of Service lists employee classifications including labor classifications, i.e. Electronic II, Millwright Lead II, QC Inspector, and General III/PM Admin. These classifications are not found on page 14 of the CBA identifying the rate of pay. Please clarify if all of the labor classifications identified in Attachment 11 are included in the CBA.

Response: The length of service list of employees was provided by the incumbent contractor. All labor classifications should be included in the CBA.

9) Per Appendix VIII, Performance Requirements Summary, the Performance Standards are 100%. This is perfect performance with no room for deviation. Please clarify that the PRS requirements are 100%.

Response: The performance standards will change to 95%.

10) Per PWS, Paragraph 1.9, Page 18, Supervisory/Key Personnel and Lead Craftsmen. Can the Government please provide a list of key supervisory positions and requirements for these positions?

Response: Reference Section L-5 of the RFP; Part II – Technical Proposal. Offers are to submit their proposed team structure…etc. The PWS scope of work has changed; thus the existing structure does not relate.

11) Section M, Page 54 of 56, Evaluation Criteria, Sub-Factor A. This requires the evaluator to evaluate the experience and qualifications of key personnel and lead craftsmen in accordance with Paragraph 1.9 of the PWS. “SP Personnel shall submit evidence to the Contracting Officer and COR that personnel meet the qualifications for their respective tasks under this contract and have or have applied for the proper certification(s) and license(s) required by the State of Arkansas or other requiring authorities. This information shall be provided to the Contracting Officer at the Proposal/Solicitation Phase and shall be updated annually thereafter for the life of the contract”. Presidential Executive Order 13495, Non-Displacement of Qualified Workers, requires the SP to offer available positions to the incumbent personnel. The SP may offer key positions of at risk employees, such as the PM and other personnel not included in the CBA. The Quality Control Inspector, Lead Craftsmen, Stock Clerks, and administration personnel along with all of the craftsmen requiring licenses are in the CBA. It is impossible for anyone

16-223-SOL-00006 Amendment 3 3 of 14 other than the incumbent to have these resumes and licenses. Please review the evaluation criteria and revise so that other offerors can meet these requirements.

Response: SCA covered employees information may be obtained from the Union. The right of first refusal of employment applies to positions in which they are qualified. For Non-SCA covered employees the nondisplacement policy does not apply. As for non- CBA/SCA key personnel, any offeror has the ability to utilize public media (local newspapers, radio, television) to seek resumes, hold a job fair, etc.; we will not amend the solicitation to accommodate an offeror who hasn’t/won’t exercise due diligence in this regard.

12) Per Appendix IX Maintenance History. Can Government please provide a list of hours by Craft?

Response: Yes; see attached lists (attachment 2) there are 15 individual .pdf’s

13) Solicitation, F. Government Vehicles. Contractor personnel will operate a limited number of Government furnished automotive, materials handling, and miscellaneous equipment while performing work under the contract, reference Section 1.2.7 of Attachment J-1, PWS and appendices thereto, as identified in Section J- List of Attachments to this contract.

PWS 1.2.7, GSA Fleet Vehicles. SP to provide whatever work vehicles needed for this Firm/Fixed Price contract. There will be no GSA vehicles provided to the SP.

Question: Based on our understanding of the PWS and from comments provided during the pre-proposal conference, the contractor is responsible for providing work vehicles needed for the contract. Can you identify the number and type of vehicles currently being utilized by the contractor to accomplish the current contract tasks?

Response: Reference Section L-5 of the RFP; Part II – Technical Proposal. Offers are to submit their proposed team structure…etc. The scope of work of the PWS has changed;

thus the existing structure does not relate. This can be accomplished so many ways and different staff structures. An SP can propose any structure that can accomplish the requirements of the PWS.

14) Solicitation, C. Technical Proposal Instructions. Provide resumes for Supervisory/Key Personnel and Lead Craftsmen listed.

16-223-SOL-00006 Amendment 3 4 of 14

PWS 1.9 SP Personnel Requirements, a. Key personnel shall have experience in maintenance of complex industrial facilities and in the operation of utility systems of the type used at the JLC.

Question: We believe a comprehensive understanding and experience of JLC facilities and equipment are a significant factor in determining appropriate key personnel, in addition to having overall experience in industrial facilities and utility systems utilized elsewhere. Because we do not have access to incumbent personnel serving in key roles, can we propose resumes that define the experience and qualifications necessary to serve as key personnel without providing specific names of individuals?

Response: No. SCA covered employees information may be obtained from the Union.

The right of first refusal of employment applies to positions in which they are qualified.

For Non-SCA covered employees the non-displacement policy does not apply. As for non-CBA/SCA key personnel, any offeror has the ability to utilize public media (local newspapers, radio, television) to seek resumes, hold a job fair, etc.; we will not amend the solicitation to accommodate an offeror who hasn’t/won’t exercise due diligence in this regard.

15) Solicitation, H-13. Statutory and actual damages. The Contractor shall additionally be liable for damages incurred by the Government as a result of the Contractor’s none or defective performance.

PWS 8.1 Waste water plant and sewage systems. The SP shall operate and maintain all sewage, wastewater, and industrial wastewater collection systems and treatment facilities.

Question: Is there a documented environmental baseline study available that identifies prior or existing soil and/or groundwater contamination resulting from waste water and/or sewage spills or contamination to prevent any liability from existing damages incurred?

Response: There are no spills or contamination. The site is clean. All spills have been handled per the JLC Spill prevention plan. A baseline study does not exist.

16) Question: Has clause H-13 been used in the past to recoup damages on the current or previous contracts. If, so can the government provide a history of the damages that have been sought?

Response: No damages have been assessed in the past.

16-223-SOL-00006 Amendment 3 5 of 14

17) PWS 16.1 Environmental Monitoring and Control Systems (EMCS) The SP shall monitor, operate, and maintain the environmental monitoring and control systems 24 hours per day (Monday through Sunday) and respond to alarms, equipment failures, failed points, in accordance with established standard operating procedures.

PWS 16.2 Requirements. The SP shall provide an Option price for an “EMCS Coordinator”. It is the intent of this Option# 2 to always have the EMCS Center occupied with two (2) full time operators during normal working hours of 8:00 AM thru 4:30 PM.

Appendix I: Definitions. Critical Environmental Conditions. These are Priority 1 conditions, monitored by an Environmental Monitoring and Control System (EMCS).

Maintenance personnel must be on-site continuously to maintain critical environmental conditions.

Environmental Monitoring and Control System (EMCS). SP personnel operate this system 24 hours a day 7 days a week.

Question: The areas of the PWS describing EMCS operators indicate this must be a 24/7 staffed position; however, the pricing option in PWS 16.2 indicates the intent is to always have the EMCS Center occupied with two (2) full time operators during normal working hours of 8:00 AM thru 4:30 PM. Please clarify the actual staffing requirement for the EMCS operator(s).

Response: The PWS requires one EMCS operator 24/7; the option #2 will provide the second EMCS operator during normal working hours of 8:00 AM – 4:30 PM. Thus there will be two operators during normal working hours.

18) Solicitation, B. Business Proposal Instructions, 2.c. Cost or pricing data, I. Direct Labor.

All estimated overtime shall be identified as such and added to the fixed-price portion of the contract pricing schedule.

PWS 1.2 General Statement of Work. Some repairs or maintenance may be necessary after normal duty hours. In that event any overtime expense resulting from such work will not be reimbursed by the government it is considered to be part of the firm-fixed – price contract.

Question: The solicitation does not provide information or historical data on the number of after normal duty hours in which repairs or maintenance has been necessary due to research activities. Will you provide an estimate based on historical data or fixed number of hours of overtime in order for us to provide a reasonable estimate of overtime that is required to be calculated into the fixed-price effort?

16-223-SOL-00006 Amendment 3 6 of 14

Response: This is a research and animal care facility, include an estimated amount of time based on your experience. In the past it has ranged between 300-600 hours per year.

19) Solicitation, G7-A. The Contractor shall provide all Contractor-specific administrative supplies (e.g., letterhead paper), cafeteria disposables, materials/chemicals, vehicles for movement of Contractor personnel as needed, etc., equipment for grounds maintenance, and gasoline and diesel fuel required for the successful accomplishment of the requirements of the PWS.

Question: Are mowing, edging and all other lawn services and equipment provided by the subcontractor TruGreen?

Response: No, TruGreen provides fertilizer.

20) The current CBA expires on October 31, 2018. Will the SP be allowed to submit a Request for Equitable Adjustment for any increases for a newly negotiated CBA at that time, or should we include a percentage of escalation in our pricing after the expiration date of the CBA?

Response: Any increase or decrease in the wage rate or fringe benefit shall be handled in accordance with the FAR Clause 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (Multiple Year and Option Contracts).

Employee wages and fringe benefits for those not covered by the SCA shall be escalated for all option periods. There will be no increase in price for labor or fringe benefits for non-SCA covered employees which are not identified in the business/price proposal.

21) Per Section B-6, Total Estimate Contract/Price Costs. For Items C. - $300,000 and D. - $250,000, are these amounts each year of the contract, or for the entire contract period?

Response: these are estimates for the entire contract period.

16-223-SOL-00006 Amendment 3 7 of 14

23) In Appendix II, Description of Facility, Building 16 and Building 17 state there are no automated fire alarm systems in these locations but page 166 list the various detectors, modules, stations, etc… Could the government please verify which is correct?

Response: Build 16 & 17 has fire extinguishers only.

24) Buildings 14A, 14B, and 14C detail in the Description of Facility that the fire alarm systems are being upgraded but page 165 details various detectors, modules, stations, etc. Will the SP be responsible for this upgrade and will the government indicate the time line on when this should be added for testing/inspection?

Response: Building 14 is being completely renovated; see the new floor plan attached (attachment 3). Yes the SP will be responsible for Building 14 as it comes online per the

PWS.

Project occupancy dates.

Building 14 Phase One: May 2017 Building 14 Phase Two: September 2018

25) Building 10 indicates an old system and an upgrade in the future. Page 162 shows information as unavailable. When will the new system be added for testing/inspection?

Will the SP be responsible for this upgrade?

Response: Building 10 is being renovated; see the new floor plan attached (attachment 3). Yes the SP will be responsible for Building 10 as it comes online per the PWS.

Building 5A, 53, 50/MRI are also in the process of being renovated, see attachment 3 for new floor of these buildings as well.

Project occupancy dates:

Building 14 Phase One: May 2017 Building 14 Phase Two: September 2018 Building 53A Phase One: July, 2017 Building 53A Phase Two: September, 2018 Building 62 MRI: December 2016 Building 10: September 2016 Building 5A: January 2017

16-223-SOL-00006 Amendment 3 8 of 14

26) What type of system does the cafeteria kitchen maintain for fire protection or fire suppression?

Response: The existing system does comply with all of the requirements of NFPA No. 96, No. 17 & 17A. The suppression system is a dry type. It only covers the main exhaust canopy in the kitchen.

27) Building 51 Description of Facility lists no Fire Alarm System other than extinguishers but Building 51 has a description of types and units used, which is correct?

Response: Build 51 has a Siemens Fire Alarm system.

28) Is the new Work Management System currently being utilized as an inventory tracker or is another system currently in use?

Response: No, the existing inventory system is MCIS.

29) Does the current, existing Work Management System have the capability of providing reports for out of service equipment and detailing the parts required, PO numbers, anticipated dates of repair?

Response: Yes.

30) In order to provide accurate pricing, can the government provide dates of previous service for the fire extinguishers on-site? Per requirements, internal maintenance is required every 6 years and hydrostatic testing every 12 years.

Response: 394 fire extinguishers were hydrostatically tested in 2012, 158 were hydrostatically tested in 2013, 27 were hydrostatically tested in 2014 and 4 were hydrostatically tested in 2015.

31) How many fire extinguishers have been replaced in the previous five year period?

Response: ~ 150 fire extinguishers have been replaced in the past 5 years. The contractor will be responsible to replace up to 30 fire extinguishers per fiscal year (October-September). The government will be responsible for replacement for anything above 30 in a fiscal year (October through September).

32) Page 26, (a) Staffing plan states: “All staff is considered critical thus the SP must maintain established levels through temporary hires as needed. When a staff position is vacant for two or more weeks; temporary hires will be required continuously until

16-223-SOL-00006 Amendment 3 9 of 14 position is filled”. A number of items must be completed to hire employees even on a temporary basis at the JLC such as: Level 1 clearance takes on average one week for fingerprint results to come back and another two weeks for the background checks to be completed. Physicals, drug testing, TB testing, measles testing, respirator fit test for access to animal areas. The hire dates of the Collective Bargaining Unit employees were provided by the government which indicates a number of employees have in excess of 160 hours of vacation time. If all of this time is used concurrently this would exceed the two week replacement criteria set-forth by the government. This requirement appears to be unrealistic given the pre-employment requirements set-forth by the government.

Will the government consider changing this requirement to 8 weeks?

Response: The notion of this requirement is to be sure the staff is adequate; this is to prevent work not being completed because there was no one to do the work. Only basic clearance by Safety will be required for these temporary workers. They will NOT be granted full clearance to the Facility. The idea is these temporary workers can work in other areas to maintain schedules. This also applies to Long Term Disability (LTD) & Short Term Disability (STD). If the Contractor fails to provide temporary staff or adequately adjust staff to handle situations as this and work is not being done this will be considered during the option exercise period and for past performance evaluations.

It is the Contractor’s responsibility to perform the work and the Government will not delay work for staffing issues with the Contractor.

33) Page 44 of the PWS, Testing, Balancing and Adjusting (TBA) indicates 100% real time QC inspections on all animal room calibrations and laboratory integrity TBA functions yet the QC section does not indicate laboratory integrity at 100%, should the SP included lab integrity QC at 100% in their plan/proposal?

Response: Yes, add laboratory integrity at 100%.

34) The PWS states that buildings 10, 14A, 05B and 05C are currently on the Trane Tracer Summit System but will be phased over with the Siemens Insight BAS, could the government provide the projected timeline of when these changes will occur? Will the successful contractor be responsible for these systems after these changes occur?

Response: The current timeline is unknown. The contractor shall be responsible for the systems either existing or new.

35) Page 50 of the PWS, Could the government provide a timeline that the Johnson Controls Metasys System will be phased over to the Siemens Insight BAS?

Response: Approximately October 2017.

16-223-SOL-00006 Amendment 3 10 of 14

36) PWS 17 states the SP is responsible for the scheduled cleaning of all occupied areas of the JLC but Appendix VI list excluded areas, can the government please clarify?

Response: Janitorial Services are required in accordance with the entire PWS; thus there are exceptions, also reference Section 15 House Keeping services.

37) PWS 17 (17.4) indicates exterior windows; above 7’ shall be cleaned annually, is this intended for all buildings on the JLC?

Response: yes, entire JLC campus.

38) The Appendix XIII Vending Machine Document shows both Gross and Net Sales on the heading but only one column for each month is provided, is this the Gross Sales or Net Sales amount?

Response: See attachment 4 Vending Sales CAFÉ.

39) PWS 18.1 list Automatic Vending of Arkansas as the vending machine provider but Appendix XIII Vending Machines indicates Compass Group as the vending company, could the government provide which vending company is currently used?

Response: Automatic Vending of Arkansas.

40) Page 56,, 18.1 General, Does the government consider pots, pans, plates, bowls, forks, spoons, knives, trays, etc., disposable items? Will the government be responsible for the replacement of utensils such as forks, knives, spoons etc., that the customers do not return?

Response: Yes, the Contractor/SP will be responsible for all pots, pans, plates, bowls, forks, spoons, knives, napkins, trays etc., plus all other disposables. “Note: The Jefferson Laboratories Complex shall furnish the space, utilities, and equipment (only) for this service but will repair and or replace such equipment at its discretion.”

41) Appendix VIII Performance Requirements Summary states 50% of these work requirements shall be completed within one work day of receipt….. however, PWS Section 2.4 Routine Maintenance Requests states in bold print 50% of Priority 3 RMR work requests shall be completed within one work day of receipt…. Can the government clarify which performance standard is correct?

Response: RMR to be 50% of “Priority 3”; PWS will be coordinated.

16-223-SOL-00006 Amendment 3 11 of 14

42) Page 18, 1.8 Equipment additions, deletions, change Procedures. How is the SP expected to anticipate such changes? Will the government issued modifications to the contract for additions and deletions of equipment during the contract period?

Response: Almost always an addition has a deletion and thus only the procedure may change; it is a balance. New Equipment is often trouble free; thus less work. If we were to add a building to the overall foot print or make a significant add; then the Government would consider an equitable adjustment and yes issue modification.

Additions and deletions in general will not include a modification.

43) It is understood the Service Provider will subcontract various services to maintain the equipment at the JLC. However, in the event of a major equipment failure what is the repair limits the Service Provider will be responsible for? Such as roof repairs, elevator repairs, generator repairs, air compressor repairs, fire alarm repairs, etc.?

Response: Reference Section 2.2.

44) Appendix V: Sub-Contracted Services, page 70, identifies services subcontracted by the current SP. Does the current SP also subcontract the following services?

• Outside window cleaning

• Variable frequency drives

• Emergency generator repairs

• Emergency generator annual load testing

• Chlorine gas, salt and caustic flake supplies

• Cathodic protection

• Air compressor repairs

• Glass replacement

• Fan balancing

• Shrub and tree replacement

Response: Yes; Outside window cleaning, Variable frequency drives, Emergency generator repairs, Emergency generator annual load testing, Chlorine gas, salt and caustic flake supplies, Cathodic protection, Air compressor repairs, Glass replacement, Fan balancing, Shrub and tree replacement.

45) Section 17, Janitorial Services, Paragraph 17.5, Floor Mats states “The SP shall provide for the floor mat service at buildings: 21 (5/10 mats), 54-200 (2/4 mats), 50 (2/4 mats).

All floor mats for buildings 21 and 50 shall bear the FDA Logo. Can the Government please provide the number of mats required?

Response: 18 floor mats total.

16-223-SOL-00006 Amendment 3 12 of 14

46) Section L, L-5,D. Recent and Relevant Past Performance Instructions states: “Offerors Past Performance proposal shall consist of a copy of each Client Letter and Past Performance Questionnaire (with the “Contract Identification” information set forth in Paragraph 1 of the questionnaire completed) sent by the offeror to the client.” Is it acceptable to add only the portion of the Past Performance Questionnaire completed by offeror in the proposal? Most of the pages of the questionnaire are to be completed by our client which we will not have access to provide in proposal.

Response: yes this is acceptable to include only Section 1 Contract Identification portion.

47) What is the contact information for the Jefferson Facilities Maintenance Union?

Response: Jason Baugh, President Jefferson Facilities Maintenance Union Phone: 501-765-5323 Email: baugh.jason@yahoo.com

48) Can we get a list of current employees certifications and licenses, i.e., fire, HVAC, backflows?

Response: This can be obtained from the Union.

49) In reference to Section L., Paragraph L-5 (B) Business Proposal Instructions, Sections A through K are to be included. Do you also want a complete copy of the Attachments J-1 through J-11 included in the Business Proposal also?

Response: No, we do not need a complete copy of the attachments referenced in Section J.

50) I am writing to respectfully request, per CFR 51, FAR 8.7, FAR 52.208-9, CFR 48, and JWOD Act 41 USC 48, you update your solicitation to insert this clause into your current listings as it is important for all potential bidders for the your contract to understand that in performance of their contract requirements, the procurement of certain mandatory source Procurement List items will be required.
