ARTICLE 5; CONSIDERATION OF BIDS
5.3 Add the following subparagraphs:
5.3.1.1 The contract will be awarded to the lowest responsive and responsible Bidder who, in the opinion of the OWNER, is best qualified to perform the work. OWNER reserves the right to reject any or all Bids, including without limitation the right to reject any or all nonconforming, non-responsive, unbalanced or conditional Bids, and to reject the Bid of any Bidder if OWNER reasonably believes that it would not be in the best interest of the OWNER to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified, of doubtful financial ability or fails to meet any other pertinent standard or criteria established by OWNER. OWNER reserves the right to negotiate contract terms with the successful Bidder and to waive any and all informalities not involving price, time, or changes in the work. In determining whether an award to a Bidder is in the best interest of the OWNER, the West Ada School District may consider factors including, but not limited to, responsiveness of the Bid, whether Bidder is unqualified or of doubtful financial ability, Bidder’s dependability, skill, judgment, integrity and trustworthiness, or any other pertinent standard or criteria.
5.3.1.2 In evaluating Bids, OWNER will consider the qualifications of Bidders as described in
Article 6.1.2 and Article 6.1.3, whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices, and other data, as may be requested in the Bid Form or prior to the Notice of Award.
SIB2
SIB3
5.3.1.3 OWNER may consider the qualifications and experience of Subcontractors, Suppliers, and other persons and organizations proposed for those portions of the Work for which the identity was required. OWNER also may consider the operation costs, maintenance requirements, performance data, and guarantees of major items of materials and equipment proposed for incorporation in the Work when such data are required to be submitted prior to Notice of Award.
5.3.1.4 OWNER may conduct such investigations as OWNER deems necessary to assist in
Bid evaluation and to establish responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, and other persons and organizations to execute Work in accordance with the Bidding Documents to OWNERS’ satisfaction.
5.3.1.5 Nothing indicated herein will prejudice OWNERS’ right to seek additional pertinent information as is provided in Article Six.
5.3.3 PUBLIC WORKS CONTRACTORS LICENSE
5.3.3.1 This Public Works project is not financed in whole or in part by Federal Aid Funds. Bid
Proposals will be accepted from those contractors only (prime contractors, subcontractors, and/or specialty contractors) who, prior to the bid opening, hold current licenses as public works contractors and contractors’ registration in the State of Idaho.
5.3.4 EMPLOYMENT PRACTICES
5.3.4.1 Pursuant to Sections 44-1001 and 44-1002, Idaho Code, it is provided that each
Contractor “must employ ninety-five percent (95%) bona fide Idaho residents as employees on any such contract except for procurement authorized in Section 67-2808 (2), Idaho Code, or where under such contracts fifty (50) or less persons are employed the contractor may employ ten percent (10%) non-residents, provided, however, in all cases employers must give preference to the employment of bona fide residents in the performance of said work, and no contract shall be let to any person, firm, association, or corporation refusing to execute an agreement with the above mentioned provisions in it.”
5.3.5 NAMING OF SUBCONTRACTORS (IF APPLICABLE FOR INDIVIDUAL BID
PACKAGES)
5.3.5.1 Section 67-2310, Idaho Code, the name of the subcontractors who perform the plumbing, heating and air conditioning and electrical work. Failure to name subcontractors as required by this section shall render any bid submitted unresponsive and void. Subcontractors named in accordance with the provisions of this section must possess an appropriate license or certificate of competency issued by the State of Idaho covering the contractor work classification in which the subcontractor is named.
The Owner interprets this law to mean three separate areas of Work, 1) plumbing work, 2) heating and air conditioning work and 3) electrical work. The Owner also interprets this to mean the entity that will perform the Work at the site, regardless of contractual relationship whether a subcontractor, a sub-subcontractor, or the prime contractor submitting the bid.
With regard to possessing an appropriate license or certificate of competency, all subcontractors must have at the time of the bid opening a current license in the appropriate category (class, type and specialty category) as issued by the Public Works Contractors State License Board. In addition, plumbing and electrical subcontractors shall have at the time of the bid opening, a valid plumbing contractor’s license or electrical contractor's license, respectively, as issued by the Idaho Department of Labor and Industrial Services.
SIB3
SIB4
In determining if the above listed subcontractors are required on the project, the Owner will refer to the plans and specifications. If doubt exists in determining if the above listed subcontractors are required on the project, the Architect who prepared the plans and specifications will be requested to make the determination. If plumbing, heating and air conditioning or electrical work is not shown in the plans and specifications but is discovered by the bidder subsequent to the date of bid opening, then the bidder must request clarification from the Architect/Engineer. Absent such clarifications, work will be considered incidental and naming of a subcontractor will not be required.
5.3.5.2 Pursuant to Idaho State Fire Marshall Fire Sprinkler Regulations No. G.2 (49), the license numbers of the subcontractor who will perform the Work must be listed on the Bid Proposal Form.
5.3.6 IDAHO DOMICILED CONTRACTORS
5.3.6.1 Section 67-2348, Idaho Code, requires the Division of Public Works to apply a preference in determining which contractor submitted the lowest responsible bid. If the contractor who submitted the lowest dollar bid is domiciled in a state which has preference law which penalizes Idaho domiciled contractors then the Division of Public Works must apply preference. The preference that will be applied is the preference law of the domiciliary state of the contractor who submitted the lowest dollar bid.
Generally speaking, a contractor's domiciliary state is the state in which the contractor’s home office is located. If federal funds are involved in the project, then no preference will be used.
ARTICLE 6; POST BID INFORMATION
6.1 6.1.1
6.1.2

OWNER reserves the right to seek additional information as provided in Article 5.3 as a basis for awarding this contract.
In Article 6, paragraph 6.3.3 delete "may, at the Bidder's option, withdraw the Bid or submit" and substitute "shall submit". In the last sentence, delete "either withdrawal or".

SIB4
SIB5
Should the contractor elect to furnish both bonds separately, any claimant may file against either bond or both to the limit of each. Should claims against either type of bond exceed the limit of the bond, the other bond shall be considered supplementary to it to provide coverage to 100% of the contract amount.
In Article 7, paragraph 7.2.1, delete "The Bidder shall deliver the required bonds to the Owner no later than three days following the date of execution of the Contract." and replace with, "The Bidder shall deliver the required bonds to the Construction Manager not later than five (5) days following receipt of properly prepared Agreement between Owner and Contractor".
