SUBJECT: DUTY TO WARN AND MANDATED REPORTS
DATE: 08/08/23

PURPOSE: To provide direction and guidance on duty to warn and mandated reports for the Military OneSource Program. The contractor is responsible for ensuring Military OneSource staff and network providers adhere to the duty to warn and mandated reports policies and procedures.
POLICY: The contractor shall implement, document, and maintain duty to warn procedures, in accordance with DoD/Military Branch of Service and Component regulations and established protocols, to address events wherein a Service or family member reveals a duty to warn situation, or a threat to self or others.
For all duty to warn and mandated report situations, including but not limited to, suicidal thoughts or intent, a desire to harm oneself, domestic violence, child abuse or neglect, violence against any person, and any present or future illegal activity, a report shall be completed in accordance with established military, state, and federal requirements, and regulations.
Notifications of Duty to Warn and Mandated report situations shall be provided to the appropriate authorities immediately.

PROCEDURE:
All duty to warn and mandated report situations will receive supervisory consultation and oversight.
Reports for child abuse and neglect must be made to local child protection services, the Family Advocacy Program, or the designated military and civilian authorities.
Reports of domestic abuse and domestic violence must be reported to the Family Advocacy Program in accordance with DODI 6400.06.
Alleged victims of domestic abuse and domestic violence requesting restricted reporting must be referred to Domestic Abusive Victim Advocate (DAVA), DAVA supervisor, a FAP clinical provider or healthcare provider in accordance with DoD policy and guidance.
Reports of sexual assault must be made to the Sexual Assault Response Coordinator in accordance with DoDI 6495.02.
Threats of harm to self or others must be reported to the designated military or civilian authorities.
Duty to warn and mandated report monthly logs shall be compiled and sent to the Government Military OneSource Program Office. This report log shall include, at a minimum: date of event, classification (DTW-Duty to Warn or MR-Mandated report), installation name, state, name of the unit, status (new vs. recurring), category (e.g., domestic violence, child abuse, harm to self/others, etc.), branch/component of service, summary of events, action taken and any other pertinent information. This report log shall not include any personally identifiable information.
EXCEPTIONS: There are no exceptions to this policy without Government Military OneSource Program Office written approval.
