FAR 52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES

(a) The Government will award a contract resulting from this solicitation to the responsible vendor whose quotation, conforming to the solicitation, will be most advantageous to the Government, considering price and other factors in accordance with FAR 13.106-2(b)(3).

The following evaluation factors shall be used:

1. Technical Capability (Compliance with the Statement of Work)

2. Energy Efficiency and Environmental Characteristics

3. Price

4. Past Performance

When combined, non-price factors (Technical Capability and Energy Efficiency/Environmental Characteristics) are equal in importance to price. Past Performance will be evaluated on an acceptable/unacceptable basis.

Vendors shall acknowledge receipt of Amendment 0002 with their revised quotation. Failure to acknowledge all amendments may render a quotation ineligible for award.

Evaluation Process

Step 1 – Acceptability Review All quotations will be evaluated to determine acceptability and completeness.

Quotations that fail to provide the required technical supporting documentation identified in the solicitation may be determined technically unacceptable and eliminated from further consideration.

The Government reserves the right to determine whether a quotation contains sufficient information to evaluate compliance with the solicitation requirements.

Step 2 – Price Ranking All acceptable quotations will be ranked in ascending order from lowest to highest Total Evaluated Price (TEP).

*** Price ranking is used for evaluation efficiency only and does not imply that price is more important than non-price factors.

Step 3 – Technical Evaluation (Conformance) The Government will evaluate quotations to determine the extent to which the quoted product complies with the Statement of Work and technical requirements.

The Government will evaluate quotations based on the technical information and supporting manufacturer documentation submitted with the quotation.

For evaluation efficiency, the Government may begin evaluation with the lowest-priced quotation; however, the Government may evaluate any or all quotations as necessary to determine the best value, considering all evaluation factors.

Step 4 – Energy Efficiency and Environmental Evaluation The Government will evaluate the proposed chiller’s energy efficiency, compliance with applicable Federal Energy Management Program (FEMP) requirements, and environmental characteristics, including refrigerant type and environmental impact.

Step 5 – Past Performance Evaluation Past performance will be evaluated to determine whether the vendor’s performance is acceptable in accordance with FAR 13.106-2(b)(3).

The Government may evaluate past performance for one or more vendors as necessary to support the best-value determination.

Step 6 – Best-Value Determination The Government will make a best-value determination based on:

• Technical Capability (Compliance with the Statement of Work)

• Energy efficiency and environmental considerations

• Acceptable past performance

• Determination that the price is fair and reasonable

No single factor is determinative; the Government will consider the combined value of all factors.

The Government intends to award without discussions but reserves the right to conduct discussions if determined necessary.

(b) A written notice of award or acceptance of a quotation, mailed or otherwise furnished to the successful vendor within the time specified for acceptance, shall result in a binding contract without further action by either party. The Government may accept a quotation (or part of a quotation) prior to its expiration unless a written notice of withdrawal is received before award.
