(ix) FAR provision 52.212-2, Evaluation Commercial Products and Commercial Services (Nov
(a) The Government will award a fixed-price contract, resulting from this RFQ, to the responsible vendor whose quote provides the best benefit to the Government, price and other factors considered. A comparative evaluation will be performed in accordance with FAR 13.106-2(b)(3). Quotes will be evaluated by performing a direct comparison of one quote to another in a uniform manner to determine which quote provides the government’s need as identified in the RFQ. Each quote shall be evaluated based Technical Capability (meeting minimum specifications), Past Performance and Price.
1. Past Performance The Government will evaluate the past performance of the prime contractor and any proposed subcontractors that will perform significant portions of the work. The evaluation will consider the recency, relevance, and quality of past efforts as it relates to the requirements of this RFQ. Information may be obtained from the references provided in the quote, as well as other sources available to the Government, including CPARS and other databases.
2. Price Price will be evaluated for reasonableness in relation to the technical capability and past performance.
Price may not be the determining factor if a higher-priced quote is determined to provide the best value to the Government when compared against other quotes.
The Government reserves the right to consider information obtained from sources other than those provided by the offeror, including past contract files, government databases, and/or contractor performance reports. No formal rating system will be applied; instead, the Government will make a best-suited selection based on the comparative merits of each quote.
At a minimum, quotes must meet the specifications stated in paragraph (vi) above. Quotes may exceed the government’s need and the government reserves the right to consider such quotes. However, the government is not required to select a quote that exceeds the minimum need but does have the discretion to accept other than the lowest price quote, provided the quote offers additional benefit to the government.
NOTE: An Offeror without relevant experience, or for whom information on past performance is not available, will be given a Neutral rating, and will not be evaluated favorably or unfavorably. This rating is neither negative or positive. Neutral is merely indicative of a lack of prior performance.
(1) NAICS Check: Offeror is self-certified as a small business under the NAICS 333310. The Government will verify this information in SAM.gov.
(2) Price: Offeror completed and submitted their pricing on SF 1449. Should only one (1) Offeror be determined technically acceptable, price evaluation techniques found in FAR 13.106-3(a) will be used to determine a fair and reasonable price.
(b) Options. The Government will evaluate quotes for award purpose by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful offeror(s) within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(x) FAR provision 52.212-3, Offeror Representations and Certifications - Commercial Products and Commercial Services (MAY 2024) (DEVIATION FEB 2025).
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
