About this file
This document provides a justification for other than full and open competition for a federal contract. The National Park Service seeks to replace the operations building for the Brandy Creek Wastewater Treatment Plant in Whiskeytown National Recreation Area, California, which was destroyed in a 2018 wildfire. The project includes construction estimated at $150,000, of which $60,000 is for a prefabricated concrete building from CXT, Inc. A brand name justification is required for the CXT component as the designer coordinated directly with CXT to develop technical specifications for wastewater treatment operator and safety requirements. The building must conform to prefabricated concrete specifications and fit within the plant footprint to maintain process flows, operator certification level, power draw, and generator compatibility.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2500 for Construction/Services) AND
UP TO $150,000
(See FAR 13.106-1)
BRAND NAME JUSTIFICATION
Date: June 16, 2020 PR Number: 0040488865
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The National Park Service (NPS) recently procured a design to replace the Brandy Creek Sewer Plant controls building at Whiskeytown National Recreation Area, Shasta County, California. The original controls building was burned down during the Carr Fire in 2018. As a replacement controls building, NPS and the designer decided that the replacement building should be a pre-fabricated concrete building, which would be able to greatly withstand future wildfires and decrease construction costs as these pre-fabricated buildings are much easier to design and construct and move to site than to create onsite.
The overall construction project is estimated at , and the project specifies a brand name component. The brand name component is a pre-fabricated concrete building from CXT, Inc. which has an anticipated cost of . Contact information for the manufacturer is:

3808 N. Sullivan Road, Building 7 Spokane, WA 99216 Toll free: 800-696-5766 Fax: 509-928-8270 E-mail: sales@lbfoster.com
This brand name justification covers only the portion of the acquisition which is brand-name, and per FAR 13.501(2), the approval level requirements for this justification will then only apply to that portion.
Background for the overall construction project:
The wastewater controls and operation building for the Brandy Creek Sewer Plant was destroyed in the 2018 Carr Fire. This wastewater treatment plant serves a high-use recreation area of Whiskeytown, processing 200 gallons per minute during peak hours, handling an average 4,500 gallons per day and capable of managing up to 45,000 gallons peak day demand at holiday weekends such as Memorial Day, Independence Day and Labor Day. Without a proper operating treatment facility, Brandy Creek cannot sustainably treat wastewater for the over 800,000 annual visitors.
The CXT prefabricated building will serve as the operations building for the treatment facility that will house the controls for the building as well as other critical treatment components.
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $3,000 ($2,000/$2500 for Construction/Services AND UP
TO $150,000
(See FAR 13.106-1)

Public health and environmental health require wastewater treatment. The current (temporary) configuration of the wastewater controls at the wastewater treatment facilities does not meet proper codes.
A proper facility is needed to house and maintain the controls as well as water testing components and proper employee safety equipment. The most efficient and sustainable solution is to provide a pre-fabricated CXT building that can better withstand future wildfires. In the design, bid, build structure for procuring the construction for facility improvements, it was imperative that the design engineer coordinate directly with the pre-fabricated building provider to ensure that the building would be properly pre-fabricated. Since CXT buildings were used elsewhere on Whiskeytown National Recreation Area and in other wastewater treatment facilities, the NPS project engineer and A&E design engineer decided to utilize CXT for this large, single component of the project as their services not easily duplicable.
The wastewater treatment operations building must be constructed as designed in order to return the facility to proper operating condition to ensure public health and safety and protection of the environment.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
__ ___ Other: Brand Name Justification, in accordance with FAR 13.501
Explain: In developing the design, the designer had to work closely with a prefabricated building vendor to develop a design for the building and ensure that it was compatible with the outside project components. CXT has experience of providing prefabricated buildings for wastewater treatment plants that meet design requirements for the wastewater treatment operator and OSHA safety standards. These unique design features included eye wash station, water heater, and laboratory layout.
NPS requires the CXT prefabricated wastewater operations building include ALL of the following technical salient characteristics:
1. Be pre-fabricated concrete and conform to the rigid specifications defined in specifications Section 13 34 23.
2. Physical size and shape: must fit within the footprint of the existing plant to support process flows.
3. Maintain the current level of operator certification (process complexity may not increase).
4. Maintain the current level of power draw to stay within available power service and be able to support the properly sized standby generator and automatic transfer switch.
