Questions and Answers:

Q1. A review of the wage determination contained in the solicitation documents shows lacks wage rates for divers. A search of all other current Davis-Bacon wage rate determinations for Nevada also shows no current active wage rates for divers. Is there another applicable wage rate determination that we should be using for the diver's wage rates.

A1. Utilize $73.97 inclusive of rate and fringes. DOL Conformance information can be found at:

https://sam.gov/content/wage-determinations/resources/dba-conformances

Q2. Specification section 31 20 00-4, paragraph 3.3.B. Excavation, mentions that the contractor should bid the project assuming all soil and rock will be rippable with standard construction equipment. Can government please clarify if an excavator with a ripper tooth attachment considered as a standard construction equipment?

If rock is encountered which cannot be ripped with a ripper tooth, Can the contractor assume that we will be allowed to request a modification for change of conditions.

A2. Yes, an excavator with a ripper tooth attachment would be considered standard construction equipment. If rock is encountered which cannot be ripped with standard construction equipment, it may be considered a change of condition.

Q3. Sheet 7 of 22: Erosion control plan, Call-out note mentions that the Turbidity curtain shall encompass entire work area, does this mean only the active in-water work area of each CLIN or the entire work area of the contract from station 8+14 to station 19+40? It will be very challenging for the contractor to maintain the turbidity curtain for the entire work area, can government please confirm if only the active in-water work area requires turbidity curtain installation?

A3. Confirm, turbidity curtains are only required around the active in-water work area to contain any sediments disturbed from work activities. For reference, the 401 water quality certification permit requires turbidity curtains "around the anticipated area of impact during construction activities" remaining in place "until suspended sediment has settled and turbidity levels meet water quality standards".

Q4. Will a bubble curtain installation in an active in-water work area along with a turbidity curtain entrance/exit gate with turbidity monitoring measures be acceptable in lieu of Type III -Turbidity Curtain?

A4. Bubble curtain would not meet the materials requirements in Section 35 01 01 of the Specifications.

Bidders should assume a turbidity curtain will be required for control of sediments in water.

Q5. Because the site visit occurred less than two weeks before the bid due date, we respectfully request an extension of two weeks to the current October 28 bid due date.

A5. A two-week extension with proposals due on November 12th (Nov 11th is a federal holiday) is acceptable.

Q6. For Factor 3, Key Personnel, can the Superintendent or the Quality Control Manager, if appropriately qualified, also perform the Site Safety Officer?

A6. The superintendent may not serve in any other key personnel position. Given the size of the site and scope of the project, it is acceptable for other key personnel to perform multiple roles if appropriately qualified.

Q7. May the ISBEE prime contractor submit project experience from other wholly owned subsidiaries of our parent company, (i.e., our ISBEE sister companies) for Factor 2, Project Experience and Factor 7, Past Performance.

https://sam.gov/content/wage-determinations/resources/dba-conformances

A7. Please submit project experience for the ISBEE entity that will be proposing on this solicitation.

Q8. For Factor 7, Past Performance, will you accept a Past Performance Questionnaire previously completed by the client for a different proposal submission?

A8. Ensure Past Performance Questionnaire is compliant with Section L of the RFP.

Q9. For Factor 2, Project Experience and Factor 7, Past Performance, will you accept projects that are 85% or higher substantially complete?

A9. Submit the attached "Project Experience" form addressing specific experience aspects below for up to 3 relevant projects completed in the last 5 years.

Q10. A review of the wage determination contained in the solicitation documents lacks wage rates for divers / diving related trades. A search of all other current Davis-Bacon wage rate determinations for Nevada also shows no current active wage rates for divers. Is there another applicable wage rate determination that we should be using for the diver's wage rates and if so what is that determination?

A10. Utilize $73.97 inclusive of rate and fringes. DOL Conformance information can be found at:

https://sam.gov/content/wage-determinations/resources/dba-conformances

Q11. Section H, Key Personnel. 01 31 00 Project Management and Coordination, 1.8A Can key personnel listed in Section H, and Environmental Manager listed in 01 31 00, fulfill multiple responsibilities (wear dual hats, etc.)?

A11. The superintendent may not serve in any other key personnel position. Given the size of the site and scope of the project, it is acceptable for other key personnel to perform multiple roles if appropriately qualified.

Q12. Factor 2-Project Experience. Can ongoing projects from major teaming subcontractor's project experience be included to meet this requirement? The current project is in excess of $40 Million, 50% complete, and is very relevant to this project given its scope. Preliminary CPARS are available if needed.

A12. Submit the attached "Project Experience" form addressing specific experience aspects below for up to 3 relevant projects completed in the last 5 years.

Q13. We are only required to submit the electronic copy as a part of the Volume II- Business Proposal, and we are NOT required to submit the originally executed hard copy at all, is that correct?

A13. Yes.
