About this file
This letter from the Hawaii Department of Transportation confirms temporary access approval for a construction project by the United States Fish and Wildlife Service. The conditions specified are that the USFWS must immediately apply for a permanent access grant upon conveyance of the Hanalei Valley Viewpoint property, not open the viewpoint to the public until a permanent access grant is acquired, and return the highway right-of-way to its original condition if a permanent grant is not acquired by December 31, 2021, though that deadline may be extended by mutual agreement. Construction plans for developing the viewpoint under solicitation number 140P2021R0114 can begin once approved by the Hawaii DOT, provided the terms of the conditional approval letter are followed.

Dear Mr. Parrott:

This letter is confirmation that an executed Grant of Access will not be required to begin construction of your project. Temporary access for construction purposes only will be allowed, with the following conditions:
1. Immediately upon conveyance of the Hanalei Valley Viewpoint property to the United States Fish & Wildlife Service (USFWS), the USFWS will apply for a permanent Grant of Access from the Hawaii Department of Transportation (HDOT).
2. The Hanalei Valley Viewpoint will not open to the public until a permanent Grant of Access from the HDOT is acquired.
3. If the permanent Grant of Access is not acquired by December 31, 2021 then the USFWS will be responsible for returning the Kuhio Highway right-of-way to original or better condition. This deadline may be extended by mutual agreement.
4. After the construction plans are approved by HDOT, the work for the project can begin with the signed conditional letter. The terms and conditions of the conditional letter must be kept.
