About this file

The solicitation number is 140L1226Q0019, issued July 13, 2026, with quotations due by July 31, 2026 at 6:00 PM Pacific Time via email to Branden_Bayze@ios.doi.gov. The period of performance runs from August 10, 2026 to October 9, 2026 (60 calendar days), with contractor performance to begin within 7 calendar days of award. This is a small business set-aside under NAICS code 237310 (Highway, Street, and Bridge Construction) with a $45 million annual receipts threshold.
The contract requires full-depth asphalt pavement repairs including removal and replacement with 3/8-inch NMAS PG64-10 Hot Mix Asphalt, tack coat application, Class II aggregate base installation, and shoulder backing. Contractor must provide a certified independent testing subcontractor to verify 92% or greater asphalt density and 95% or greater shoulder backing maximum density compliance. Technical evaluation is on a Pass/Fail basis requiring submission of equipment inventory, material specifications, ADA compliance execution strategy for smooth pavement transitions (maximum 0.25 inch vertical deviation over 10 feet), and a realistic project schedule accommodating working hours of 8:00 AM to 4:30 PM Monday through Friday excluding federal holidays, with best management practices to prevent sediment tracking into adjacent salmon habitat. Price is the secondary evaluation factor assessed for mathematical accuracy and fairness. A performance and payment bond is required within 10 calendar days of award. Offerors must submit a 20% bid guarantee (SF 24 Bid Bond or acceptable alternative) with their quotation and maintain vehicular liability insurance of $100,000 per person and $500,000 per occurrence, plus property damage of $100,000 per accident and $500,000 aggregate. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the
Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.
(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

RFO 52.212-2 Evaluation - Commercial Products and Commercial Services (MAR 2026)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
FACTOR 1: TECHNICAL ACCEPTABILITY
The Government will evaluate the quoter's technical submittals on a Pass/Fail (Acceptable/Unacceptable) basis. To be determined technically acceptable, the quoter must submit a technical proposal or work plan that satisfies all of the following evaluation criteria:
• Subcontractor & Certification Capability:
o The quoter must explicitly identify and provide qualifications for a certified, independent testing subcontractor who will perform the mandatory 92% or greater asphalt density testing and 95% or greater shoulder backing maximum density testing required by the SOW.
• Equipment & Operational Resource Sufficiency:
o The quoter must provide an equipment inventory or operational narrative demonstrating immediate access to a commercial asphalt paver, a pavement sawcutter (for straight-line full-depth repairs), a tack coat distributor, and compaction equipment capable of achieving specified densities.
• Material Specification Conformance:
o The quoter must provide a written commitment or preliminary mix design sheet confirming that all contractor-furnished materials will strictly meet project specifications, including 3/8-inch NMAS PG64-10 Hot Mix Asphalt
(HMA), FHWA FP-14 Section 411 compliant tack coat, and standard Class II aggregate base for the 6-inch subgrade patch depth and 2-inch shoulder backing taper.
• ADA/ABA Compliance Execution Strategy:
o The quoter must provide a brief, acceptable technical narrative detailing their engineering approach to Task 5
(Pavement Conformance at the HEC Barn). The narrative must demonstrate an understanding of how to construct a smooth, ADA-compliant transition using grinding or tapering with no vertical deviation greater than 0.25 inches over 10 feet.
• Schedule Realism & Operational Constraints:
o The quoter must provide a project schedule demonstrating a realistic sequence of tasks (mobilization, surface prep, full-depth repairs, overlay, shoulder backing, and demobilization) capable of reaching completion within the mandatory 60-calendar-day Period of Performance.
o The schedule and narrative must explicitly account for the regular working hour constraints (8:00 AM to 4:30 PM, Monday through Friday, excluding federal holidays) and outline standard best management practices (BMPs) to prevent sediment tracking into the adjacent salmon habitat.
FACTOR 2: PRICE
Price will be evaluated based on the total overall cost submitted in the Quote Schedule. Quotes will be assessed for mathematical accuracy and completeness across all CLINs. The Contracting Officer will evaluate the total proposed price to ensure it is fair and reasonable in accordance with FAR 12.203 and simplified acquisition parameters.
In the event of a tie, the Contracting Officer has the discretion to determine how the tie will be resolved. The Contracting Officer may assess which quote is more advantageous to the Government or may apply the guidance provided in FAR 14 and 15.
(b) Proocedures and Communication
In accordance with FAR 12.203, the Contracting Officer reserves the right to communicate with any, all, or none of the quoters regarding technical or pricing details, and may request revised quotations without being required to hold formal discussions or open a formal competitive range.
15 | P a g e
(c) Late Submissions
Per FAR 12.203(c)(1), the Contracting Officer reserves the right to exercise good business judgment in deciding whether or not to accept a quotation or modification received after the exact closing date and time specified in this solicitation.
(d) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(e) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.228-1 BID GUARANTEE (September 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under
Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds --
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20% of the bid price or $3 million, whichever is less
d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.)
