About this file
This is a Nationwide Permit (NWP) Verification letter from the U.S. Army Corps of Engineers, Omaha District, Montana Regulatory Office, dated November 20, 2025, authorizing dam maintenance and rehabilitation work at Melstone Reservoir in Musselshell County, Montana.
The Bureau of Land Management (BLM) submitted a Pre-construction Notification on September 16, 2025, for the Melstone Dam Reconstruction project. The Corps verified that the work qualifies for authorization under NWP 3, Maintenance, which regulates discharge of dredged and fill material under Section 404 of the Clean Water Act and structures in navigable waters under Section 10 of the Rivers and Harbors Act. The project consists of four primary components: outlet demolition removing 76 feet of existing 24-inch reinforced concrete pipe with 0.03 acre temporary impact above the ordinary high-water mark (OHWM); outlet construction installing 120 feet of 30-inch pipe, a 58-foot by 53-foot stilling basin, 11-foot inlet tower, and 475-foot toe drain resulting in 0.05 acre impact below OHWM; slope stabilization using approximately 5,380 cubic yards of riprap material for upstream protection with 0.6 acre impact below OHWM; and project completion in accordance with plans dated November 22, 2024. The NWP verification is valid until March 14, 2026, provided no deviations occur from the approved plans. The BLM must submit a signed Compliance Certification form within 30 days of project completion, and authorization does not relieve the permittee from obtaining other required federal, state, or local permits. The project manager is Colten Shimer, reachable at Colten.D.Shimer@usace.army.mil or (406) 200-2689.
